The Regular Meeting of the Rosemead City Council was called to order by Mayor Tury at 8:05 p. m., in the Council Chambers of City Hall, 8838 E. Valley Boulevard, Rosemead, California. The Pledge to the Flag was led by Councilman Bruesch. The Invocation was delivered by Reverend Walt Jackson. ROLL CALL OF OFFICERS: Present: Councilmen Bruesch, Cleveland, Imperial, Taylor and Mayor Tury Absent: None APPROVAL OF MINUTES: MAY 14, 1985 - REGULAR MEETING Councilman Taylor requested that the minutes be deferred to the next meeting so that the Clerk can transcribe Item V-B verbatim as part of the minutes. There being no objection, the minutes were deferred to the next Council Meeting. PRESENTATION:. Jim Dugdale A resolution of commendation was presented to Jim Dugdale, teacher, who has been teaching for the.past 16 years at Elementary, Schools even though he is blind, and does an excellent teaching job and is an example to his students of what can be accomplished even with this kind of handicap. PRESENTATION: Glenn Reeder A resolution of commendation was presented to Glenn Reeder, a long standing resident of this community who has been involved with the Boys Scouts and Girls Scouts Organizations, PTA, Board of Trustee of the Rosemead School District, started Rosemead's Annual Prayer Breakfast 12 years ago, and many other community efforts. Mr. Glenn Reeder expressed his appreciation to the Council. II. PUBLIC HEARINGS A. CONTINUED HEARING TO CONSIDER AN APPEAL TO THE DENIAL OF A SIDEWALK WAIVER AT 3191 N. DELTA Mayor Tury stated that the continued hearing is still open and inquired if there was anyone who would care to speak regard- ing this item. No one came forward, and the Mayor closed the hearing. Councilman Taylor stated that in general he would support putting sidewalks in wherever possible. ;However, he feels un- easy about this particular item because the resident claims that the neighbor next door to her had done quite an improvement on their property but the County, who was doing the City's-inspec- tions at that time, forgot to make them put sidewalks in. He stated that the same type of incident happened on the corner property of that street. He felt uncomfortable to make this owner put in sidewalks when two of her neighbors did not have to, and felt that an exception could be made on this particular site because the two neighbors did not have to put them in. Councilman Imperial felt that waiving the requirements for sidewalks for this particular property could have reper- cussions up and down the block if and when any of the other neighbors do improvements on their property. CM 5-28-85 Page N1 U 0 Councilman Imperialifelt that we either have an Ordinance or we don't, and either have a Planning Commission decision or we don't. Mayor Tury agreed with Councilman Imperial, and that this was one of the reasons why the City changed from the County ser- vices because of the things that were falling through the cracks. He felt that if this waiver was granted,then.the sidewalk policy for that particular street would be abandoned. He added that the owners signed the affidavit and were aware of the requirement in, order to get the building permit. Councilman Bruesch agreed with Councilman Taylor and felt that the precedent was set on this particular street and this particular property five years ago. He stated that these owners have lived here many years, and they are not someone who has just come into town and are trying to avoid a requirement. There was a lot of additional conversation regarding the waiver of the sidewalk requirement; however, the motion to up- hold the Planning Commission's decision was made. MOTION BY COUNCILMAN CLEVELAND, SECONDED BY COUNCILMAN IMPERIAL that the Planning Commission's decision to deny the waiver of the sidewalk requirement be upheld. Vote resulted: AYES: Councilmen Cleveland, Imperial, and Mayor Tury NAYES: Councilmen Bruesch and Taylor ABSENT: None ABSTAIN: None Whereupon the Mayor declared said motion duly carried and so ordered. III. LEGISLATIVE A. ORDINANCE NO. 579 - GRANTING A FRANCHISE TO FALCON COMMUNICATIONS TO OPERATE A CABLE SYSTEM IN ROSEMEAD ORDINANCE NO. 579 AN ORDINANCE OF THE CITY dOUNCIL OF THE CITY OF ROSEMEAD GRANTING A NON-EXCLUSIVE FRANCHISE.TO FALCON COMMUNICATIONS TO OPERATE A CABLE COMMUNICATIONS SYSTEM IN THE CITY OF ROSEMEAD AND SETTING FORTH CONDITIONS ACCOMPANYING THE GRANTING OF THE FRANCHISE MOTION BY MAYOR TURY, SECONDED BY COUNCILMAN CLEVELAND that Ordinance No. 579 be adopted. Vote resulted: AYES: Councilmen Cleveland, Imperial, and Mayor Tury NAYES: Councilmen Bruesch and Taylor ABSTAIN: None ABSENT: None Whereupon the Mayor declared said motion duly carried and so ordered. 11 Councilman Taylor stated that he could appreciate what the Council has gone through on this particular ordinance, but as he had stated when it was approved in format to draw this ordinance up, he wanted the record to show that he still opposes it only in the sense that Group IV underbid the Falcon Company in all four categories and he feels personally, that Group w had a couple of other items that were much better for the City, but that was the rea- son that he voted "no" on this item. B. RESOLUTION NO. 85-18 - CLAIMS & DEMANDS RESOLUTION NO. 85-18 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE SUM OF $416,532.90 NUMBERED 9396-9416/13994 THROUGH 14093 INCLUSIVELY MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILMAN IMPERIAL that Resolution No. 85-18 be adopted. RESOLUTION NO. 85-19 - STANDARD SPECIFICATIONS FOR PUBLIC WORKS CONSTRUCTION, 1985 EDITION RESOLUTION NO. 85-19 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD ADOPTING 1985 EDITION OF THE STANDARD SPECIFICATIONS FOR PUBLIC WORKS CONSTRUCTION MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILMAN BRUESCH that Resolution No. 85-19 be adopted. Vote resulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. D. RESOLUTION NO. 85-20 - RESOLUTION OF INTENTION TO VACATE PUBLIC ALLEY (WHITMORE ALLEY) Councilman Bruesch stated that he had inquired if the vacation of this property would change the.assessments on the residence in- volved, and if there would be a change in the evaluation of the property. John Carmona, Planning Director, stated that the abandoning of an easement would not create an additional value to their property. Councilman Bruesch then inquired if there would be a reassess- ment on their property. Robert Kress, City Attorney, stated that a Public Hearing will be held on this item, and certainly by that time there can be an answer to these questions. Councilman Bruesch stated that there are senior citizens living in that area and they, are afraid that their property might be re= assessed, and they would have to pay higher property taxes. MOTION BY COUNCILMAN TAYLOR, SECONDED BY MAYOR TURY that Resolution No. 85-20 be adopted. Vote resulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. Councilman Imperial inquired how many other situations like this are there in the City of Rosemead and how would this impact be on those people. Mayor Tury stated that as far as he knew this was the only totally unimproved alley within the City. Frank G. Tripepi, City Manager, stated that this was the only one that he knew of also. Mayor Tury stated that by staff should contact the County information to see what effect owners adjacent to the alley. IV. CONSENT CALENDAR the next Council Meeting, the Assessor's office for this tax this might have on the property CC-A AUTHORIZATION TO ATTEND LEAGUE OF CALIFORNIA CITIES MAYORS AND CITY COUNCIL MEMBERS EXECUTIVE FORUM IN MONTEREY FROM JULY 17 TO 19, 1985 MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILMAN CLEVELAND that the foregoing item be approved. Vote resulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. V. MATTERS FOR DISCUSSION & ACTION A. CITY SUBSIDIES OF RTD FARES FOR SENIORS, HANDICAPPED AND STUDENTS Mayor Tury stated that he was surprised that it would take so much of the Prop "A" funds to subsidize the RTD fares, and in- quired if the RTD has offered a reduced rate or will it be at the full fare. CM 5-28-85 Page #3 0 Councilman Taylor stated that since we have the dial-a-ride for the seniors and the handicapped in the City, this seems like a duplication of service except for the addition of the students. Nell Soto, RTD Representative, stated that figures of the amount of riders on RTD are not only Rosemead residents, they are those people who ride through Rosemead, and are not an exact count. Therefore the cost could be considerably less, since the City would only be subsidizing Rosemead residents. Mayor Tury requested that this item be deferred to a later date, so that staff can get more information regarding what the Rosemead ridership is. Nell Soto stated that there is an alternative of how much the City would like to subsidize of the bus passes, and it is not necessary to subsidize the full amount. Councilman Bruesch commented that there is a 75% raise in bus passes for.the seniors and handicapped and there is a 300% increase for the students, and he felt that students who are really in need be subsidized with a bus pass, not all students. He felt that the seniors and handicapped who have a need should also be subsidized. He stated that now that there is a new staff person available, possibly she could screen the applicants for this type of program. Councilman Imperial stated that he felt that the City of Rosemead is taking good care of the elderly and handicapped already with the dial-a-ride. He felt that by subsidizing the students, it could go on to end up subsidizing the entire com- munity. He suggested that contact be made with the local high school to see if there is a big problem in Rosemead, and then go from there. He stated that he needed a lot more information before.making any decisions on subsidizing RTD. He felt that there were many things that could be done with that Prop "A" money. Mayor Tury stated that the staff has to do some investiga- tion as to what the real ridership of the Rosemead residents are, and this item was deferred to a later date. B. SLURRY SEAL PROJECT John Maulding, City Engineer, stated that in response to the questions that have been asked regarding the slurry seal, La Belle Consultants had been asked to look at the work and render a re- port, and he also had asked a representative of WRG, Highway Inspection Service to be here this evening to respond to any question that the Council may have. He added that WRG Corpora- tion were the inspectors and did the testing on the slurry seal. Mayor Tury stated that he had questions regarding the La Belle memorandum which stated that curing process would be aided if the. asphalt is reasonably hard in character. He wanted to know if this asphalt was reasonably hard in character. Mr. Maulding.stated George White of WRG could respond. to that. He felt that the purpose of slurry seal should be explained, and he said that the purpose of slurry seal was to put oil back in the pavement, and that is exactly what this slurry seal is doing. It does not improve the strength of the pavement. It simply prolongs the life and a way to put oil back in, and get traffic back on as soon as possible. Councilman Bruesch inquired if there was a sample of the emulsion? Mr. Maulding stated that they did have samples of the emulsion. Councilman Bruesch inquired if La Belle Laboratories had studied that emulsion. Mr. Maulding stated that it had not been turned over to La Belle Laboratories; however, they did not do the testing. It was tested by WRG Corporation, and they have samples of the emulsion. CM 5-28-85 Page #4 Mr. George White stated that the material is a preventative maintenance, and if the oil is not put back,it starts to deter- iorate,it starts to crack and the pavement starts to break. The scuffing is a normal situation for slurry. Councilman Taylor inquired why La Belle Consultants were not given samples of the emulsion to test. Mr. Maulding stated that WRG did the inspection on the job, and he stated that they just have not had the time to give them the samples, but they can. Mayor Tury suggested that the samples be given to La Belle Consultants. Councilman Bruesch inquired of Mr. White the results of the tests that they had taken. Mr. White stated that all the tests were taken prior to using oil on the street, and all of the tests passed, and they had no problems. VI. MATTERS FROM OFFICIALS A. Councilman Imperial read a letter from Caltrans regarding the Electrical Maintenance Yard at 8555 E. Hellman Avenue in Rose- mead. The letter stated that Caltrans would be conducting a feasi- bility study to determine whether the Maintenance Yard should be further enclosed, and they would be contacting local and state police also. Mayor Tury stated that at least there is some attention being given to this problem by Caltrans. Councilman Imperial felt that it was adding insult to injury because at the Walnut Grove off-ramp they have-set_un a compound and they'.ve put in signs and what have you. Mayor Tury stated that they are widening the off-ramps and that there is construction going on there. Councilman Imperial suggested that the Maintenance Yard be enclosed and electronically wired with a burglar alarm and he felt that that would answer their problems and the City's. B. Councilman Bruesch commented about the Del Mar off-ramp underpass, and checking it out, he stated that the Southwest corner is in Rosemead and that is the worst part of the underpass. He felt that while they were working there widening the off-ramp, they could send the crews to plant that hill. Mayor Tury stated that a letter could be written to them suggesting this; however, he felt that the most productive approach would be to contact San Gabriel and Monterey Park. He requested that a memo be prepared' informing the Council on what is going on regarding with the other cities in regards to the cleanup of the off ramps. C. Councilman Taylor requested a report from the City Manager regarding the corrosive liquid H8 and a list of the different truck- ing code numbers that are used. He felt that the State Safety people could provide a definition and a list of these code numbers that are used. He requested a copy of the State and Federal Guide- lines for that. There being no further business to handle, the Council Meeting was adjourned to the next regular Meeting on June 11, 1985 at 8:00 P. M.
