A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, GRANTING
CONDITIONAL USE PERMIT 82-249 FOR THE CONTINUED SALE OF ALCOHOLIC BEVERAGES
ON PROPERTY LOCATED AT 7705 EAST GARVEY AVENUE, ROSEMEAD, CALIFORNIA.
THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS
FOLLOWS:
Section 1. The Planning Commission of the City of Roesmead does hereby
r find and determine that an application was duly filed by Ty Huynh, requesting the
continued sale of alcoholic beverages for off-site consumption, in conjunction with
an existing liquor store, formerly known as "Tanya's Mini Market", and located at:

7705 East Garvey Avenue, Rosemead, California;
and that a public.hearing was duly scheduled for October 4, 1982, at 7:30 p.m., in
the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead,
California; and that notice of the time, date, place, and purpose of the aforesaid
hearing was duly given according to law; and that a public hearing was duly conducted
at the aforementioned time and place. .
Section 2. The Planning Commission further finds and determines that facts
do exist as required by Section 9180., et. seq., of the Ordinances of the City of
Rosemead, justifying the granting of a conditional use permit.
Section 3. The Planning Commission further finds:
1. The project is in harmony with the elements and objectives of the
General Plan.
2: The project will not be deterimental to the surrounding properties.
3. The project is desirable to the public convenience.
4. On the basis of evaluation, this project has been determined to be a
Class 9 categorical exemption under.the provisions of the California
Environmental Quality Act.
Section 4. Based on the aforementioned findings, the Planning Commission
hereby grants a conditional use permit with respect to the property described in
Section 1, subject to the following conditions:
1. Applicant shall apply for the appropriate City of Rosemead occupancy
permit.
2. Maintain the property in a clean and litter-free state in accordance
with Section 5404-5415 of the Rosemead Municipal Code.
3. This conditional use permit shall be approved for a period of one (1)
year, at which time it may be reviewed for renewal by the Planning
Commission without benefit of a public hearing.
4. All signs shall be maintained in good condition and repair and shall
pose no hazard to public safety statues, standards and ordinances, as.
mandated in Section 9902(G) of the Zoning Ordinance.
5. Windows shall remain clear and unobstructed providing that no more than
15% of any window may be covered by signs or any other obstruction.
A night light of sufficient wattage shall be installed to illuminate
the inner-most portion of the business at all times, and meet to the
satisfaction of the Director of Planning.
6. The Certificate of occupancy shall not be issued unless all conditions
are complied with within thirty (30) days, in accordance with Section
9189.1 of the Rosemead Municipal Code.
7. Within ten (10), days of approval, the applicant shall submit a notarized
Affidavit of Agreement to all conditions.
8. Two parking spaces shall be designated for mini market use only by
signs two square feet in size, assigning the parking spaces, to the
satisfaction of the Director of Planning.

9. Hours of operation shall not exceed 7:00 a.m. to 10:00 p.m.
Section 5. This action shall become final and effective ten (10) days
after this decision by the Planning Commission, unless within such time, a written
appeal is filed with the City Clerk for consideration by the Rosemead City Council,
as provided in the Zoning Ordinance.
Section 6. This resolution is the result of an action taken by the
Planning Commission on October 4, 1982, by the following vote:

Section 7. The secretary shall certify to the adoption of this Resolution
and shall transmit copies of same to the applicant and.Rosemead City Clerk.
