PC - 1982-01 - Granting Conditional Use Permit 81-239 At 3001 Walnut Grove AvePC RESOLUTION 82-1 0 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL USE PERMIT 81-239 ALLOWING THE SALE OF ALCOHOLIC BEVERAGES ON PROPERTY LOCATED AT 3001 14ALNUT GROVE AVENUE, ROSEMEAD, CALIFORNIA. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission of the City of Rosemead does hereby find and determine that an application was duly filed by Manuel Toraya, requesting the sale of alcoholic beverages for on-site consumption in conjunction with an existing racquetball club, known as "Rosemead Racquetball Club", and located at: 3001 Walnut Grove Avenue, Rosemead, California; 'f and that a public hearing was duly scheduled for January 4, 1982, at 7:30 ?).rc., in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California; and that notice of the time, date, place, and purpose of the aforesaid hearing was duly given; and that a public hearing was duly conducted at the afore- mentioned time and place. Section 2. The Planning Commission further finds and determines that facts do exist as required by Section 9180., et. seq., of the Ordinances of the City of Rosemead, justifying the granting of a conditional use permit. Section 3. The Planning Commission further finds: 1. The project is in harmony with the elements and objectives of the General Plan. 2. The project will not be detrimental to the surrounding properties. 3. The project is desirable to the public convenience. 4. On the basis of evaluation, this project has been determined to be a Class Nine Categorical Exemption under the provisions of the California Environmental Quality Act. A Notice of Exemption was filed with the County Clerk. Section 4. Based on the aforementioned findings, the Commission hereby grants a conditional use permit with respect to the property described in Section 1 subject to the following conditions: 1. That the license be issued for three (3) years and may be extended, upon request of the applicant, by the Planning Commission without benefit of a public hearing. 2. Sale of alcoholic beverages shall be limited to members and their paying guests. 3. Sale of alcoholic beverages shall terminate one (1) hour after closing, except in the case of special events. 4. There shall be no signs advertising the sale of alcoholic beverages visible from the public right-of-way. Section 5. This action shall become final and effective ten (10) days after this decision by the Planning Commission, unless within such time, a written appeal is filed with the City Clerk for consideration by the Rosemead City Council, as provided in the Zoning Ordinance. Section 6. This resolution is the result of an.action taken by the Planning Commission on January 4, 1982,-by-the following vote: AYES: De Cocker, Schymos, Lowrey, Ritchie, Mattern NOES: None ABSENT: None ABSTAIN: None PC Resolution 82-1 Page Two Section 7.
