The Adjourned Council Meeting of the City Council of the
City of Rosemead was called to order by Mayor Taylor at 8:05
p. m., in the Conference Room of City Hall, 8838 E. Valley
Boulevard, Rosemead, California.
The Pledge to the Flag was led by Councilman Cleveland.
The Invocation was delivered by Councilman Bruesch.

Mayor Taylor invited the Garvey School District Board of
Directors to have their roll call.

A. FERN SCHOOL SPORTS COMPLEX
Councilman Tury stated that the only problem he had with
the Fern School Sports Complex was that the proposal had been
made to the Garvey School District Board in February of last
year, and to this date there has been no response from them.
John Nunez, President, stated that proposal which had been
prepared by the City Attorney had been presented to the County
Counsel and they delayed action on it, and their advice to the
Board was that the proposal was not to their benefit.
Councilman Tury felt that under those circumstances, he
felt that the proposal should be withdrawn by the City, and
wait until something more is heard from the School District
Board.
Mayor Taylor felt that until the City hears differently,
the Fern Sports Complex is a standing proposal, and instead
of withdrawing it, just leave it on the table for discussion.
Councilman Imperial stated that if the proposal wasimot
acceptable to the Board and if they have not presented a counter-
proposal, on what would there be a discussion.
Robert Kress, City Attorney, stated that the proposal that
went to the County Counsel was one that had been agreed upon in
large measure by the City Council and the, Board of Directors of
the School District at the August, 1984 Meeting. He stated
that he had not heard from anyone from the County Counsel or
Administration since that last meeting in August.
Dr. Andrew Viscovich stated that agreement was prepared by
Pat Barrett and the City Attorney, and was then reviewed by
County Counsel and was returned to the School District on 15th
of June, 1984, and the County Counsel's recommendation was that
the whole Agreement should be rewritten since there were 13
points that needed correction or clarification.
Mayor Taylor commented that the 13 points had not been pre-
sented to the Council.

Dr. Viscovich stated that was correct,. and-they.,had?'not been
shared, because at that time another discussion had developed
regarding the use of Garvey Park. The Board was presented with
a proposal in terms of elements of a City/School Agreement for
joint use of Garvey Park. He stated that it was,felt that when
the Garvey Park issue was remedied, that would help in the pre-
paration of a joint proposal for the use of Fern Sports Complex.
Councilman Tury inquired if the Board felt that the Duff
School Agreement had to be worked out prior to the approval of
the Fern School Sports Complex.
John Nunez stated that it was not necessary; however, that
would be the framework that would be desirable to work out for
both school sites.
Councilman Bruesch stated that everyone seems to be in
agreement that the Fern Sports Complex is a good and needed
project especially in that area; however, it is necessary to
see what the 13 items are that are wrong with the proposal.
He felt that in order to negotiate it would necessary to see
what is being negotiated.
Councilman Tury stated that everyone thinks it is a great
project but negotiation is a two-way street.
Mayor Taylor felt that each project should be considered
individually, and stated that the Duff School Agreement pertains
to Duff School and is too general:.to use for the Fern Complex
by just changing the name on the Agreement. He did not think
this should be the precedent setting guide to be used at Fern.
Robert Miranda stated that he did not like tying Duff and
Fern into a package, and felt that one project is being held
up because of the other.
Mayor Taylor stated that he did not feel that anything
was going to be accomplished on the Fern Complex tonight since
there is too much lack of information and the County Counsel's
advise to the School Board. He stated that the Council needed
to know what the County Counsel's problems are with the proposal
so that they can be worked out or corrected.
Councilman Tury stated that he would like to see some pro-
visions written in the proposal for Duff School that at such time
the schools go off the year-round system, Garvey Park be.allowed
to be used by the residents.
Raul Garcia stated that he has had the opportunity to work
at two sites in Monterey Park for the Alhambra School District.
Monterey Highlands, which is in the middle of a Park and Bright-
wood School which is adjacent to a Park. He inquired if there
had been any imput from the City of Monterey Park or if any
information had been shared regarding the Agreements between their
school district and their City.
Mayor Taylor stated that he was not aware of any such infor-
mation.
Mr. Garcia felt that it would be worthwhile investigating
how the City of Monterey Park and the Alhambra School District
have handled their problems.
Councilman Bruesch stated that South E1 Monte has a complex
down by Peck and the Freeway. He stated that the El Monte Redev-
elopment Agency built a baseball field there and there is a joint
agreement and requested that that agreement be investigated also.
He suggested that staff request information from both cities re-
garding their joint agreements with the school district.

Councilman Tury stated that from the discussion taking place
he felt that there was general agreement that the two school sites
should be separated, and maybe progress could be made at least on
one. He added that Garvey Park and the Duff School site seems to
be the most pressing, and he felt that the Fern Sports Complex can
not be handled at this particular meeting.
Councilman Bruesch agreed with Councilman Tury that the pro-
jects should be considered separately and that a date should be
set tonight for another joint meeting with a counter proposal being
presented regarding the Fern Sports Complex. He felt that about
6 weeks should be adequate time to get some of the information
needed to proceed with that agreement.
Councilman Imperial stated that he wanted the information
before setting a date for another meeting.
Mayor Taylor stated that it seemed that everyone was in accord
as far as wanting more information and a counter proposal from the
school board for the Fern School Sports Complex and suggested that
the Duff School-City Agreement for the Joint Use of the School/Park
Property be discussed at this time. He inquired if there was any ques-
tions-on the first article #1?
Michael Burbank, Parks & Recreation Director, stated that
the description is of the whole parcel, and Garvey Park only
represents 1/3 of that parcel. He drew a map of the area and
suggested that a diagram of the site should be included with
Article #1 showing'where the property boundaries lie.
Mayor Taylor commented on Article #2 and the hours the school
would have primary use of the area.
John Nunez stated that the hours utilized by the school would
from 8:30 to 4:00 p. m. and the days would all days except for
Saturdays, Sundays and School Holidays.
Mayor Taylor commented on Item #3 which states the City would
have primary use on all other hours, which is after 4:00 p.m. and
week-ends.
Mayor Taylor stated that Item #4 was self explanatory in
that the primary use agency could grant permission to the other
agency on a permit or permission basis to use for special occa-
sions.
Mayor Taylor commented-on Item #5 and that it seemed to say
the same thing as Item #4, and it is redundant, and should be re-
moved.
Mayor Taylor commented on Item #6 and inquired if there were
any questions, and there being none they went on to the next item.
Mayor Taylor commented on Item #7 which stated that the City
and the School would share the cost of turf maintenance.
Michael Burbank stated that the City takes care of the irri-
gation system; however, the grass, turf, potholes, dirt and every-
thing else is handled by the School. He added that the ball '.diamonds
are maintained by the City since it is on City property.
Bob Miranda thought that item could be more specific in
the items each are responsible for.
Mayor Taylor commented on Item #8 which relates to the legal
liabilities of the agencies that had primary control.
Robert Kress, City Attorney, inquired if the County Counsel
approved that condition? He stated that the County Counsel has
specific language regarding negligent acts of either party and
this just doesn't cover it.
Mayor Taylor stated that he was sure that this, would have
to be refined and he was sure that it was not proper the way it

Mayor Taylor commented on Item #9 which is the termination
clause, and he felt that it was not even needed because it was
so general. He stated that it should be made more specific and
the termination clause should be reviewed every five years by
the school board and the City, and could have an annual termin-
ation clause if notice is given by a certain date.
Councilman Tury inquired if it could be reviewed annually
as long as the year-round school is in session.
Everyone seemed to be in accord to have a review annually
as long as Duff School is on year-round sessions.
Mayor Taylor stated that he had asked earlier in the evening
about the 13 points that the County Counsel had disagreed with on
the Fern Complex proposal, and had also asked about the nine points
on the Duff Agreement had been approved by the County Counsel, and
both times got a yes answer.
Dr. Viscovich stated that the County Counsel had reviewed them.
Councilman Bruesch requested copies of agreements that Monterey
Park has with the schools, and South El Monte has with the schools.
John Nunez stated that he would get a copy of the County
Counsels opinion on the Fern Sports Complex to the City Council.
He stated that at the next meeting of the Board, he would bring
up the issue of the counter proposal for the Fern Complex.
Councilman Tury stated that the Duff School proposal should
be put in a legal form with legal language.
Dr. Viscovich stated that a target date could be April 30,
1985 for another joint meeting.
John Nunez inquired about the Cable T. V. Company and the
type of access that the schools would have.
Mayor Taylor stated that the City doesn't have control over
what the available public facilities would be, and that the School
District should contact the Cable T. V. Company.
Frank G. Tripepi, City Manager, stated that the Cable T.V.
Company will provide a free drop to all public institutions within
the City, and from that you will receive basic service.
Raul Garcia stated that working with the Alhambra School
District they have had some interaction with Falcon T.V. and
all of it has not been positive, and he suggested that the
company be watched as far as the communications between Falcon
and the other public agencies. It can be a great advantage for
the School District to be able to have access to their resources.
Frank G. Tripepi, City Manager, stated that back when the
Alhambra franchise was granted it was back when all of the com-
panies were offering the world to get the Franchise, and many of
those promises are no longer even allowed to be discussed.
Dr. Viscovich expressed his appreciation for the footbridge
across the wash and it has been used regularly and daily. He
stated that Fern may become an Elementary School entirely and
Rice may become an intermediate school and our school organiza-
tion may be from K-5 and 6-7-8 and that will help as far as
traffic patterns and all kinds of safety issues that have to be
considered. He stated that one foot bridge is influencing the
new school, Bitely School, and the contractor will start next
month and if everything goes well on September, 1986 a school
of 600 youngsters will be open.

Councilman Tury stated that the Bitely School is a beauti-
ful complex and stated that if anyone should get the chance to
see the pictures they should go to Dr. Teaney's office.
John Nunez stated that possibly at the next joint meeting,
he could bring in the artists rendition of the school and dis-
play it.
There being no other business to handle, the meeting was
adjourned to the next regular meeting on March 26, 1985 at 8:00
p. M.
