CC - 06-25-850 MINUTES OF THE REGULAR MEETING ROSEMEAD CITY COUNCIL JUNE 25, 1985 AT 8:00 P. M. APPROVED CITY OF ROSEMEAD DATE-/I ~7-:2 The Regular Meeting of the Rosemead City Council was called to order by Mayor Tury at 8:05 p. m., in the Council Chambers of City Hall, 8838 E. Valley Boulevard, Rosemead, California. The Pledge to the Flag was led by Councilman Taylor. The Invocation was delivered by Reverend Tom Phillips. ROLL CALL OF OFFICERS: Present: Councilmen Bruesch, Cleveland, Imperial, Taylor and Mayor Tury Absent: None APPROVAL OF MINUTES: JUNE 11, 1985 - REGULAR MEETING MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILMAN BRUESCH that the Minutes of the Regular Meeting of June 11, 1985 be ap- proved. Vote resulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. APPROVAL OF MINUTES: JUNE 18, 1985 - ADJOURNED MEETING Councilman Taylor requested a clarification in the minutes on the second page, first sentence to add the word "no" before the word ."incentive". MOTION BY COUNCILMAN TAYLOR, SECONDED COUNCILMAN BRUESCH that the Minutes of the adjourned meeting of June 18, 1985 be approved. Vote resulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. PROCLAMATION: CHAMBER OF COMMERCE WEEK/JUNE 24-30, 1985 Mayor Tury presented a proclamation to Joan Hunter, President of the Rosemead Chamber of Commerce, proclaiming June 24th to June 30th as Chamber of Commerce Week. Joan Hunter expressed her appreciation to the Council, and stated that Rosemead was the best City and had the•best Chamber of Commerce. I. ORAL COMMUNICATIONS A. Debra Zamora, 3047 Angelus, stated that there was a traffic problem going in and out of Zapopan Park, and added that she had five children that played at the park and was worried that they would be hit by these reckless drivers. She felt that the Stop Sign placed at Angelus and Park was not helping and she requested speed bumps be installed. Mayor Tury stated that selected enforcement will be placed there and-that should slow down the traffic for awhile, and this problem will be turned over to the Traffic Commission to look for alternative ways of slowing down the traffic. Debra Zamora stated that the problem was the greatest on week-ends during the day. Mayor Tury stated that when this item is on the Traffic Commission's Agenda, she would be notified. B. Joyce Jones, 8339 Park Street, complained that she had been cited for parking on the sideyard of their property, and she stated that she did not mind paying for the citations if everyone that parks on their front lawn have to pay also; however, there are many violators that are not being cited. CM 6-25-85 Page N1 • Mayor Tury stated that he also'had noticed a lack of en- forcement of the ordinance that prohibits parking on front yard areas. He requested a staff report on the legitimacy of the tickets that Mrs. Jones had received for parking on the side- yard of her home. Councilman Taylor stated that there are cars being parked on DeAdalena Street that are violating the ordinance and he sees this everyday, and that Mrs. Jones' comment on the lack of en- forcement is a very valid complaint. Mrs. Jones thanked the Council for the fence at Zapopan Park and felt that it was helpful. She commented on a tree that is covering the Stop Sign at Park and Angelus Avenues, and she felt that it should be trimmed so that the view would not be obstructed. She felt that another Stop Sign is needed on the other corner. Mayor Tury stated that this problem will be turned over to the Traffic Commission for study. C. Olga Fisher, 8334 Park Street, thanked the Council for the fence and stated that it was 50% better. She commented on the reckless drivers that do not see the stop sign. Mayor Tury requested that all three of these ladies be no- tified of the Traffic Commission Meeting that this item will be considered. Mrs. Fisher stated that she had called the Sheriff's Depart- ment when these reckless drivers were tearing through the park, but the Sheriff's Department did not feel it necessary to check it out. She added that this last Sunday at 1:00 a. m. she called because there was a.strange van parked on her street and had been there for several hours, and again they did not come by to check on it. Mayor Tury stated that contact would be made with the Sheriff's Department to find out why they are not responding to calls. Mrs. Fisher commented on waterbugs that are coming from the park when the water drains from the park. Mayor Tury stated that the Park's crew would check that out. D. Ruth Albert, 8744 Scott Street, complained about a broken door and thermostat which had been put in under a Home Handyman Program. Mayor Tury stated that he would have a member of staff con- tact her to see if there was faulty workmanship under the Handy- man Program on her door and thermostat. II. PUBLIC HEARING A. PUBLIC HEARING CONSIDER THE PROPOSED 1985-86 BUDGET, USE OF REVENUE SHARING FUNDS & APPROPRIATIONS LIMIT. Mayor Tury stated that the Public Hearing was open and in- quired if there was anyone in the audience who would care to speak regarding this-matter. No one came forward, and the Public Hearing was closed. The following Resolution was presented for adoption: RESOLUTION NO. 85-24 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD ADOPTING AN APPROPRIATIONS LIMITATION FOR THE 1985-86 FISCAL YEAR MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILMAN IMPERIAL that Resolution No. 85-24 be adopted. PUBLIC HEARING TO CONSIDER CONFIRMATION OF ASSESSMENTS ON GLENDON WAY STREET IMPROVEMENT PROJECT Mayor Tury opened the Public Hearing and inquired if there was anyone in the audience who would care to speak regarding this matter. Arthur Jordan; 9527 Jordan, inquired why his assessment was higher than his neighbors since it seemed as though they all had the same work done. Tom Howard, Deputy Engineer, stated that he would discuss his particular parcel with him in the lobby and explain the charges. Mayor Tury inquired if there was anyone else that needed questions answered. Don Mascis, 9544 & 9548 Guess Street, stated that his pro- blem was basically the same as Mr. Jordans. The Public Hearing was left open-and after the Engineer's explanation it was continued. The Mayor inquired if there were any other protests and there being none, the Public Hearing was closed. The following Resolution was presented for adoption: RESOLUTION NO. 85-26 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD CONFIRMING THE STREET SUPERINTENDENT'S REPORT AND ASSESSMENTS THEREIN MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILMAN IMPERIAL that Resolution No. 85-26 be adopted. Vote resul ted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. CC-C APPROVAL OF PLANS & SPECIFICATIONS FOR ROSEMEAD BLVD., . MEDIAN BEAUTIFICATION & AUTHORIZATION TO SOLICIT BIDS Councilman Taylor stated that this project is estimated to cost from $250,000 to $300,000 to landscape the median, and his first reservation was that after driving several of the local streets he noticed that Prospect Street south of Hellman and Stevens Street were in very bad shape. He noticed that Columbia Street also needs repairs. Isabel Street has quite a bit of re- pairs needed. Evelyn Street needs work done on it. He also mentioned Whitmore Street west of Jackson; however, he was told that was in the budget for this year to redo. Mayor Tury stated that he felt that Councilman. Taylor had a very valid point and requested information on those streets., Councilman Taylor stated that there were others also. Highcliff east of Jackson, Graves east and west of Del Mar, also heed repair. He stated that he could not vote to pull out a good median divider on Rosemead Boulevard when there are streets that need repair. He mentioned also that Ralph Street east of Rio Hondo is breaking up. Mayor Tury suggested that,if any other Councilman has any other streets that needs repair, that they give a list to the staff so that it could be investigated. Councilman Taylor stated that 95% of the streets in the City have been improved and he commended the action of the City on this accomplishment. He just felt that there has been an oversight on these particular areas. Councilman Taylor requested that when this project does go out to bid, he would like to see that there would be a separ- ate bid on the narrow strip islands and the full wide islands with the heavy green landscaping. He requested two bids on those so that the Council can really see what is being received for the dollars spent. CM 6-25-85 Page #4 Mayor Tury stated that this item be deferred for further action. CC-I RENEWAL OF ARCHITECTURAL AGREEMENT FOR 1985-86 COMMUNITY REVITALIZATION PROGRAM Councilman Taylor stated that he has expressed his objection to the architectural agreement. Councilman Bruesch questioned if only 9 or 10 projects can be handled by the architect with the financial limitations of $20,000. Mayor Tury.stated that the project could be expanded if necessary; however, he felt that this was a realistic figure. MOTION BY COUNCILMAN IMPERIAL, SECONDED BY COUNCILMAN CLEVELAND that the Architectural Agreement with Neil Stanton Palmer for 1985-86 Community Revitalization Program be approved. V. MATTERS FOR DISCUSSION & ACTION A. Slurry Seal Project Councilman Taylor stated that.he had no problem accepting the major portion of the job; however, something would have to be done with the Rosemead swimming pool parking lot and the Little League parking lot. He questioned the time frame on the parking lots. Tom Howard, Assistant City Engineer, stated that the Con- tractor had indicated that he could get that done within the next week. Mayor Tury stated that there is obviously a difference in the procedure that this slurry seal project has been handled from the way.it has been done in the past and there should be an on going investigation of the problems so that it doesn't happen again. MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILMAN IMPERIAL that the 1984-85 Slurry Seal Project be accepted with the correc- tive work to be done:and the staff's recommendations be approved. Councilman Bruesch stated that he had received calls from people who live on Falling Leaf and they are saying that those nights that there are auto auctions and there are over- flow parking on their streets, there is no where other than their front yard areas to park their cars. Mayor,Tury suggested that Councilman Bruesch get together with Mr. Tripepi or Mr. Wagner to see if something can be done for those people on that one particular street. CM 6-25-85 Page N5 Councilman Bruesch stated that he was in full agreement with the ordinance prohibiting parking on front yard areas; however, he felt that this was a problem that could be alle- viated by the Traffic Commission's investigations. Councilman Taylor stated that this problem has been an on-going problem for many years, and yet the Auto Auction does have parking available but for some reason the customers are not using the parking lot. Mayor Tury stated that some limited restrictions should be placed on the streets around the Auto Auction area. This issue should be turned over to the Traffic Commission to investigate limited parking on that street. C. Councilman-Imperial directed the City Manager to en- force the Ordinance regarding out-door display. He had noticed that there are displays out on the sidewalks. He also requested tighter control over abandoned vehicles and did not feel that the City should wait for a Parking Control Officer to begin work. Mayor Tury stated that there would be a breakfast meeting with the Sheriff's Department on Thursday morning and he felt that was something that should be brought up at that time.with them. He felt that since additional funds are being expended it is critical that the City gets the maximum participation from the Council. These men will be working directly in the City and he hoped that they will be much more responsive to the City's needs. D. Councilman Imperial requested a status report on the eyesore at Hellman and Walnut Grove, and wanted to know what Caltrans has done down there. Mayor Tury stated that there would be.a status report at the next Council Meeting. E. Frank G. Tripepi,.City Manager, responded to the Code Enforcement of Outdoor Displays, and he stated that the Code Enforcement Officer worked all day Saturday and citations were issued and a number of addresses were noted of yard sales without permits. He stated that the Council would get a copy of a memo regarding exactly what took place. F. Councilman Taylor inquired about two items that had come up at the last meeting. One was the Bicycle Riding signs at Rosemead Park and the beer drinking problem that the Sheriff's Department was going to prepare a report on. Donald Wagner stated that there has been two weeks since the last Council Meeting and this would be the two week period and the Sheriff's Department is aware that we should have a status report from them by the end of the week. Mayor Tury requested that the status report be placed on the next Agenda. Michael Burbank stated that.two Bicycle Signs have been put up in Rosemead Park. G.I Mayor Tury stated that the vote on SB 1091 will take place tomorrow in Sacramento and any of the Council that can make it should go to give moral support of the bill. H. Mayor Tury stated that the violations of front yard parking are not being enforced, and violators are not being cited. Councilman Taylor stated that most of the people in Rosemead would support this ordinance and it down-grades any neighborhood to have cars parked on front yard areas. He stated that it was obvious that enforcement of this ordinance is.not taking place because every morning and night he sees the same cars parked on lawns. i Mayor Tury questioned why this ordinance was not being enforced. CM 6-25-85 Page 116 Councilman Imperial stated that there is a problem if this Ordinance is not being enforced. Mayor Tury requested a report from the Sheriff's Department regarding the enforcement of this ordinance, and on their feel' Trigs regarding the writing of those citations. He also inquired about the in-house parking control package, and when would the Councillsee it. Enforcement of the ordinance would not have to wait for the parking control officer. Frank G. Tripepi, City Manager, stated that it would be avail- able by September 1st. Councilman Imperial stated that he was not concerned about how they felt about enforcing the City's ordinances. VII. STATUS REPORT A'. JAWS PROGRAM Tim Kerr, Executive Assistant, stated that Rosemead staff with the Cities of South E1 Monte, Alhambra and San Gabriel met with staff from L. A. County Probation Department to discuss the cities' participation in the Juvenile Alternative Work Services Program (JAWS). He stated that the Cities in attendance were genuinely interested and that they would present the issue to each of ~their City Councils for consideration. He hoped that there would be enough interest generated by their Cities to permit enough work for a work crew to be stationed in this area on a permanent basis. Mayor Tury was pleased with the report and felt that Rosemead should keep the ball rolling and not wait for other City's to do the initiating. Councilman Bruesch inquired what time span is being consi- dered. Mr. Kerr stated that it would be for a period of one year. Councilman Bruesch inquired if this would include replanting or is it just plain clean-up. Mr. Kerr stated that the crew would do whatever the City deemed appropriate for the work crews to be involved with. Councilman Bruesch stated that he would like some of the hillsides replanted and inquired where the capital outlay would come from. Mayor Tury stated that first the other Cities would have to decide whether they are seriously interested in joining Rose- mead and then the details will be worked out. VIII. ORAL COMMUNICATIONS A. Mr. Myers stated that he would like to provide the City with the Release of Liens. Mayor Tury stated that there would be no problem if they can be certified by the City Engineer or City Clerk, the funds will be released. Nlr. Myers stated that it had been 90 days since the comple- tion of1the job. B. Mayor Tury recognized Rick Imperial, Councilman Imperial's youngest son, and his girlfriend, Karen and welcomed them to the Council Meeting.
