The Regular Meeting of the Rosemead City Council was
called to order by Mayor Tury at 8:05 p. m., in the Council
Chambers of City Hall, 8838 E.'Valley Boulevard, Rosemead,
California.
The Pledge to the Flag was delivered by Councilman
Cleveland.
The Invocation was delivered by Reverend Freund.
ROLL CALL OF OFFICERS:
Present: Councilmen Bruesch, Cleveland, Imperial,

APPROVAL OF MINUTES: May 14, 1985 - REGULAR MEETING
MOTION BY COUNCILMAN CLEVELAND, SECONDED BY COUNCILMAN
BRUESCH that the Minutes of the regular meeting of May 14,
1985 be approved. Vote resulted:

II. PUBLIC HEARINGS
A. PUBLIC-HEARING TO CONSIDER PROTESTS RELATING TO
THE IMPOSITION OF LIENS ON REAL PROPERTY IN CASES
OF DELINQUENT RUBBISH COLLECTION CHARGES
Robert Kress, City Attorney stated that this was the .
second annual hearing that has been held on this matter. He
stated that with the adoption of the Ordinance that requires
that the trash bill be paid, and if it is not paid by the per-
son actually receiving the service, then it becomes a lien on,
the real property. He stated that the purpose of the hearing
is to hear any protests to the imposition of these liens.
Mayor Tury opened the Public Hearing and inquired if
there was anyone in the audience who would.care to speak re-
garding this matter.
John Yeng, 9133 E. Valley Blvd., stated that he took over
the property on October 18, 1984; however, he had been billed
in the amount of $232.74 and had called Modern Service for an
explanation but he.could not understand why he should have been
billed since the beginning of 1984 instead of when he rented
the building on October of 1984. He stated that his trash had
not been picked up in February, March or April.
Mayor Tury stated that his bill would be pulled and no
action would be taken on the bill, and that Mr. Yeng should
meet with staff and a representative of Modern Service and
this issue will be resolved and brought back to Council. CM 6-11-85

George Keller, 522 E. Hellman, Monterey Park, stated
that he was responsible for the properties at 3214 and 3216
Eckhart. He stated that the tenant at 3216 has been there
for the past year; however, had not paid his trash bill since
May of last year. Mr. Keller stated that he paid that bill;
and will try to be reimbursed by his tenant; however, the
tenant at 3214 is no longer there and he also did not pay
his trash bill. He stated that he was first notified of these
delinquencies in April of this year which were for bills not
paid from May of last year to December of last year. He felt
that he should have had notification sooner. He stated that
he had paid the bill from January of this year to September of
this year so it is current.
Mayor Tury stated that one of the reasons that the delin-
quent trash bills are being passed.over to the owners is that
an ordinance was adopted that made it the property owners res-
ponsibility to see that the bills were paid. He felt that the
property owners should be notified every six months instead of
waiting the full year, and he suggested to the owner that the
trash company bill him directly and he in turn can charge an
extra $5.00 or so to the tenant in his rent and thereby having
full knowledge that the bills are being paid.
Mr. Keller stated that he understood that he would have
to pay for the services rendered; however, he felt that Modern
should not have waited from May of 1984 to May of 1985 to noti-
fy him of the delinquencies.
Mayor Tury stated that possibly Modern Service could send
the City a list of delinquencies every six months instead of
annually. He stated that 3214 be pulled and Mr. Keller should
contact staff and possibly something can be worked out.
Reverend Tom Phillips, 8875 Mission Drive, Rosemead, stated
that his property at 8877 Mission Drive was rented and requested
that he be advised so that he could pay it if the trash bill is
not paid.
. Councilman Taylor suggested that Reverend Phillips contact
Modern Service and have the bill sent to him and just add that
amount to the rent. By doing that there would be no need to
worry about the possibility of delinquent accounts.
Doris Telles, 3401 and 3403 LaFayette, stated that her pro-
blem was receiving the proper billing. She stated that she has
called and written to Modern Service several times and has been
ignored. She commented that she has had 8 different billings
from them and all 8 are for different amounts. She just doesn't
know exactly what is owed Modern Service.
Mayor Tury stated that no action would be taken on those
properties and she should contact staff and then the problem
can be resolved.
John Tartaglia, 424 N. Gladys, Monterey Park, stated that
he was the owner of property located at 2616 Jackson and 7602
Newmark. He stated that he was confused about the trash bill
because on May 10th he had paid $127.54 and then a week or.so
later he received notice that he owed an additional $118.00.
Mayor Tury suggested that Mr. Tartaglia contact staff and
together with Modern Service his problem will be resolved, and
no action would be taken on his trash bills until the matter
is resolved.
Mr. Tartaglia inquired what right Modern Service had in
placing a lien on the property.
Robert Kress, City Attorney, stated that it was not Modern
Service that is placing the lien on the property, but the City.
The City passed an ordinance that states that everyone must take
the service fora fixed minimum monthly charge.

Juan Nunez, 2702 Del Mar, stated that an owner would not
know that a tenant has not paid his rubbish bills until the
bills are delinquent and liens are being placed on his property.
Mayor Tury stated that was the reason that it is being
encouraged that all landlords place the rubbush bills in their
name and then just add the $5.00 to the rent. That way there
would be no chance of a lien being placed on the property and
there would be a saving of the $2 a month late fee charge.
Juan Nunez stated that all the landlords should be notified
of this procedure.
Robert Kress, City Attorney, stated that was done and each
and every property owner was notified when the ordinance was
adopted, and possibly this should be done again..
Nick Francone, San Gabriel Distributing, 2611 River Avenue,
stated that he had been billed for the past year and has only
had pickup for the past two months.
Mayor Tury suggested that Mr. Francone contact City Hall
staff and along with Modern Service and the problem can be
resolved.
Anna Djokich', 265 E. Foothill Blvd., Arcadia, owner of the
property at 7409 Graves, stated that she had received notice
that there would be a lien placed on that property because
her tenant had not paid the trash bill. Her tenant had told
her that she was using bin service, and Modern Service told her
that there was no payment since March, 1984.and that it was not
possible that she used bin service and that she would still have
to pay monthly pickup fees.
Mayor Tury stated that this doesn't make a lot of sense
because the rates are cheaper for residential pickup than with
a bin. He suggested that Mrs. Djokich and her tenant contact
City staff and with Modern Service so this can be clarified.
Robert Carrera, 1255 Duncan E. L. A., owner of the property
at 2708 Charlotte, commented that Modern Service had sent a bill
of $72.40; however, the property has been burned and no one has
been living there since March of 1983.
Councilman Taylor stated that 2708 Charlotte would be an
easy one to document since no one has.been living on the property
since 1983. ,
Mayor Tury stated that property would be pulled and the City
would take care of the problem with Modern.

Councilman Bruesch requested that the list of streets of the
properties in question be alphabetical.
Mayor Tury inquired if there was any one else who would care
to speak on this subject. There being no one, the Public Hearing
was closed.
MOTION BY COUNCILMAN IMPERIAL, SECONDED BY COUNCILMAN BRUESCH
that the liens be placed on the properties listed except for 9133
Valley, 3214 Eckhart, 3401 and 3403 LaFayette, 2616 Jackson and
7602 E. Newmark, 2611 River, 2709 Graves and 2708 Charlotte. Vote
resulted:

Mayor Tury stated that if the owners of those properties
do not contact the staff, the staff should contact them in order
to get these problems resolved within the next two weeks.
Donald Wagner, Assistant City Manager, stated that he had
scheduled to meet with Pancho, Thursday at 9:00 a.m. regarding
some other properties in question and he would add these to the
list.

IV. CONSENT CALENDAR

CC-B AUTHORIZATION TO CLOSE OUT 1976 STATE GRANT PROJECT
AND REMAINING FUNDS
Councilman Taylor stated that he could not vote for the
proposal that staff is recommending to build another asphalt
walkway. He received complaints about bicycle riding on the
walkway in Rosemead Park. He felt that the walkway from the
ball diamond to the snack bar stand was sufficient. CM 6-11-85

Councilman Taylor stated that he felt that there could
be alternative proposals instead of asphalt walkways in the
park.
Mayor Tury stated that he felt that made better sense;
however, there was a deadline of June 30, 1985 to have this
proposal prepared. He requested that Michael Burbank prepare
other proposals by next Tuesday, June 18, 1985 adjourned
meeting so that the Council could consider the alternatives.
This item was deferred to the next Council Meeting.
CC-C PROPOSITION "A" FUNDING/RECREATIONAL TRANSIT
Councilman Taylor stated that he had serious reservations
about another funding system of this nature.
MOTION BY MAYOR TURY, SECONDED BY COUNCILMAN IMPERIAL that
$6963 be transferred from the Proposition "A" reserve to fund
the transportation costs of recreation trips. Vote resulted:

CC-D PROPOSAL FOR ACTUARIAL & ADMINISTRATIVE SERVICES
FOR CITY OF ROSEMEAD RETIREMENT PLAN
MOTION BY COUNCILMAN IMPERIAL, SECONDED BY COUNCILMAN
CLEVELAND that the proposal for actuarial and administrative
services for the City of Rosemead Retirement Plan be approved.
Vote resulted:

Councilman Taylor inquired if the five year projected
cost would be included in this actuarial.
Donald Wagner, Assistant City Manager, stated that it
would be included and he felt that he should have those
figures available by the end of this week.
CC-E AWARD OF CONTRACT FOR 15TH HOME HANDYMAN BID PACKAGE
Councilman Taylor inquired if the low bidder, Leeman Con-
struction had done any of the other handyman projects for the
City in the last few years.
Tom Howard, City Engineer, stated that he believed that
he has.

that the low bidder Leeman Construction be awarded the contract
for the 15th Home Handyman Project. Vote resulted:

V. MATTERS FOR DISCUSSION & ACTION
A. AB 1209 - TRAFFIC VIOLATORS SCHOOL FEES

VI. MATTERS FROM OFFICIALS
A. Councilman Cleveland commented on an invitation from
the Los Angeles County Sanitation District to attend a boat
trip on the marine survey vessel, the Sea-S-Dee. He stated
that there will be four Saturday morning tours scheduled, June
22, June 29, July 6 and July 13, and any Councilmember or staff
member or family members are invited. He mentioned that he had
enjoyed the trip a couple of years ago and wanted to bring it
to the attention of the other councilmembers.
Robert Bruesch stated that he would be interested in at-
tending.
B. Councilman Imperial stated that passing Rosemead Park
on the week-ends he has noticed a giant beer-bust. He felt that
the patrolling is lax at the park and wanted more police surveil-
lance during the days and evenings so far as noise, alcohol con-
sumption and other problems that might arise.
Councilman Taylor requested a written report regarding this
in the next two weeks from the Sheriff's department in what they
have done. He wanted to find out what the sheriff has done.
Councilman Bruesch had also heard about some reports about
some girls being.acosted by some inebriated people at night in
the park.
Mayor Tury stated that the patrolling should start again,
and he felt that it was time, and requested a report from the
Sheriff's department on what they have done in the two-week
period and on what they intend to do for the balance of the
year. .
Councilman Imperial requested that the patrolling include
the Mission side of the park by the swimming pool where there
is parking.
Mayor Tury stated that the patrolling should go on in all
the City parks now.
C. Councilman Imperial commented that there were a lot
of trailers and trucks parked in the K-Mart Parking lot. .
Mayor Tury suggested that the K-Mart Corporation be con-
tacted and inform them that the parking of those vehicles have
to be stopped, and he.requested that Rosemead Square also be
notified because the trucks and trailers are parking there also.
Councilman Imperial stated that they should be notified
that this is a recurring problem, and the main headquarters
should be contacted.
Mayor Tury stated that as a courtesy the local manager
should be contacted and advise them that a letter is going
to be sent to the corporate headquarters.
D. Councilman Taylor stated that the parking lot at
Rosemead Park should be checked out regarding the Slurry Seal,
and a report back from staff.
E. Councilman Taylor requested that the staff look into
the possibility of putting up signs of no bicycle riding on the
walkways at the park.
Mayor Tury inquired if there was any objection to posting
no bicycle riding signs in the park.
Councilman Imperial stated that he thought that was policy
all along.
Michael Burbank, Park & Recreation Director, stated with the
adoption of:elementscof,;the~, County'Code,there is no bicycle riding
allowed, and there are signs being placed by the ball diamond
and the snack bar stating that it is a violation. CM-6-11-85

F. Councilman Bruesch stated that he had attended the
League's RTD Corridor Meeting and Supervisor Pete Schabarum's
staff also attended and gave an outline of their proposed transit
district; everyone in attendance agreed that something has to
be done to improve the transit situation in the San Gabriel
Valley; however, this is not a clear cut proposal. He had a pro-
blem with the funding of this transit district, as one of the
funds being considered was Proposition "A" monies.
Mayor Tury felt that the City of Rosemead should take a
neutral position and see what develops.
G. Councilman Bruesch stated that on the Del Mar Foods lot
there is a large truck parked, two cars for sale and one trailer,
and this seems to be a continuing thing.
H. Councilman Bruesch inquired if a letter had been drafted
to the other cities along the Caltrans corridor concerning the
on and off ramps.
Tim Kerr, Executive Assistant, stated that he had been talk-
ing to representatives from cities of Alhambra, Monterey Park,
Montebello, E1 Monte, South E1 Monte and San Gabriel and there
will be a meeting with all of them next Wednesday to discuss this
issue.
Mayor Tury requested a memorandum regarding the results of
that meeting.
I. Mayor.Tury requested that the staff check into the cost
of cementing in the streets signs that are stuck in dirt.
J. Mayor Tury requested at the next Agency Meeting a memo
on the status of the investigation of the possible off-ramp off
of the Pomona Freeway to alleviate some of the congestion. He
stated that he had gone down Walnut Grove to Carrows about 5:00
p. m., and the traffic was backed up past Narramore. Since the
study to alleviate this congestion has been authorized, he wanted
to know what the status is on this study.
VII. STATUS REPORTS
A. CITY SUBSIDIES OF RTD PASSES FOR SENIOR CITIZENS,
HANDICAPPED AND STUDENTS
No action was taken or required.
B. WHITMORE ALLEY VACATION
No action was taken or required.
VIII. ORAL COMMUNICATIONS
A. Juan Nunez, 2702 Del Mar, stated that there were cars
and trucks parked all along Garvey between Del Mar and Brighton.
He commented about a truck that has been parked behind the store
there that is carrying some type of corrosive. lie stated that
it was a corrosive H8 on the truck. He felt that area has been
a truck stop for the last 4 or 5 years.
Mayor Tury stated that the owners of the property should be
contacted where the problem exists, and start enforcing the laws.
B. Mr. Nunez stated that he has problem with the kids riding
bicycles on the sidewalks where he lives. He has told them not to
ride their bicycles and skateboards on the sidewalk because they
cannot be seen. He had talked to the parents; however, he has not
gotten any cooperation from them.
Councilman Bruesch stated that the schools have safety
programs that teach the students not to ride bicycles on the
sidewalk; however, some of them are not paying attention to the
safety program even though they have been informed.

C. Mr. Nunez inquired about the status of the proposed
High School in the City of Rosemead.
Mayor Tury stated that the Council is trying to find out;
however, they still don't know.
Councilman Taylor stated that only rumors have been heard,
and the school board will not discuss any site because of specu-
lation.
Mayor Tury stated that someone in the Alhambra School Dis-
trict is letting out information that should not be let out., Even
after the site is selected, there will be a year of public hear-
ings before anything can be done. He stated that people living
near the Garvey School District are getting all worked up over
it because they have been told that was a primary site for this
new high school. He added that there was some very poor infor-
mation coming out of the Alhambra School District.
IX. CLOSED SESSION/SALARY REVIEW
MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILMAN BRUESCH
that the Senior Park Maintenance Man at Rosemead Park be granted
a salary increase as recommended. Vote resulted:

Donald Wagner, Assistant City Manager, stated that SB 1091
is currently on.the Senate Floor and it is scheduled for hearing
early next week and the Council will be notified of the hearing
in case any Councilman is interested in going to Sacramento:
Donald Wagner, Assistant City Manager, stated that AB 1611,
which is the Sales Tax Consultant Bill, is in the Senate Appro-
priation Committee awaiting the date for a hearing.
There being no further business to handle the City Council
adjourned the meeting to next Tuesday, May 18 at 8:00 p. m. for
a Study Session regarding the General Plan.
