The Regular Meeting of the Rosemead City Council was called to order by Mayor Cleveland at 8:10 p. m., in the Council Chambers of City Hall, 8838 E. Valley Blvd., Rosemead, California. The Pledge to the Flag was led by Mayor Pro Tom Bruesch. The Invocation was delivered by Reverend Garth Hyde. ROLL CALL OF OFFICERS: Present: . Councilmen Bruesch, Imperial, McDonald, Taylor, and; Mayor...Clevelaud' Absent: None APPROVAL OF MINUTES: MAY 12, 1987 - REGULAR MEETING Mayor Pro Tem Bruesch stated that there should be an addition to page #1 on.the bottom of the page, and it should read: demo- grapher's report, and on page.#3, the word not should be added to his statement; and it should read: and he could not support Dis- trict voting for the Alhambra School District and then go against it for the City representation. . MOTION BY COUNCILMAN McDONALD, SECONDED BY COUNCILMAN IMPERIAL that the Council Minutes be approved as corrected. Vote resulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. I. ORAL COMMUNICATIONS FROM THE AUDIENCE A. Leroy Young, 7533 E. Garvey, inquired about the vacation of an alley behind his property. Donald Wagner, Assistant City Manager, stated that neighbors north of Mr. Young's property have not been heard from as yet, and until the neighbors are heard from and the utilities, a hearing can not be scheduled. He reiterated to Mr: Young that it has to go first to the Planning Commission and then will be heard by the City Council. Mr. Young stated that he wanted to be on record that it had been scheduled for tonight but was not on the Agenda. III. LEGISLATIVE A. Councilman Taylor requested that a copy of the Police Report that was referred to.in-CC-C be given to him. CC-A PARKING SOUTH OF GARVEY ON KELBURN AVENUE AND FALLING LEAF Councilman Taylor stated that he felt that a survey of the.. people living on Kelburn and Falling Leaf was a good idea; however, he felt that the people living on the adjoining streets should be polled also. He also commented on the restriction of hours from 7:00 a. m. to 6:00 p. m. He felt that Tuesday evenings also were. a problem for the residents who lived near the Auto Auction. He. wanted this clarified further before the residents are polled. Councilman Bruesch inquired why the restricted time period for parking could not be all day Tuesday and Wednesday during working hours. He felt that 'those two days were the primary pro- blem time periods. He recommended 'adding another option for those people, such as: 2 hour restricted parking on Tuesdays from 7:00 a.m. to 10:00 p. m., and Wednesdays, from 7:00 a.m. to 5:00 p. m. Councilman Imperial stated that if 2 hour parking is allowed, it would not resolve the problem, and he felt that 1 hour was ade- quate. Councilman Taylor and Bruesch agreed with that. Councilman Bruesch inquired if that could be added to the survey.that is being sent to the residents of those streets in question. There being no objection, it was so directed. Councilman Taylor felt that the 5 or 6 streets that are adja- cent to the Auto Auction be included in the survey. Councilman Bruesch agreed with Councilman Taylor. MOTION BY COUNCILMAN McDONALD, SECONDED BY COUNCILMAN BRUESCH that the recommendations of the, Traffic Commission regarding the parking south of Garvey be approved with the addition of the recom- mendations'of the addition of the adjacent streets and the restric- tion of time be limited to Tuesdays and Wednesdays at the times stated. Vote resulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. Councilman Imperial requested that the staff be directed to strongly enforce the action taken. There being no objection; it was so ordered. Councilman Bruesch inquired when this survey would be pre- sented to the residents of those streets in question. Jeff Stewart, Administrative Assistant, stated that it would be about three weeks. CM 5-26-87 Page 42 CC-G TRAFFIC STRIPING - DEL MAR AVENUE AT HELLMAN AVENUE/ LEFT TURN POCKET - DEL MAR SOUTHBOUND AT HELLMAN Martha Rodriquez, 7842 E. Hershey, owner of a ,store at 3337 Del Mar.Ave.,commented that her customers cannot park in the front of her store which provides sports equipment for the little leagues. She stated that their business needs parking for their customers. Fletcher Flynn, 1143 Prospect Avenue, San Gabriel, customer of Mr. Meat, spoke in favor of additional parking in front of the store, and stated that this parking is needed for their continued success. Councilman Imperial made a motion to defer this item for further consideration and information. Councilman Taylor discuss it more thorou meeting. He felt that from the agenda packet to the next meeting in are. seconded the motion, but he did want to ghly when it is brought back to the next there was critical information missing and he wanted the documentation brought order to explain what the circumstances Nancy C. Wood, 14844 Cornell Street, Whittier, customer of Mr. Meat, stated that she comes to shop there only every three or four months; however, when she does,she picks up an order of $400 to $600 worth of meat. She stated that she does on occasion park in the gas station next door, but that is not always avail- able. The no parking situation has made it very difficult to carry large boxes of meat to the car. She stated that it has been an inconvenience since Mr. Meat has lost their parking in front of the store. Jim Smith, 3038 N. Prospect, Rosemead, stated that he has never seen more than 2 cars in the left-turn lane going north, and that left-turn lane is long enough for 6 cars. He felt that if the left-turn lane was reduced down to the north end of Mr. Meat's building,it would still be large enough to accommodate the situation. He commented that parking is allowed on the east side of the street and yet the west side of the street is one foot wider where parking is not allowed. Rob Miyasaki, Deputy Traffic Engineer, stated that parking is not allowed on the east side of Del Mar from Hershey to Hell- man Avenue and the lane width is 15 feet and parking is restricted anywhere there is not a 19 foot lane. He commented that there are "no parking" signs posted at Hershey and midway to Hellman on Del Mar Avenue. Councilman Taylor stated that the curb in front of the store on the east side of Del Mar should be painted red, and if the re- quest on this item is denied,it should also be painted red. He had checked the intersections at Walnut Grove at Garvey, Del Mar at Garvey and Hellman, and San Gabriel and Hellman and he felt that this intersection is not being treated any differently than any of the others Rob Miyasaki, Deputy Traffic Engineer, stated that the park- ing on the east side of Del Mar has been brought to their attention by the Traffic Commission and it will be corrected. Jim Smith stated that many people ignore the "no parking" signs in front of Mr. Meat. Councilman Taylor stated that he didnot think that the proposed two stalls in the left-turn pocket are adequate for all the traffic that goes down Del Mar. He felt that the original traffic planning was good. He did agree that it was an inconvenience to the meat mar- ket; however, very qualified standards were used prohibiting park- ing there. Councilman Bruesch stated that he used that intersection twice a day for 11 years, and he remarked that the north left-turns were not 25% of the south left-turns onto Hellman. CM 5-26-87 Page #3 Councilman Bruesch continued by saying that he could not see any problem with shortening the left-turn pocket to two or three spaces for the cars. Jim Smith stated that the lack of parking was a big inconven- ience for Mr. Meat and it is a big inconvenience for those who shop there. Dorothy LeRoy, 1543 Drumhill Drive, Hacienda Heights, owner of Mr. Meat, stated that Mr. Rutana,the owner of the service sta- tion next door allows customers of Mr. Meat to park there. She stated that she had no parking on.her premises for their customers, and if Mr. Rutana should sell his property, they would have no way of getting deliveries, and customers could not get to them, and this would virtually close their doors. She stated that when the right-of-way negotiations were taking place, the representative of Willdan Associates stated that there should be no problem with on-street parking. She did not want this item to be deferred, and she wanted action taken on this tonight. Councilman Taylor stated that he would withdraw his second to the motion to defer this item because he felt that the vote would be the same in two weeks anyway. Councilman Imperial stated that he.had no problem withdrawing his motion. He stated that the reason that he made the motion was that he thought that action might have been taken that would not enhance the position of the business people there. - Juan.Nunez, 2702 Del Mar, stated that he felt that the only way to allow any parking there would be eliminate the left-turn pockets. Donald Wagner, Assistant City Manager, explained the recom- mendation of the Traffic Commission which was to restripe Del Mar Avenue between Hellman Avenue and Hershey Street and that would free two parking spaces to be installed adjacent to Mr. Meat for a period of twenty minute parking, and that a cost estimate be prepared for the construction of a southbound left-turn pocket on Del Mar at Hellman. Councilman Taylor: Before we vote on it, I would like to make a.statement of why I have to oppose this item. I had asked for information to be brought back at the next meeting. As you know, I represent the City in the Joint Powers Insurance Authority for the City, and I feel that this particular solution is a grave injustice in the sense that throughout the City we have basic standards that we use for traffic control. We are going to say to the people on the east side of the street, we are going to give you an 11 foot lane in front of your business and we are going to paint the curb red because the people across the street from you get preferential treatment. Now, that is in fact what we are doing. If you go to the other streets that I made refer- ence to, and I would like this in the minutes verbatim, Ellen, my statement, because I think that we have created a precedent setting issue here of major liability. As I stated the traffic reports will bear out, and I am using 1983 statistics of 5,000,000 cars for 1987, as what I projected from the statistics to be. The driveway as the statement was made next door to this building is 10 foot wide, this building abuts the sidewalk. There is no clearance from the building to the sidewalk. Now, a couple of months ago we had a big to!do here about driveway clearance and, such. There is a property on Rosemead Boulevard.north of Valley, the same situation, cars exiting from the back had to pull out over the sidewalk into the street before they.could see traffic. We have an identical situation. here. We have painted the curbs red on the.property on Rosemead Boulevard. Identical situation here. No visibility. You are moving two cars into this area and I am sorry about your business. I am not picking on any business. It is just a fact of reality that by shoving this traffic over to the east side of the street ...there was a young boy killed on Valley and Rosemead in the right hand lane because vehicles, and in this case it was a truck that made a right hand turn and crushed the child as it went over the curb because it couldn't turn. And that is documented in the Police Records., CM 5-26-87 Page N4 • • Taylor continues: But now we are making an ll..foot-drive lane along the curb. 'If ,you look up;there, that board that you see with our names on it and over to the corner where the flag is, is about 12 to 13 feet. When you get..vehicle traffic coming through a right hand lane like that, we have created a potential liability for this City, and we are doing it.knowin'gly because we have not done this on.other streets. We.have treated properties all equal. So without even going for an alternate solution.... Mrs. LeRoy mentioned properties south of there, the hotels or the apartments, I could go for 20 minute parking in front of those businesses to keep the.streets clear, but I can't go for this, proposal because I have seen so many lawsuits filed that it is pathetic. I think we are opening ourselves up for preferential treatment at one intersection. That is all that I.have at this time. Councilman Imperial commented that he felt that the City.had allowed a problem to be created about that business on Rosemead Boulevard north of.Valley.and he was.the one to make all that todo. He also felt that therei.had been-an engineering problem'at'~Hellman afi&Del'-Mar, where cars. couldn't pull into the. driveway of the gas station without sticking out'_iuto the street. Councilman Taylor stated that some action was taken to correct that situation by painting the curb red to prevent accidents of people pulling out. He felt that this was an 'identical situation. Councilman Bruesch inquired.what the status of parking on the east side of Del Mar.was before the widening. Mr. Miyasaki stated that he did not have that information. Councilman Bruesch stated that from what he remembered that there was only parking allowed starting from about-40 feet north of Hershey. He thought that even before the widening of Del Mar there was no parking allowed in front of the market on the east side of the street. MOTION BY COUNCILMAN McDONALD, SECONDED BY COUNCILMAN.BRUESCH that the recommendation of the Traffic Commission be approved. V. MATTERS FOR.DISCUSSION & ACTION A. REQUEST FOR RELIEF FROM MORATORIUM ORDINANCE NO. 599 888 MONTEBELLO BOULEVARD, VISCOUNT HOTEL MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILMAN McDONALD that relief from the moratorium Ordinance No. 599 be granted to the Viscount Hotel, 888 Montebello Boulevard. Vote resulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly.carried and so ordered. Councilman Bruesch stated that the feasibility study that had been included in the Agenda packet was exactly that he felt a feasibility study should be. He added that now that he has seen such an analysis,'he would judge future feasibility studies proposed for hotels and motels in terms of this one. He commended the owner and his staff for presenting such a useable document. VII. MATTERS FROM OFFICIALS A. Councilman Bruesch commented on the Scholarship. Fund which was set up in memory of Jeanette Larson and inquired what the status of this was at this time. CM 5-26-87 Page #5 Donald Wagner, Assistant City Manager, stated that a memorandum had been prepared regarding the scholarship fund; however, in any case it will be placed on the Agenda for the next meeting and Rose- mead High School is recommending one of their students as the re- cipient of the Jeanette Larson Scholarship Fund. Councilman.Bruesch commented another pet project of Mrs. Larson was the historical site of Savannah Cemetery. He stated that he had attended the Memorial Day Services at Savannah Cemetery and was appalled by the vandalism that has been done on some of the oldest graves stones of possibly any cemetary. He remarked that he had been told that Savannah Cemetary is the oldest active burial site in L. A. County, and as such, he could not see what is holding up the process of getting Savannah proclaimed a.historical site. Councilman Imperial stated that he was in agreement with Council- man Bruesch in getting the Savannah Cemetery declared a historical site, and primarily because it is not impossible that a future Council may be more interested in the monetary value of that site than the history of the site and could allow that site to become a shopping center. He felt that if Savannah Cemetery were a State Historical site, the Council would have more power to police the site and to do what ever is necessary to improve it. He suggested that the Mayor direct the staff to write a letter to the E1 Monte Board requesting their help in getting the paperwork from-Sacramento. Also request that our Legislative Analyst help us with and submit this paperwork through the State channels to get this work done as expeditiously as possible. Mayor Cleveland stated that staff was so directed. Councilman Taylor.' suggested.that the Council Meeting be ad- journed in.memory of those 37. brave servicemen who lost their lives on the Naval Vessel, Stark, last week in the Persian Gulf. B. Councilman Bruesch commented on the Item CC-C which was a claim against the City, and remarked that this incident took place in the City of Rosemead; however, the police report was prepared by an E1 Monte Police Officer and the CHP and not by L. A. County Sheriff's Department. He requested an explanation on this item; and exactly what took place and why the Sheriff's Department did not have a police report on the incident. Donald Wagner, Assistant City Manager, stated that a memo,., would'be forthcoming. C. Councilman McDonald introduced Sheriff Deputy Dennis Martinez from the Temple City Sheriff's station, and thanked him for attending the Council Meeting. D. Councilman Imperial requested an updated status report on the 7-11 and what has been done about enforcement. Councilman Imperial requested a report from staff on the pos- sibility of a developer's fee, not for private homes, only for com- mercial development. Councilman Imperial requested an up-dated status report on the Vietnam Memorial and he felt that something. should be getting accom- . plished.on.that Councilman Imperial stated thathe had requested some time ago a traffic study on Ralph and 'Rosemead Blvd.:, and he wanted all' traffic incidents and also wanted to have.the Traffic Commission study the possibility of a light there to slow down•the traffic. Councilman Imperial stated that Sunday he was driving north of Valley on Muscatel and he noticed a station wagon loaded with pillows for.sale. He stopped and inquired if they had a permit to sell pillows out of a station wagon, and the man showed him the permit. The man lives on Chappel and San Gabriel'Blvd. He stated that he could not understand why permits had been issued to allow this man to sell pillows on a corner. He stated that he wanted this stopped. CM 5-26-87 Page #6 • • Councilman Taylor requested a written memorandum regarding what Councilman Imperial is referring to, and a copy of that per- mit which had been issued to this man. He stated that he was shocked that street vendors can get licenses, and this just should not have happened. He wanted to know why it happened and who authorized it. Councilman Bruesch requested that staff also look into paint- ings that are being sold on the northwest corner of Garvey and San Gabriel. He added that they have had oriental rugs and fruit there too. Councilman Imperial commented on the memorandum regarding the restroom policy at Garvey Park. He stated that he has made his feelings known about the restrooms being closed while the parks are open. He added that if restrooms are.being vandalized, call the police, but don't close the restrooms. He stated that if a restroom cannot.be kept open, then the park should be closed also. VII. ORAL COMMUNICATIONS A. Holly Knapp, 8367 E. Whitmore St., inquired who was going to be in control of what channels will be made available to the residents of Rosemead. Councilman Taylor stated that Falcon Television will be in control. He remarked that the residents can subscribe to whatever they want. Robert Kress, City.Attorney, stated that the area regarding programming has.been deregulated and there is simply no local con- trol that can be maintained over what goes out. He added that in terms.of technology the City has some limited areas of regulations; however, as far as programming and fees the City has no control. Mrs. Knapp stated because of her position as a concerned citi- zen and a teacher of young children, and most importantly as a parent, she.recommended'that the so called "Playboy, Channel" not be part of the package.deal. She added that other communities have been able to stop the "Playboy-7 Channel" from coming into their communities, and she would look into how this was done. She felt that the trouble it will cause should be stopped before it comes into Rosemead. Councilman Bruesch'stated that Falcon had made a statement that they would provide a wholesome family type entertainment, and would not have X-rated or pornographic material on the T. V. Councilman Imperial stated that is what he was told and it was part of the committment when Falcon was soliciting the Contract. Councilman Taylor disagreed and stated that X-rated movies were in the Contract with Falcon. Robert Kress, City Attorney, stated that Group W Cable had a corporate policy that they would not sell the "Playboy Channel" and they made that representation when soliciting the contract with the City; however, he felt that Falcon does offer the "Play- boy Channel" but whether.something is.X-rated or not is not really an appropriate standard because what they show is not rated at all. He commented that all of the recent cases where governmental entities have taken on ".Playboy" or anything similar, have been thrown out of court. There is simply no room for the franchise.or the City to tell the company what they can put on there, however, what has been successful.is the lobbying efforts of individual citizens,and this can.be done by simply withholding their subscriptions from the system until such time that Falcon decides to change its policies. He stated that he would prepare a memo by the next meeting that deals with.this subject; however, there is simply nothing that this Council can do, that would get the Council in a First Amendment law- suit that they would lose. Mrs. Knapp stated.that she would pursue the matter through her own sources.. CM 5-26-87 Page N7 B. Ruth Bush, 7234 E..Mooney Drive, South San Gabriel, stated that she had come out of.a'Monterey Park drug store and she noticed some very shocking, nude pictures of.young women. She noticed also that the same papers are at Garvey and Del Mar by the Donut Shop. She stated that working at Garvey Jr. High she is very cognizant of children passing these places and seeing these pornographic pictures. She urged the Cities of.Monterey Park and Rosemead to see that these papers are not placed where these youngsters can be exposed to them. Trudy Billings, 7542 Melrose Avenue, Rosemead, also was upset by these pornographic newspapers and stated that others had told her that there were five racks outside of Norms. In- quired'if the City has any control over what is placed in those racks. Councilman Bruesch stated that the Courts can regulate the size and shape of-the racks, but they cannot regulate the contents of the rack. Robert Kress, City Attorney, any regulation regarding the con- tent is governed by the State; and there have been changes in the State law.that will make pornography prosecutions easier and he would provide the Council the information on newsracks and that kind of enforcement activity. Mrs. Billings inquired how long these newspapers have been in racks in Rosemead. Councilman Imperial stated that as far back as 1981, he had been concerned about this problem because there had been some on the corner of Walnut Grove and Valley in front of the Palms Restau- rant, and some down at.the Donut stand at Mission and Valley, and some on Garvey Avenue. He commented that after a meeting with the owners, it was found out '.that the law actually protected them. He did note that some of them disappeared because someone would put a quarter in the stand,and then take all the newspapers out and the owner did not make any money. Robert Kress, City Attorney, stated that he would investigate the problem; however, he felt that. the rugs, pillows and fruit would be a lot easier to address. C. Maggie Clark, 3109 N. Prospect Avenue, Rosemead, inquired why it was easier to put these papers on the street corners, but they are not allowed to put it on T. V. She stated that she was very disturbed by these pornographic newspapers right on the street corners with children being exposed to them. Councilman Taylor commented on the cases that have been before the courts regarding these advertisements to call certain 976 numbers and the phone companies have said they could do nothing about it, but they got 40% of the money. Robert Kress, City Attorney.., stated that the courts have ruled that the phone companies have to issue those 976 numbers. Councilman Bruesch stated that people have applied to set up the newspaper racks at certain, business places and the owners of the business don't even look at what is being put in them. He felt that the complaints could be directed to the local businesses who allow these newspapers outside their doors, or to the corporate headquarters. D. Juan Nunez, 2702 Del Mar, inquired who enforces pushcart. restrictions. Councilman Taylor.stated that he had also seen pushcarts down on Garvey by the Community Center about a week ago. Juan Nunez stated that he had called the Animal Control on an animal that was laying at 7825 Garvey, and he stated that they did not come down after several.days to;pick up the animal. CM 5-26-87 Page #8 Councilman Taylor stated that he felt that Mr. Nunez was making a legitimate point. _A public agency is being paid to pick-up animals and clean-up after them, and although this may be a small problem, this is a valid complaint. Councilman Imperial stated that he wanted to have staff directed to send a letter to Animal Control and tell them what the Council feels the procedure should be, and if they cannot meet those stan- dards, maybe an alternative method should be found. He felt that staff should find out who is supposed to do what. Councilman McDonald stated that he knows that the services that are provided by the City are not perfect. He felt that Mr. Nunez should call the staff at City Hall and they will take care of the problem. He felt that the Council is here to make policy and the staff is hired because they are educated in managing the City, and he felt that Mr. Nunez should take advantage of their expertise and he should not wait for a meeting to come around because it is a waste of time to get these things resolved. The Council tries to make.the system in Rosemead as perfect as they can, but Mr. Nunez should call the staff so he won't have to wait two weeks to bring it to the Council's attention. Juan Nunez stated that he has called the staff many, many times. E. Cleo Young, 7533 E. Garvey Avenue, Rosemead, spoke about the Alhambra School Board and reported that on May 5, 1987 they had decided to build on to the existing schools in their.district. She stated that they had also stated that they would not release the EIR of sites within the City of Rosemead, and inquired what could be done to make them release those EIR's. Councilman Imperial stated that he could understand, her concern at this point, but the Council has:to take a wait-and-see attitude. He assured her that the City would be watching very carefully. Mayor Cleveland stated that there are two members of the City Council.that were appointed to monitor the Alhambra School Board and they are right on top of it.. C1eo.Young stated that there was a very dangerous bill coming out of Sacramento, SB 442, which would allow developers to bring three properties together and use eminent domain, and stated that this legislation should be stopped. F. Hugh Foutz, City Treasurer, 3824 N. Rosemead Blvd., re- ported to the Council about the recent performance of the Voices Chapala and they had a very successful tour and by request they will be returning in August. Hugh Foutz stated that he was on the Board of the Savannah Cemetery and he realized the vandalism was.a very great problem, and they are looking for the proper-person with the right equip- ment to pick-up those.monuments that were vandalized. He felt that a local effort would be needed to get the cemetery cleaned up, and he suggested that some of the people who have family mem- bers buried there could be solicited. He felt the major problem was that the gate cannot be closed because people come there to find their.family members at all hours. Councilman Imperial stated that he felt that State grants could be received, and as far as closing the gates, he felt that if Forest Lawn and Calvary Cemetery can close their gates, so can the Savannah Cemetery. Hugh Foutz stated that those cemeteries do have caretakers and they are paid around the clock to watch over the place,and even.if the gate was locked at Savannah Cemetery, they could climb the fence. Hugh Foutz also commented on the.Dinsmore Heritage House and there are a lot of good things stored there of historical value, and some cultural enrichment is done there. He suggested that a request for people who are interested in the cultural enrichment of their community be.placed in the Newsletter and they would be happy to have more people serve on that Board.
