PC - 1982-04 - Conditional Use Permit 80-201 at 4110 Temple City Blvd And 9739 Abilene StPC RESOLUTION 82-4 FOLLOWS: r A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF. ROSEMEAD GRANTING CONDITIONAL APPROVAL FOR AN EXPANSION OF CONDITIONAL USE PERMIT 80-201, ON PROPERTY'LOCATED AT 4110 TEMPLE CITY BOULEVARD AND 9739 ABILENE STREET, ROSEMEAD, CALIFORNIA. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS Section 1. The Planning Commission of the City of Rosemead does hereby find and determine that an application was duly filed by Tomei Shogi Company, Ltd., requesting the expansion of Conditional Use Permit 80-201, to conduct an existing dog kennel on property located at: 9739 Abilene Street and 4110 Temple City Boulevard, Rosemead, California; and that a public hearing was duly scheduled for November 16, 1981, at 7:30 p.m., and continued to December 7, 1981, January 4, 1982, and January 18, 1982 at 7:30 p.m., in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California; and that notice of the time, date, place, and purpose of the aforesaid hearing was duly given according to law; and that a public hearingwas duly conducted at the aforementioned times and place. Section 2. The Planning Commission further finds and determines that facts do exist as required by Section 9180., et. seq., of the Ordinances of the City of Rosemead, justifying the granting of a conditional use permit expansion. Section 3. The Planning Commission further finds: 1. The project is in harmony with the elements and objectives of the General Plan. ~r ,Y' 2. The project will not be detrimental.to the surrounding properties. 3. The project is desirable to the public convenience. 4. On the basis of evaluation, this project has been determined to be a Class Nine categorical exemption under the provisions of the California Environmental Quality.Act. A Notice of Exemption was filed with the County Clerk. Section. 4. Based on the aforementioned findings, this Planning Commission hereby grants an expansion of a conditional use permit with respect to the property described in Section 1 of this Resolution, subject to the conditions set forth in Exhibit "A" (attached), and the addition of the following conditions: 1. The site shall be maintained in accordance with Section 9181.1 of the Rosemead Municipal Code. 2. The applicant shall obtain an approved Occupancy Permit from the Building Department. 3. The applicant shall comply with all requirements of the Los Angeles County Animal Control Department relevant to the obtaining and complying with all appropriate licenses. 4. The property shall be maintained in a neat, and orderly fashion at all times. 5. Applicants shall remove all barbed wire from the site. 6. The applicants shall submit a notarized Affidavit of Agreement to all conditions, within ten (10) days of.approval of this expansion of the conditional use permit. 7. All conditions placed on the original conditional use permit shall be applicable to this extension. 8. All conditions to be fully implemented within one (1) year's period of time. 9. The applicant shall keep and maintain "small" dogs as represented at the public hearing on January 18, 1982. • PC Resolution 82-4 Page Two 10. This conditional use permit shall be limited to two (2) years and be available for extension without a public hearing. ll. The overnight kennel area shall be located at the northeast end of the property. Section 5. This action shall become final and effective ten (10) days after this decision by the Planning Commission, unless within. such time, a written appeal is filed with the City Clerk for consideration by the Rosemead City Council, as provided in the Zoning Ordinance. Section 6. This resolution is the result of an.action taken by the Planning Commission on January 18, 1982, by the following vote: AYES: De Cocker, Schymos, Lowrey, Ritchie, Matterr, NOES: None ABSENT: None ABSTAIN: None Section 7. The secretary shall certify to the adoption of this Resolution and shall transmit copies of same to the applicant and Rosemead City Clerk. ADOPTED this 1st day of March 1982.
