A'. RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, GRANTING
CONDITIONAL APPROVAL OF CONDITIONAL USE PERMIT 82-250 FOR THE CONTINUED
SALE OF ALCOHOLIC BEVERAGES FOR OFF-SITE CONSUMPTION, ,ON PROPERTY-LOCATED
AT 2525 NORTH SAN GABRIEL BOULEVARD, ROSEMEAD, CALIFORNIA.
THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS
FOLLOWS:
Section 1. The Planning Commission of the City of Roesmead.does hereby
find and determine that an application was duly filed by Edward S. Chuen, requesting
the continued sale of alcoholic beverages for off-site consumption, in conjunction
with an existing liquor store, known as "Casa De Liquor", and located at:
2525 North San Gabriel Boulevard, Rosemead, California;
and that a public hearing was duly scheduled for November 1, 1982, at 7:30 p.m., in
the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California;
and that notice of the time, date, place and purpose of the aforesaid hearing was duly
given according to law; and that a public hearing was duly conducted at the afore-
mentioned time and place.
Section 2. The Planning Commission further finds and determines that facts
do exist as required by Section 9180., et. seq., of the Ordinances of the City of
Rosemead, justifying the granting of a conditional use permit.
Section 3. The Planning Commission further finds:
1. The project is in harmony with the elements and objectives of the
General' Plan.
2. The project will not be detrimental to the surrounding properties.
3. The project is desirable to the public convenience.
4. On the basis of evaluation, this project has been determined to be a
Class 9 categorical exemption under the provisions.of.the California
Environmental Quality Act.
Section 4: Based on the aforementioned findings, the Planning Commission
hereby grants a conditional use permit with respect to the property described in
Section 1, subject to the following conditions:
1. Applicant shall apply for City business license, occupancy permit, and
applicable license with the Department.of Alcoholic Beverage Control.
2. The trash receptacle is to be properly enclosed and screened to the
satisfaction of the Planning Director.
3. The parking area is to be repaved and the spaces striped in compliance
with Part XXII, Section 9122 of the Rosemead Municipal Code.
4. The wall of all structures on the subject property are to be maintained
in a graffiti-free state.
5. Comply with all requirements of the Building, Fire and Health Depart-
ments.
6. The subject property shall be maintained in a clean, litter-free state
in accordance with Sections 5401-5415 of the Rosemead Municipal Code.
This includes the removal of glass, and other debris from both parking
areas on the property, the abutting sidewalks, and the roof area.
7. This permit is granted-for a-period-of two (2)~,years at whichatime it
may be renewed by the Planning Commission without a public hearing.
8. This permit is not transferable.to future owners and/or occupants.
9. The metal fence at the rear of the property shall be repaired.
10. All conditions requiring the action of the applicant shall be accomplished
within sixty (60) days,of approval.

11. Within ten (10) days of the date of approval, the applicant shall
submit a notarized Affidavit of Agreement to the above conditions
with the Planning Department, and shall, within a reasonable period
of time, satisfy these conditions with the knowledge that failure to
do so may result in the revocation of this conditional use permit.
12. The chain link enclosures around the compressors and air conditioners
on the south side of the building, and around the storage area on the
northwest corner of the.lot shall provide an enclosure and visual
relief to the satisfaction of the Planning Director.
13. South side of the storage building shall be restuccoed.
14. Install photoelectric sensors that will turn the flood lights on at
dusk and off at dawn.
15.. Signing shall conform to the Sign Ordinance, Section 9906. of the
Rosemead Municipal Code.
Section 5. This action shall.become final and effective ten (10) days
` after this decision by the Planning Commission, unless within such time, a written
appeal is filed with the City Clerk for consideration by the Rosemead City Council,
as provided in the zoning Ordinance.
Section 6. This resolution is the result of an action taken by ,the Planning
Commission on November 1, 1982, by the following vote:
AYES: De Cocker, Ritchie, Schymos, Mattern
NOES: None
ABSENT: Lowrey
ABSTAIN: None
Section 7. The secretary shall certify to the.adoption of this resolution
and shall transmit copies of same to the applicant and Rosemead City Clerk.
