PC - 1982-41 - Granting Conditional Approval Of Parcel Map 15448PC RESOLUTION 82-41 FOLLOWS: ~1 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL APPROVAL OF PARCEL MAP 15448. (A ONE-LOT SUBDIVISION INTO TWO SEPARATE PARCELS.) THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS Section 1. The Planning Commission of the City of Rosemead does hereby find and determine that an application was duly filed by Michael Mangana and Owen Development Company, requesting a one-lot subdivision into two separate parcels for property located at 3154 Muscatel Avenue; or more specifically known as: In the City of Rosemead Lot 122 of Tract No. 3706 as per map recorded in Book 40 Page 39 of maps in the Office of the County Recorder of Los Angeles County; and that a public hearing was duly scheduled for December 6, 1982, at,7:30 p.m., in the Council Chambers of Rosemead City Hall, 8838 Valley ,Boulevard, Rosemead, California; and that notice of the time, date, place, and purpose of the aforesaid hearing was duly given according to law; and that a public hearing was duly conducted at the aforementioned time and place. Section 2. The Planning Commission further finds and determines that this request is in conformance with the Land Use Element of the General Plan, and; 1. The proposed map is consistent with the applicable General Plan of the City of Rosemead. There is no specific plan. 2. The design of the proposed subdivision and improvements are consistent with the applicable General Plan. There is no specific plan. 3. The site is physically suitable for the type of development. 4. The site is suited for the proposed density of development. 5. The design of the subdivision will not conflict with public easements. 6. The design and proposed improvements of the.subdivision will have no adverse environmental effects on fish, wildlife or their habitat, or cause any public health problems. A Negative Declaration was prepared and adopted in compliance with Rosemead Resolution 79-77, CEQA, and the guidelines for the implementation of CEQA. 7. Discharge of wastes from the proposed subdivision will not result in the violation of existing requirements as prescribed by the California Regional Water Board. 8.?_ That the Commission recognizes the need to establish a Zoning ordinance governing flag lot develo pments, and intends on developing such ordinance within the near future. 9. That as an interim means of evaluating flag lot developments, the Commission's existing policy of specific criteria is appropriate for development requests on a case-by-case basis. 10. That the proposed subdivision exceeds both minimum code and policy criteria for building lot area requirement and that, in this case, an approval of a variance for lot width (street frontage) is in keeping with such criteria. 11. That the granting of a variance will allow for the development of two new single-family homes and will not create an adverse effect on surrounding properties because of the limited scope of the proposal; however, the Commission is committed to reviewing such developments for potential cumulative effects. 12. That the variance was subject to conditions of approval (reference Parcel Map 15448, conditions contained herein), assuring that the zoning adjustment was not the granting of a special privilege incon- sistent with the limitations placed upon other properties within the vicinity and zone. r. - a 0 PC Resolution 82-41 Page Two 13. That special circumstances exist, with respect to lot size and property condition that the strict application of the Zoning Ordinance would deprive the subject property of privileges enjoyed by other properties in the vicinity. 14. That the granting of such variance will not adversely effect the comprehensive General Plan. Section 3. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Rosemead does approve the request for subdivision of that parcel of land described in'Section 1,,-su§ject to the following conditions: 1. Comply with conditions as set forth in:.the Deputy City Engineer's Report dated November 24, 1982, and the Fire Department recommendations dated November 24, 1982 (Exhibit "A" attached hereto and incorporated herein by this reference). 2. The interior property line of the newly-created lot, and where desig- nated by the Director of Planning,. the perimeter property line, shall be fenced with a six-foot (6') high masonry or wooden fence. If a wooden fence is installed, the fence shall be supported by steel posts set in concrete. Said fence shall be installed prior to recordation of the parcel map or bonded to assure compliance within one (1) year of recordation. 3. The existing house and detached garage are to be demolished prior to the recordation of the parcel map. 4. The final parcel map reflect a 15-foot fire lane, in fee, and that a sign restricting parking be located at an obvious.location within said fire lane. 5. The applicant shall sign an Affidavit of Agreement, and return it to the Planning Department within ten (10) days of approval of this request. Section 4. The secretary shall certify to the adoption of this resolution and transmit copies thereof to the City Clerk of the City of Rosemead. Section 5. CITY ENGINEER CONDITIONS OF APPROVAL FOR PARCEL MAP NO. 15448 General: The City Engineer has reviewed the subject parcel map and is recommending the following conditions: Details shown on the tentative map are not necessarily approved. Any details which are inconsistent with requirement of ordinances, general conditions of approval, or City Engineer's policies must be specifically approved in the other conditions of these minutes. A parcel map prepared by, or under the direction of, a Registered Civil Engineer or Licensed Land Surveyor must be processed through the City Engineer's office prior to being filed with the County Recorder, unless said map is waived by the Advisory Agency. Prior to submitting the parcel.map to the City Engineer for approval by the Planning Commission pursuant to Section 66442 of the Government Code, obtain clearances from all departments, divisions and utility companies which have set conditions of approval on this subdivision. A preliminary parcel map guarantee is needed showing all fee interest holders; all interest holders whose interest could ripen into a fee; all trust deeds, together with the name of the trustee; and all easement holders. The account for this title report should remain open until the final parcel map is filed with the County Recorder.. Easements shall not be granted or recorded within rights-of-way proposed to be deeded or dedicated for public streets,' until after the tract is recorded, unless such easements are subordinated to the road easement by certification on the title sheet of the final map. Drainage and Grading: Approve of this map pertaining to local drainage is recommended.
