MINUTES OF THE REGULAR MEETING
ROSEMEAD CITY COUNCIL
MARCH 26, 1985 AT 8:00 P. M.
The Regular Meeting of the Rosemead City Council was
called to order by Mayor Taylor at 8:00 p. m., in the Council
Chambers of City Hall, 8838 E. Valley Boulevard, Rosemead,
California.
The Pledge to the Flag was led by Mayor Pro Tem Tury.
The Invocation was delivered by Reverend Richard Acosta.

Present: Councilmen Bruesch, Cleveland, Tury & Mayor Taylor
Absent: Councilman Imperial (Excused for City Business)
APPROVAL OF MINUTES: FEBRUARY 26, 1985 - REGULAR MEETING
MARCH 12, 1985 - REGULAR MEETING
MARCH 19, 1985 - ADJOURNED MEETING
Mayor Taylor requested that the Minutes be deferred to the
next meeting.
There being no objection, it was so ordered.
Mayor Taylor presented a Resolution honoring Jeanette Larson
for her outstanding efforts to many in the community from the
youngest to the oldest.
Councilman Tury commented that it was people like Jeanette
Larson who give so much of themselves and ask for so little that.
make this such a fine City, and expressed his personal thanks.
Mayor Taylor presented a Resolution honoring Alex Maldinado
who entered a burning house at 2803 Angelus Street and guided
the residents of the house to safety and expressed appreciation
for his heroic deeds.
I. ORAL COMMUNICATIONS
A. Olga Fisher, 8334 Park Street expressed her appreciation
to the Council for having the picnic area at Zapopan Park moved
away from her bedroom windows; however, she stated that there was
still a problem with people cutting through her yard and that the
people driving through do not stop at the stop signs, and the
traffic is bad especially in the late afternoon and on.
Mayor Taylor suggested that Donald Wagner be called with addi-
tional specific times of this traffic problem, and he could con-
tact the deputies to have more patrolling during the problem hours.
Mrs. Fisher stated that she felt that a fence would be a
great help because people are not using the driveway.
Mayor Taylor stated that this problem would be checked into,
and more patrol cars would be put in that area for awhile.
Councilman Tury stated that he felt that the parking problem
should be investigated after Zapopan Center is completed and that
a fence might be the solution to the residents problems and should
be looked into.
B. Joyce Jones, 8339 Park Street, stated that she lived
across the street from Mrs. Fisher, and she reiterated the fact
that a fence would be helpful and necessary.
Mayor Taylor stated that a few months ago the Sheriff's deputies
had been patrolling the park more intensely and it seem to quiet some
of- the disturbances; however, there are more complaints now, and
it is time to do it again. CM 3-26-85

Mrs. Jones commented about the stop signs that had been placed
thereyshould have been placed in the other direction, coming away
from San Gabriel as you get to Park and Angelus.
Mayor Taylor stated that also would be investigated by Mr.
Wagner.
Councilman Tury requested that a reason be given at the
next Council Meeting why the Park should not be fenced off.
Mrs. Jones stated that'motorcycles go--in and.,out-of there;--
and 3t_.is really a problem.
Mayor Taylor directed Donald Wagner to check that out and
prepare a report for the Council regarding the motorcyclists.
Councilman Bruesch inquired if there wasn't an ordinance
that prohibits motorized vehicles in the parks and wanted to
know what the penalty was.
Mayor Taylor stated that driving in the park is prohibited;
however, he did not know what the penalty was.
Councilman Tury stated that this was an enforcement problem
and it will have to be taken care of.
Mayor Taylor stated that the Sheriff's department would have
to be contacted regarding these problems.
C. Daniel Manriquez, owner of a business in Rosemead, stated
that he wanted to inform the Council of an incident that took
place in the City of Rosemead on March 19th. He stated that he
had been subjected to severe violations of his civil rights by the
Temple City Sheriff's Department. He had witnessed the severe
beating of a young woman by the Sheriff's Department and had re-
quested and recorded their names and the action taken and was beaten
and arrested, and was denied his request for medical aid for 5 hours.
He stated that his reason for being at the meeting was to urge the
Council to initiate an investigation in this matter, and he felt
that something must be done to prevent this kind of thing happening
again to other innocent people in the community.
Mayor Taylor thanked Mr. Manriquez and stated that this is,
already under investigation and has been since the incident occurred.
He stated that Captain Callas has interviewed all of the officers
who were involved and several witnesses; however, he did not have
an answer as far as the outcome as yet.
. Councilman Tury stated that if answers are not received by
local department, the City will go to internal affairs. He added
this has been done in the past and it will continue to be done.
Councilman Bruesch requested a copy of the statement which
Mr. Manriquez had prepared.
Mervyn Kennedy, 9139 Marshall Street, a long-time resident,
stated that the American Civil Liberties Union has been apprised
of this incident and requested that a full, thorough and fair
evaluation of this incident take place. He stated that the ACLU
San Gabriel Valley Chapter had asked him to appear and speak in
the matter of justice in this matter.

IV. CONSENT CALENDAR
CC-A RELEASE OF STREET BOND FOR TRACT #37061/1130-1208
WALNUT GROVE
MOTION BY COUNCILMAN CLEVELAND, SECONDED BY COUNCILMAN
BRUESCH that the Street Bond for Tract #37061 be released and
the work be accepted as complete. Vote resulted:

V. MATTERS FOR DISCUSSION & ACTION
A. AB 724
Donald Wagner, Assistant City Manager, stated that AB 724
concerns the City of Richmond and the County.of San Francisco,
and Assemblyman Campbell has introduced AB 724 on behalf of the
City of Richmond which provides that the sales tax be applied
where the property is physically located at the time of sale.
He commented that the effect of this particular legislation
would be devastating not only to Rosemead, but other cities, and
the recommendation is to authorize staff to prepare a letter in
opposition to this Bill.
The City Council was in accord that a letter in opposition
to this legislation should be prepared and sent to the appropriate
legislators.
MOTION BY COUNCILMAN TURY, SECONDED BY COUNCILMAN CLEVELAND
that the staff prepares a letter in opposition to AB 724, signed
by the Mayor and be sent to the appropriate legislators. Vote
resulted:

B. SB 1091
Donald Wagner, Assistant City Manager, stated that SB 1091
proposes to take approximately $18,000,000, or a little over 10%
of the growth, from Los Angeles County and redistribute it to the
non-sharing property tax cities in the County. He added that for
example, the City of Rosemead could receive as much as $790,000
if this Bill passes. He commented that the City Manager and
Councilman Tury are scheduled to go to Sacramento to testify on
behalf of this particular piece of legislation, and in addition
to that, all the Cities that are effected by this legislation
are holding a Meeting on April 1, 1985 in Norwalk and hopefully,
Senator Campbell will be able to attend to answer any questions.
Councilman Tury stated that he felt very stongly about this
legislation, and commented that cities like Rosemead are being
penalized and have been penalized since Proposition 13 passed
because the Cities which were operating in excess were bailed
out by the State and our residents paid for the bail-out of those
Cities. He stated that the County is receiving another increase
of $177,500,000 in property taxes over what they received last
year and this bill if it passes will take care of 40 cities, and
will take about $18,000,000 of that increase which will be allo-
cated back to the Cities on a population basis. CM 3-26-85

Councilman Ouesch stated that without* 1091, non-tax cities
do not have an incentive to develop. He added that if all the pro-
perty value raised went into the County, it would actually be an
disincentive to development in the Cities. He felt that this was
a valid point in support'of SB 1091.
MOTION BY COUNCILMAN TURY, SECONDED BY COUNCILMAN BRUESCH
that letters of support of SB 1091 be sent to the appropriate
legislators. Vote resulted:

VI. MATTERS FROM OFFICIALS
A. Councilman Bruesch inquired if a letter had been sent
to Caltrans regarding 8555 Hellman Avenue, and he had noted im-
provement there; however, he still felt that it could cleaned
up better.
Mayor Taylor stated that he had been by there today, and
he felt that it was greatly improved.
Councilman Tury stated that he was sure that more could be
done; but Caltrans has definitely cooperated and the improvement
shows. He. felt that Del Mar should be approved by Caltrans first.
B. Mayor Taylor stated that there will be a Meeting on
April 2, 1985 at 8:00 p. m. to discuss Dedicated Law Enforcement.
VII. ORAL COMMUNICATIONS
.A. Juan Nunez, 2702 Del Mar, commented on an incident that
had happened earlier this evening at his home. He stated that a
youngster coming home from school ran into his home as refuge
from seven other youngsters who were harrassing him and demanding
the boys wallet, and pulled out a knife on him. Mr. Nunez stated
that he called the Sheriff.'s Department and they came out and made
a report; however, when he had asked the deputies if tomorrow an
unmarked car could be sent to patrol the area, they informed him
that they did not have an unmarked car for the area.
Mayor Taylor stated that a report will be received from the
Sheriff's Department tomorrow, and he stated that Councilman
Bruesch had witnessed something and was told that nothing could
be done about it, and this is a typical statement that is heard
from residents in this community. He requested that Mr. Wagner
contact the Sheriff's Department and request a full written re-
port on the incident. He added that the City Council is consi-
dering going to a Dedicated Law Enforcement Program where the
Patrol Cars will be identified as Rosemead cars because there
have been too many incidents where the proper response has not
been received.
Councilman Bruesch suggested that Mr. Nunez contact the
School authorities and they are anxious to be apprised of this
type of situations.
Mayor Taylor stated that the more people checking into these
things the better and the more answers will be obtained.
B. Emma Feely, a Rosemead Senior Citizen, inquired about
the change in the Dial-A-Ride Contract and when it would begin.
Donald Wagner, Assistant City Manager, stated that it would
begin on Monday, April 15, 1985, and Community Transit Services
will be servicing the City of Rosemead. He added that there will
be flyers sent out and publicity in the local newspapers on the
change of 'contractors.
Mrs. Feely stated that she and her friends used the service
three or four times a week and were happy and satisfied with what
they had.
Councilman Bruesch stated that if there should be any problems
with the changeover or the service, he requested that the City be
notified at once.

C. Juan Nunez, 2702 Del Mar, inquired about the meeting
regarding alternate law enforcement.
Mayor Taylor stated that it was to discuss the dedication
of patrol cars for the City of Rosemead. He stated that now
we are on a sharing program with South E1 Monte, Duarte, Rose-
mead, and Bradbury, and it is being considered becoming a dedi-
cated service so that the cars are in Rosemead and not floating
between the four cities.as it has for the past 10 years.
Juan Nunez asked when this meeting would be.
Mayor Taylor stated that it would be next Tuesday, at 8:00
p. m. in the Council Chambers.
The Council Meeting was adjourned to next Tuesday, April 2,
1985 at 8:00 p. m.
