A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, GRANTING CONDITIONAL USE PERMIT 82-248 FOR THE CONTINUED SALE OF ALCOHOLIC BEVERAGES ON PROPERTY LOCATED AT 9119 EAST GARVEY AVENUE, ROSEMEAD, CALIFORNIA. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission of the City of Rosemead does hereby find and determine that an application was duly filed by Chong Keun and Myung Bee Kim requesting the continued sale of alcoholic beverages for off-site consumption, in conjunction with an existing liquor store known as "Garvey Liquor", and located at: 9119 East Garvey Avenue, Rosemead, California; and that a public hearing was duly scheduled for September 20, 1982, at 7:30 p.m., in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California; and that notice of the time, date, place, and purpose of the aforesaid hearing was duly given according to law;, and that a public hearing was duly conducted at the aforementioned time and place. Section 2. The Planning Commission further finds and determines that facts do exist as required by Section 9180., et. seq., of the Ordinances of the City of Rosemead, justifying the granting of a conditional use permit. Section 3. The Planning Commission further finds: 1. The project is in harmony with the elements and objectives of the General Plan. 2. The project will not be detrimental to the surrounding properties. 3. The project is desirable to the public convenience. 4. On the basis of evaluation, this project has been determined to be a Class 9 categorical exemption.under the provisions of the California Environmental Quality Act. Section 4. Based on the aforementioned findings, the Planning Commission hereby grants a conditional use permit with respect to the property described in Section 1, subject to the following conditions: 1. Restripe the parking area. 2. Maintain the property in a clean and orderly fashion at all times. 3. Construct a covered masonry trash enclosure. All trash shall be placed in bins within the enclosed area. 4. Paint all exterior walls of the building and repaint the business signs. 5. This conditional use permit shall be granted for a period of one (1) year and the applicants may apply for an extension without a public hearing. 10. The applicant shall sign an affidavit of agreement to the above conditions within 10 days of the date of approval. All conditions shall be complied with within 60, days of the date of approval. This action shall become final and effective ten (10) days after this decision by the Planning Commission, unless within such time, a written appeal is filed with the City Clerk for consideration by the Rosemead City Council, as provided in the Zoning Ordinance. Section 6. This resolution is the result of an action taken by the Planning Commission on September 20, 1982, by the following vote: AYES: De Cocker, Schymos, Ritchie, Lowrey, Mattern NOES: None ABSENT: None ABSTAIN: None Section 7. The secretary shall certify to the adoption of this Resolution and shall transmit copies of same to the applicant and Rosemead City Clerk. ADOPTED this 4th day of Octnhar 1982. Flood lights shall be installed on the west wall to illuminate the driveway and two other lights shall be installed on the rear of the building. All lights shall be operated from dusk to dawn, and be controlled by photo electric devices. 8. Hours of operation - not to open before 6:00 a.m. or close after 10:00 p.m.
