The Regular Meeting of the Rosemead City Council was called to order by Mayor Tury at 8:00 p. m., in the Council Chambers of City Hall, 8838 E. Valley Boulevard, Rosemead, California. The Pledge to the Flag was led by Mayor Pro Tem Imperial. The Invocation was delivered by Reverend Paul Bengtson. ROLL CALL OF OFFICERS: Present: Councilmen Bruesch, and Mayor Tury Cleveland, Imperial, Taylor Absent: None APPROVAL OF MINUTES: FEBRUARY 18, 1986 - ADJOURNED MEETING MOTION BY COUNCILMAN CLEVELAND, SECONDED BY COUNCILMAN IMPERIAL that the.Minutes of the Adjourned Meeting of February 18, 1986 be approved. Vote resulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. APPROVAL OF MINUTES: FEBRUARY 25, 1986 - REGULAR MEETING MOTION BY COUNCILMAN BRUESCH, SECONDED BY COUNCILMAN TAYLOR that the Minutes of the Regular Meeting of February 25, 1986 be approved. Vote resulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. ORAL COMMUNICATIONS FROM THE AUDIENCE A. Chaplain James Curry spoke against having the new high school in the City of Rosemead and stated that he was working hard on this project. He also spoke against the establishment of a Nite Club, dba Shangrila, at 3106 San Gabriel Blvd.and commented on the fact that the Planning Commission will be considering this item on March 17, 1986. He also remarked about the parking problems at San Gabriel and Whitmore Avenue. . Mayor Tury stated that the Traffic Commission would look into the parking problem at that location. John Carmona, Planning Director, stated that there will be a Public Hearing on the establishment of the Nite Club, dba Shangrila, on Monday, March 17, 1986 and the recommenda- tion of the staff is denial of the request, and he invited Chaplain Curry to attend the meeting at that time, and if he wanted a copy of the staff's report he could receive it from the Planning Department. Councilman Bruesch stated that there is again a problem on Whitmore on the weekends which includes public drinking, and loud music. He commented that these people who are causing this dis- turbance must have a scanner because when calls are made to the Sheriff, they go across the bridge on Whitmore Street"., and as soon as the Sheriff's leave, they return. Last summer the Sher- iff's were cruising by every hour or so and it seemed to take care of that problem, but since those periodic checks have not been made the problem has occured again. He requested that these intermittent checks be started again. Frank G. Tripepi, City Manager, stated that this would be taken care of by the Sheriff's Department with random checks. B. Reverend Paul Bengtson, pastor of the Neighborhood Covenant Church just opposite site "C" which is one of the sites proposed by the Alhambra School District for the new high school. CM 3-11-86 Page H1 • • He added that many of his parishioners live in that affected area and many are senior citizens who would be negatively impacted by having to be displaced from their homes. Reverend Bengtson remarked that he happened to live in Monterey Park, and expressed appreciation to the City Council for taking such a strong stance against site "C". He added that it surprised him that Monterey Park is the only City of the surrounding cities that does not have a high school. He wondered if there was some way that the Council could exert an invitation to the City Council of Monterey Park to discuss some potential sites in Monterey Park. Mayor Tury stated that the residents of the City of Rosemead would love it, if the new high school site would be in Monterey Park. He stated that a lot of pressure has been exerted, and the Council is doing what they can to resolve the problem. .PRESENTATION: PASADENA,GIRLS CLUB./TEEN VOLUNTEER CORPS Mayor Tury presented a proclamation to Naomi Morales, Kimberly Armas, Maribel Cano, and to Juanita::Ramirez,who wash-'t there,.from the Pasadena Girls Club Teen Volunteer Corps who live in Rosemead and serve the Rosemead Dinsmore House as volunteers who do some gardening and painting and thus beautifying the Dinsmore house. Mayor Tury stated that he appreciated the efforts of these young people. Councilman Bruesch commented that two of the girls had gone to Willard School. II. PUBLIC HEARING A. CONTINUED PUBLIC HEARING TO CONSIDER THE ESTABLISHMENT OF UNDERGROUND UTILITY DISTRICT H4 Mayor Tury stated that the Public Hearing was open and in- quired if there was anyone who would care to speak on this sub- ject. Dr..Stuart Maude, 9639 and 9651 Valley Blvd., stated that he was very much in favor of the undergrounding of Valley Blvd., and felt that even though this undergrounding would not cost the property owners,.the money saved would be put back into other improvements of their properties. Mayor Tury stated that since the undergrounding on Garvey was done at no cost to the property owners there, that it would only be fair to do the same on Valley Blvd. Councilman Bruesch inquired how much of the unappropriated reserve would be left after this expenditure. Mayor Tury responded that $100,000 had been budgeted and with the expenditure of $40,000 that would leave approximately $60,000. Councilman Imperial stated that he felt that this was a worth- while project and that it would add to the safety of our community in case of a national emergency and felt that it was long overdue. The following Resolution No. 86-16 was presented for adoption: RESOLUTION NO. 86-16 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD ESTABLISHING UNDERGROUND UTILITY DISTRICT #4 MOTION BY COUNCILMAN IMPERIAL, SECONDED BY COUNCILMAN BRUESCH that Resolution No. 86-16 be adopted and that the City pay for the undergrounding of the utilities on private property, and authorize the.transfer of the necessary funds from the unappro- priated reserve to pay for the installation of the facilites on the affected properties. Vote resulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. CM 3-11-86 Page H2 Councilman Taylor inquired how many customers would be taken care of with the $55,000 expenditure for undergrounding. John Steelesmith, Area Manager of Edison Company, stated that there are approximately 35 to 40 customers that would be serviced. Councilman Bruesch inquired if San Gabriel would be under- grounding their utilities on Valley Boulevard on the north side of the street where the cities boundaries meet. Donald Wagner,.Assistant City Manager, stated that San Gabriel is working with Edison also. Frank G. Tripepi, City Manager, stated that he had spoken with the City Manager of E1 Monte regarding the east end of Valley and-.they will be undergrounding also in conjunction with this project also. Councilman Taylor stated that he was not opposed to the project itself, only that the cost might be under-estimated. John Steelesmith stated that Edison has calculated that it should not be higher than $2000 per customer for the 35.to 40 customers and that is how the figure of $55,000 is arrived at. III. LEGISLATIVE A. RESOLUTION NO. 86-13 - CLAIMS & DEMANDS RESOLUTION NO. 86-13 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE SUM OF $218,979.42 NUMBERED 9853-9866/16024 THROUGH 16107 INCLUSIVELY MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILMAN IMPERIAL that Resolution No. 86-13 be adopted. Vote resulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. B. RESOLUTION NO. 86-15 - URGING THE ENACTMENT OF LEGIS- LATURE REQUIRING INSTALLATION & USE OF SEAT BELTS IN SCHOOL BUSES RESOLUTION NO. 86-15 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD URGING THAT THE CALIFORNIA LEGISLATURE ENACT LEGISLATION REQUIRING THE INSTALLATION AND USE OF SEAT BELTS IN SCHOOL BUSES AND BUSES HIRED TO TRANSPORT STUDENTS MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILMAN BRUESCH that Resolution No. 86-15 be adopted. Vote resulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. IV. CONSENT CALENDAR (CC-A and CC-D deferred) CC-B ACCEPTANCE OF ROAD DEEDS & PERMIT TO ENTER FOR ANGELUS STREET IMPROVEMENT PROJECT CC-C AWARD OF CONTRACT FOR 19TH HOME IMPROVEMENT PACKAGE MOTION BY COUNCILMAN IMPERIAL, SECONDED BY COUNCILMAN CLEVE- LAND that the foregoing items on the Consent Calendar be approved. Vote resulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. CM 3-11-86 Page #3 CC-A APPROVAL OF BUS SPECIFICATIONS AND AUTHORIZATION TO SEEK BIDS Councilman Bruesch stated that he was totally in favor of the Shuttle Program; however, his concern was that the buses be of the finest quality. He inquired if the only.air condi- tioning would be from the front of the vehicle. Tim Kerr, Executive Assistant, stated that there would be air conditioning units in both the front and back of the bus. Councilman Bruesch inquired what the proposed service life of the vehicles. Tim Kerr stated that they should be good for at least five years. Councilman Bruesch inquired how much of Proposition A funds are being.put:aside for replacement to continue the program. Councilman Taylor stated that the way Proposition A funds are going, there will be more than enough money to fund the program. Mayor Tury stated that at the next budget session that can be brought up. MOTION BY COUNCILMAN IMPERIAL, SECONDED BY COUNCILMAN BRUESCH that the Bus Specifications be approved and authorization to seek bids be granted. Vote resulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. CC-D AWARD OF CONTRACT FOR FERN, WALNUT GROVE, AND KLINGERMAN STORM DRAIN PROJECT Councilman Taylor commented on item #2 on page #2 of the memo from the Deputy City Engineer states that minor irregularities in the bid would be waived. Norm Rubel, Deputy City Engineer, stated that the low bidder added his figures wrong. The first apparent low bidder's total added up to $20,000 more which made the apparent second bidder the low bidder and his figure was added wrong also, but it was for only $1,000. Councilman Taylor stated that he had no problem with either bidder and asked if that was the only irregularity, and requested a list of the minor irregularities on the bid. MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILMAN IMPERIAL that the Contract for Fern, Walnut Grove and Klingerman Storm Drain Project be awarded to the low bidder, Vicco Construction Company in the amount of $850,480. Vote resulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. VII.MATTERS FROM OFFICIALS Councilman Bruesch commended the Chamber of Commerce on their Monte Carlo Night on Saturday, and stated that he had a wonderful time. Councilman Bruesch reminded the staff that he would still like a copy of the Disaster Plan for the City of Rosemead. Councilman Taylor stated that at the last Council Meeting he had requested a letter from Pacific Bell regarding make- ready poles for the Cable T.V. installation. Frank G. Tripepi, City Manager, stated that he would pro- vide that letter as soon as it is received from Pacific Bell. CM 3-11-86 Page #4 A. GREAT DANES (VERBATIM) Taylor: Last Thursday morning about 5:45 a. m. in the morning as I was getting up, I heard a loud noise. It was a thud in the sense that, it was a large Great Dane dog that hit the front of my house, and there were two of them-and they literally ate our cat. As far as, I bring it up in our Council Meeting be- cause I would like it'in the.minutes:. verbatim. The cat was on the front porch there and the Great Dane actually hit the house. I can't tell you what the dog must have weighed, but it literally ate the cat at that time. But there was two of them, and as I went out the door I startled the dogs off and this was just about 6:00 o'clock in the morning. I chased the dogs. I didn't really chase them. I went out in the front yard and the dogs had taken off three or four houses by that time. I mentioned to my wife what had happened, and she was naturally upset about.it. I would like to go further. My wife had made the comment several months ago that the kids had seen a couple of Great Danes eating a cat before on the street there. The dogs are let out at night or they get out at night. So I went ahead and went to work and my wife called me in Huntington Beach about 7:00 o'clock and said that she had gone over and talked to the owners which were about 1/2 block away down one of the streets. She went because my children told her where the dogs lived, and she got into the car and went over to the home and talked to the owner, the man in the house, and he said, well, the dogs are in the back. So my wife had asked to take a look at the dogs, and they were not in the back. So one of my older sons drove around the neigh- borhood and he parked accross the street and the dogs did not come back at that time. So he asked one of the neighbors, a young adult there, and he saw both of the dogs go into the back yard, but meanwhile, while my wife was over talking to the owner at the house, those two Great Danes came back to my house, went into my backyard and my four year old son was on the back porch at that time. I would like Gregory, my eleven year old... Greg would you come up and tell them what happened with those Great Danes when they got in the backyard. They literally came gallop- ing in the backyard because we have another cat too.. I think the smaller one was chasing that cat and they came back probably 45 minutes later. Greg~was`on'the back porch. -I didn't realize that those dogs had actually come back into the yard. He was there and pulled my little four year old back into the house. Gregory Taylor: I brother sitting on the gate and I got Then they went tow then went back out I shut the gate. was out in the back and just saw my little the porch and saw something come through up and opened the door and pulled him in. and the back and stayed around the back and the gate and when they went around the corner Mayor: Thank you Greg. Taylor: Mr. Mayor as I say, I wanted in the record because I am going to ask the City Manager to check with the L. A. County Pound out in Baldwin Park. My wife.filed a complaint, and I would like to see what they did to follow up on that particu- lar problem. I am not sure what the law can do about it. It was only a cat, but what concerned me more was the fact that they came back into the yard later and this has happened and it has been going on for a couple of years. You hear about rumors. It actually happened last Thursday. So I want to find out what the L. A. County Pound can do on something like that, and have them check that neighborhood because those dogs have been running loose for over two years. Imperial: Mr. Mayor.... Mayor: Jay.... Imperial: Mr. Mayor we have a leash law in this City. Taylor: Mr. Imperial I appreciate that, but it is too simple for something of this nature. When you get a couple of blood thirsty dogs like that loose on the street. I didn't realize that my little four year old was out on the porch at that time when they actually came back again. CM 3-11-86 Page #5 Imperial: You mean we have a leash law, and it is a fact that those dogs were loose, Mr. Mayor, even though it is after the fact, what we need to find out is what kind of action that we can take on this. That is very scary. Those dogs had no reason to be out running loose, and we have got an irresponsible owner as far as I am concerned. If there is anything that we can do after the fact, I would certainly would like to pursue it. Taylor: I had heard about the dogs being out, but you almost have to see it to believe what has been going on. The address is 3612 Ellis Lane, Mr. Tripepi. Mayor: Gary, it will be.checked out, and I think that the whole Council would like to have the report as soon as possible. Thank you, Gary. VIII. ORAL COMMUNICATIONS FROM THE AUDIENCE A. Juan Nunez, 2702 Del Mar, commented that he has caught quite a few animals that are running loose and have called the Animal Control Officers. The Officers have told him that if the animal returns to the yard, they cannot be touched. Mayor Tury requested that someone from the Animal Control program be in attendance at the next Council Meeting to ask some questions. Councilman Taylor requested on the subject that he had brought up, that the City Manager, find out how it can be substantiated if there have been other complaints made against these dogs or their owner. Mr. Nunez stated that when he had called the Animal Control Office at night, he was told that they have one man patrolling the area between Downey, Placentia, Diamond Bar to the Foothills. Councilman Imperial stated that during the negotiations with the L. A. County Animal Control, he>was assured that there would be adequate coverage 24 hours a day in the City of Rosemead. Mayor Tury requested that all this information be made avail- able at the next Council Meeting on March 25, 1986. Councilman Bruesch stated that some Cities are declaring certain breeds of dogs a nuisance and are requiring that muzzles be put on them at all times. At times there have been Court Orders placed on certain dogs, and the families have to keep their dogs locked up or get rid of them. B. Hugh Foutz, City Treasurer, called everyones attention to the Sister City's Program on the 21st of March, and he stated that there will be eight physicians from Zapopan and they will be visiting this area for 10 days and local clinics and hospitals will be hosting them and giving them.some hands-on experience. Hugh Foutz also mentioned the annual Prayer Breakfast which will be held on the 12th of April, and everyone is invited. Mayor Pro Tem Imperial stated that he was very sorry but he has to work that particular Saturday and will not be able to attend. There being no further business to consider, the Council Meeting was adjourned to the next regular meeting on March 25, 1986 at 8:00 p. m.
