PC - 1982-28 - Granting Conditional Use Permit 82-247 At 7619 Garvey Ave~VI PC RESOLUTION 82-28 DAT~_./9_ A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, GRANTING CONDITIONAL",USE_PERMIT 82-247 FOR THE EXPANDED SALE OF ALCOHOLIC BEVERAGES ON PROPERTY LOCATED AT 7619 GARVEY AVENUE, ROSEMEAD, CALIFORNIA. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission of the City of Rosemead does hereby find and determine that an apnlication was duly filed by the Alpha Beta Company, requesting the expanded sale of alcoholic beverages for off-site consumption, in conjunction with an existing market, known as "Alpha Beta Market", and located at: 7619 East Garvey Avenue, Rosemead, California; and that a public hearing was duly scheduled for September 7, 1982, at 7:30 p.m., in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California;' and that notice os the time, date, place and purpose of the aforesaid hearing was duly given; and that a public hearing was duly conducted at the aforementioned time and place. Section 2. The Planning Commission further finds and determines that facts do exist as required by Section 9180., et. seq., of the Ordinances of the City of Rosemead, justifying the granting of a conditional use permit. Section 3. The Planning Commission further finds: 1. The project is in harmony with the elements and objectives of the General Plan. 2. The project will not be detrimental to the surrounding properties. 3. The project is desirable to the public convenience. 4. On the basis of evaluation, this project has been determined to be a Class Nine categorical exemption under the provisions of the California Environmental Quality Act. Section 4. Based on the aformentioned findings, the Planning Commission hereby grants a conditional use permit with respect to the property described in Section 1, subject to the following conditions: 1. This conditional use permit shall be approved for a period of one (1) year or until such time as a transfer of ownership should take place, or there is a change of use in the market. The market's receiving and trash bin area (located directly to the rear or north side of the structure) shall be kept free of all junk, trash and debris at all times, and shall be kept washed down at least once a week. A licensed pest control service shall be utilized on at least a monthly basis in an effort to control pests and rodents to diminish the possibility of health problems to the neighborhood. 4. Within ten (10) days of approval of this conditional use permit, the applicants shall submit a signed and notarized Affidavit of Acceptance of all conditions. 5. The market management shall be charged with the responsibility for the continuous policing of the loading and trash areas to prevent loitering and littering. 6. Wash down the sidewalks directly in front of the store at least once a week. PC Resolution 82-28 Page Two 7. The Fire Department shall review the southeast exit door and provide a written opinion as to what shall be required and the market shall comply with any directives contained in that report. The report shall be submitted to the Planning Department. 8. Meat and produce waste shall be wrapped in plastic prior to being placed in the trash container. 9. A bicycle rack shall be installed that will hold six (6) bicycles where they can be locked up. The location shall not interfere with ingress and egress. 10. All conditions shall be complied with within 60 days from the date of approval. ,t t _d ,.L;.. _L_ll L Section 5. This action. shall become final and effective ten (10) days after this decision by the Planning Commission, unless within such time, a written appeal is filed with the City Clerk for consideration by the Rosemead City Council, as provided in the Zoning Ordinance. Section 6. This resolution is the result of an action taken by the Planning Commission on September 7, 1982, by the following vote: AYES: De Cocker, NOES: Schymos ABSENT: None ABSTAIN: None Ritchie, Lowrey, Mattern Section 7. The secretary shall certify to the adoption of this Resolution and shall transmit copies of same to`the applicant and Rosemead City Clerk. day of September , 1982. Dickey j/ Secretary *AMENDED BY THE PLANNING COMMISSION, SEPTEMBER 20, 1982 AS FOLLOWS: 2.' Alpha Beta shall provide some form of trash enclosure.to enclose their trash bins. The trash enclosure shall be constructed to the satisfaction of the Director of Planning. Said trash enclosure shall be locked to deter rummaging.. The trash bins shall remain in the trash enclosures at all times, except when being serviced by the trash collector. 11. No video games shall be closer than 25 feet to the liquor display area.
