PC - 1982-03 - Denying Conditional Use Permit 81-234 At 9432 Valley Blvd0 PC RESOLUTION 82-3 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DENYING CONDITIONAL USE PERMIT 81-234 FOR THE ESTABLISHMENT OF A CONVENIENCE MARKET TO BE OPERATED IN CONJUNCTION WITH A NEW SERVICE STATION ON PROPERTY LOCATED AT 9423 VALLEY BOULEVARD, ROSEMEAD, CALIFORNIA. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission of the City of Rosemead does hereby find and determine that an application was duly filed by Min Seong Kang and Mi Yong Kang, requesting the establishment of a new convenience market and service station, to be known as , "K.S. Market", and to be located at: 9423 Valley Boulevard, Rosemead, California; and that a public hearing was duly scheduled for December 21, 1981, at 7:30 p.m., in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California; and that notice of the time, date, place and purpose of the aforesaid hearing was duly given; and that a public hearing was duly conducted at the afore- mentioned time and place. Section 2. The Planning Commission further finds and determines that facts do not exist as required by Section 9180., et. seq., of the Ordinances of the City of Rosemead, justifying the granting of a conditional use permit. Section 3. The Planning Commission further finds: 1. The Planning Commission generally found that the project did not satisfy the minimum lot size for a service station; that the proposed mixed uses would lead to overcrowding on a non-conforming lot., and the proposed project would not be more beneficial than what presently exists on the property. 2. The project is not in harmony with the elements and objectives of the General Plan. 3. The project will be detrimental to the surrounding properties, as the property is not of suitable size to support the number of proposed uses. 4. The project is not desirable to the public convenience. 5. On the basis of evaluation, this project has been determined to be a Class Nine categorical exemption under the provisions of the California Environmental Quality Act. A Notice of Exemption was filed with the County Clerk. Section 4. Based on the aforementioned findings, the Commission hereby denies a conditional use permit with respect to the property described in Section 1 of this Resolution. Section 5. This action shall become final and effective ten (10) days after this decision by the Planning Commission, unless within such time, a written appeal is filed with the City Clerk for consideration by the Rosemead City Council, as provided in the Zoning Ordinance. Section 6. This resolution is the result of an action taken by the Planning Commission on December 21, 1981;_by the following vote: AYES: De Cocker, Schymos, Lowrey, Ritchie, Mattern NOES: None ABSENT: None ABSTAIN: None Section 7. The secretary shall certify to the adoption of this Resolution and shall transmit copies of same to the applicant and Rosemead City Clerk.
