The subject property consists of a single family residence with a tool shed that has been converted
to a second unit. The property is zoned R-2 with a lot size of 6750 t square feet. The owner of
record is deceased, and there is a dispute between the surviving siblings as to the disposition of the
property. The case was initiated in March 2005, and compliance has not been achieved in over ten
months. Due to alleged gang activity at the location,.all inspections have been conducted with an
escort from the Sheriff's Department.
The case chronology is as follows:
March 23, 2005 - "Please" letter and "bulky item" trash notice mailed to property
owner.
April 27, 2005 - Inspection: minor progress - some yard area cleanup. Tool shed
conversion remained. occupied.
June 8, 2005 - Property declared substandard by Building Official and a Declaration
of Substandard Property filed with Los Angeles County Recorder's office. A 15-day
certified letter was mailed to the property owner and posted at the property.
June 21, 2005 - Building inspector spoke to one of the owner's daughters, Martha
Guevara, and granted a 30-day extension. Ms. Guevara resides at the property.
June 30, 2005 - Building inspector spoke to probate attorney, Frances Martin. She
informed the inspector that a court date bf July 11, 2005 was scheduled to determine
ownership of the property.

• July 12, 2005 - Inspector was informed that the court date had been postponed until
August 12, 2005.
• August 15, 2005 - Inspector left message for Ms. Martin regarding court status. No
response was received.
• August 23, 2005 - Inspection: no progress. Tool shed conversion remained
occupied. Trash, junk, debris, and inoperable vehicles remained in the yard.
• August 25, 2005 - Building inspector spoke with another of the owner's daughters,
Yolanda Chavez. Inspector was advised that the next court date was scheduled for
September 12, 2005.
• September 28, 2005 - Inspection: no progress.
• November 9, 2005 - Inspection: no progress.
• January 3, 2006 - Inspection: no progress. Conversion still occupied and all other
substandard conditions remained.
To date, little progress has been achieved in correcting the defects, and no permits have been
obtained.
A Notice of Hearing was mailed and posted on the property on January 9, 2006. All interested
parties have been notified.
CITY BUILDING OFFICIAL'S RECOMMENDATION:
It is recommended that the Board find the property substandard and order all substandard conditions
be removed and/or corrected by March 1, 2006. However, if permits are obtained, and sufficient
progress is achieved by March 1, 2006, the abatement date may be extended to April 3, 2006.

as defined in Section 9905 of the City of Rosemead Building Laws, because of the defects listed on
the attached letter.
THEREFORE, NOTICE IS HEREBY GIVEN that on Tuesday, January 24, 2006. at 7:00 p.m., in
the City Hall, 5838 E. Valley Boulevard, Rosemead, California, a HEARING WILL BE
CONDUCTED before the City of Rosemead Rehabilitation Appeals Board on this matter.
All persons who desire to be heard shall appear before the above Board at said time and place to

A recent inspection at the subject address found the property to be substandard as defined by Chapter 99 of the City
of Rosemead Building Code, due to the conditions enumerated in the attached list of defects.
Section 9908 of the Rosemead Building Code declares all such substandard buildings a public nuisance and requires
the abatement thereof by repair, rehabilitation, or demolition of the substandard conditions.
As the owner of record, you are hereby ordered to comply with the requirements of said code, by repair,
rehabilitation, or demolition of the substandard conditions listed, within fifteen (15) days after receipt of this notice.
Be advised that if v ou are renting this property to others the Ciiv may file a "Notice of Iron-Compliance" with the
State Franchise Tax Board. Section 17274 of the Revenue and Taxation Code states: "No deduction shall be
allowed for interest taxes depreciation or amortization with respect to substandard (rental) housing."
This notice will be posted on the property. If you disagree with the findings, or cannot comply with the order within
the time specified, you may request a public hearing. Such request for hearing must made, in writing, within fifteen
(15) days after posting of this notice on the subject property. The request for hearing shall be directed to the City

Estate of Cosme Guevara, the owner of the above named property. We are in the
process of evicting the tenant living at the address, Ms. Martha Guevara.
One of the problems that we are having with Ms. Guevara is that she is claiming
ownership of said property and the Probate Court is having to try this issue.
