MINUTES OF THE REGULAR MEETING
ROSEMEAD CITY COUNCIL
JULY 10, 1984 AT 8:00 P. M.
The Regular Meeting of the Rosemead City Council was called
to order by Mayor Taylor at 8:05 p. m., in the Council Chambers
of CitylHall, 8838 E. Valley Blvd., Rosemead, California.
The Pledge to the Flag was led by Councilman Cleveland.
The Invocation was delivered by Reverend Richard Acosta.
ROLL CALL OF OFFICERS:
Present: Councilmen Bruesch, Cleveland, Imperial, Tury
and Mayor Taylor
Absent: None
AL OF MINUTES: June 26, 1984 - Regular Meeting
Mayor Taylor stated that there should be a clarification on
page #5l and requested that the Minutes be deferred to the next
meetine.
There being no objection, it was so ordered.
I. ORAL COMMUNICATIONS
A.l Joyce Jones, 8339 Park Street, stated that she still had
complaints about Zapopan Park. She stated that a sign had been
put up, but it was small and people are not paying attention to it.
She had not noticed police patrolling the park after 11:00 p. m.
Mayor Taylor inquired if there had been any decrease in the
noise or drinking.
Mrs. Jones stated that last Saturday night the neighbors had
a partyl and they ended up in the park around 11:00 p. m. drinking
and sitting at the table and bench right next to Mrs. Fisher's
house. (She inquired why could they not get a fence at that end
of the street.
Councilman Bruesch inquired if a Police Report was made about
the disturbance.
Mrs. Jones stated that she made a Police Report at 11:30 p.m.
and they responded about 12:30 a.m. She felt that if signs are to
be posted they should be large enough for people to see.
Frank G. Tripepi, City Manager, stated that since the June 26,
1984 Council Meeting there have been 28 log entries encompassing
various contacts between the law enforcement officers and trespassers
in that park. He stated that even.prior to that June 26th Meeting,
there have been arrests made in that park for possession of drugs.
Lt. Johnston stated that these contacts were made as early as
5:00 p. m , and as late as 5:00 a. m.
Councilman Tury stated that he felt that some deputies should
swing by there around 11:00 p. m. each night and monitor the situa-
tion for another two weeks and he requested that more signs be
added and possibly larger ones.
Mrs. Olga Fisher, 8334 Park Street, stated that she lived
right next to the park, and she commented on the party on Satur-
day night with a lot of young men drinking beer and using her
fence to relieve themselves. She stated that there was a fence
there at one time, but the fence had been knocked down and never
replaced..
Mayor Taylor stated that there is a possibility.that a fence

Frank G. Tripepi, City Manager, stated that the memorandum
from Lt.Tom:Johnston had indicated that the crews are going to
continue to monitor that park. He stated that another report
would be prepared for the Council by the next meeting.
Councilman Imperial requested a memo from the Sheriff's
Department on activities within this City during that one hour
period to see why there should have been a one hour response
time. I
Councilman Tury stated that he felt that there should be a
sign right at the end of that street as you walk into the park,
may be on the other streets too. They should be on a pole, by
itself and very, very visable, at every entrance to that park.
B.JMr. Lerma, 3203 N. Delta Avenue, Rosemead, complained
about the fact that yesterday he had been forced to leave Garvey
Park bylthe Principal of Duff School, and the police. He ques-
tioned if the Park belongs to the City or the School District.
Mayor Taylor stated that Garvey Park is City property and
a. portilfon of that area overlaps into school property.
Michael Burbank, Parks & Recreation Director, stated that
the area that this gentleman was in is City property.
Mr! Lerma stated that he was threatened to be thrown in
jail and his children placed in a foster home by Officer Griffin,
Badge #56.
Mayor Taylor requested that the City Manager prepare a report
on thislincident, and inquired who had initiated the arrest.
Mr! Lerma stated that the principal had told him to leave
or he would call the police. He said that the Park belongs to
the School from 8:00 a.m. to 3:00 p. m. and then it becomes a
public park and not before.
Councilman Tury stated that he felt that the school has in-
correct 'information and it is a public park and until such time
that the Council grants them exclusive use through the school
district for year around school it remains a public park.
Mayor Taylor requested a full written memorandum explaining
what happened and one from the school district explaining the mis-
understanding. From what was stated tonight, it was City property,
and a memorandum to the school district is needed stating that this
is something that the City will have control over.
Frank G. Tripepi, City Manager, stated that he was not sure
why the IDistrict took that action. It may have been based on
mistaken knowledge or on past history between the District and
the City. That small ball diamond is for their exclusive use under
an informal agreement between the City and the School District
during the nine months that school is in session, for the hours
that classroom instruction is taking place. When the Board made
the decision to proceed with year-round school, they made the
assumption that that informal agreement for the exclusivity of
that particular parcel probably was carried over.
Councilman Imperial inqui-red if there had been a Facility Use
Permit issued for that.
Mr! Tripepi stated that there had been, and that Mr. Burbank
had informed the School District that for the summer months if
they wanted to expand that exclusive use beyond the school year
they would have to file a Facility Use Permit with the City, and
they have done so as of yesterday.
Mayor Taylor stated that he did not have an answer to this
problem, however, he directed staff to research this and come
back to the Council with a report.
Councilman Imperial requested a copy of the Facility Use Permit
and a report on what transactions that led up to this point.

Don Detora, 4731 N. Muscatel, inquired about an item

Mayor Taylor stated that he had read in newspapers about $500
contributions being made to candidates, but he does not know where
the Conflict of Interest comes in; however, the City Attorney might
have the answer.
Robert Kress, City Attorney, stated that he could not render
an opinion on a hypothetical question like that. If that issue
is presented and if a member of the Council would like that opinion,
he would certainly;.give one.
Mr. Detora stated that he would like to know because to him that
is a Conflict of Interest.
Councilman Bruesch requested that the City Attorney investigate
such Conflict of Interest regarding the donations referred to. He
did_+know that in other cities questions have been raised and people
have been disallowed to vote on those particular franchises.
Mayor Taylor directed the City Attorney to investigate the pos-
sibility of a Conflict of Interest.
D.I Robert Miranda, 8046 Whitmore, commented on the Garvey Park
incident. He stated that there were no posted signs saying this por-
tion belongs to the School District and this area belongs to the City.
Anyone who crosses over to the Districts property, is subject to arrest
at the discretion of the principal. If signs are posted,it would
allow the community to know what:property they are on.

or Taylor stated that there has been a mutual cooperation

Mrl. Miranda stated that the only reason that it has not happened
in the past is that there was not year-round school.
Mayor Taylor inquired if the entire School District went year-
round then it would require the vote of the people.

CC-C APPROVAL OF WILLDAN ASSOCIATES PROPOSAL FOR CDBG
ADMINISTRATIVE SERVICES FOR 1984-85 PROGRAM YEAR
Mayor Taylor inquired if this letter which was sent to the
consultants requesting proposals was the only information sent.
Frank G. Tripepi, City Manager, stated that was the proposal
request that went to several agencies. He added that this was a
recent I requirement that came from the County. That proposals must
be requested and received and the firms that responded are the firms
that are most.active in the area with the County.
Councilman Bruesch inquired what the cost for this service in
the last fiscal year from Willdan.was.
Mark Fullerton, Willdan, stated that it was $70,000 opposed to
the figure of $80,000 for the coming year. There was an increase in
the Residential Rehabilitation from $30,000 to $35,000.
Councilman Tury stated that Willdan has done an excellent
job for the City and has an excellent staff that knows the City.
Mayor Taylor stated that he did not object to Willdan's
proposal; however, he questioned the proposal requests, and
stated1that he felt that it was not adequate.
Frank G. Tripepi, City Manager, stated that the programs
are very specific and all the consultants that work with these
programs know what those requirements are, and they know what

A.I GENERAL PLAN/CONSULTANTS
The staff's recommendation was that Donald Cotton & Associates
be considered to prepare the City's General Plan.
After much questions and answers regarding the procedure at
arriving at that recommendation a motion was made.

that Donald Cotton & Associates be chosen to prepare the City's
GenerallPlan. Vote resulted:

Mayor Taylor requested copies of the General Plans that
this company has put together for the cities listed so that we

Councilman Bruesch requested a memo explaining how the Council
is to determine, whether in these clients lists, it is individual
work or the work of the whole company.
John Carmona, Planning Director, introduced Laura Hudson to
the Council and the audience, and stated that she will be the
projectimanager.

Councilman Bruesch requested that the record show that he
is in favor of.the project; however, he is philosophically opposed
to use of Redevelopment funds in this manner outside of the Redev-

VI. MATTERS FROM OFFICIALS
A.1 OLYMPIC TORCH RELAY RUN JULY 22, 1984
Councilman Bruesch stated that he had been informed today
that the cost of the Banner would be prohibitive; however, he
did want the staff to investigate the possibility of obtaining
small hand held American Flags to be passed out to the community.
Taylor inquired about the hand-held flags and the quantity
needed.
Councilman Bruesch stated that he would like the staff to check
on the cost of these flags; however, it would not be a cost to the
City as the service groups would pay for it.
Mayor Taylor directed staff to investigate the cost of the
flags.
B.I METERING OF ON-RAMPS
Councilman Bruesch inquired if the City could allow the ramp
metering to be installed if the same could be continually cleaned.
He felt that the trash on the off and on-ramps are getting out of
control.
Mayor Taylor stated that the ramps should be cleaned either
way. He stated that a letter from the Mayor of E1 Monte asked
the Rosemead City Council to oppose the ramp metering project. CM 7-10-84

Sewer Gas

built in Emerson which was 1,100 feet long and was de-

in, and this is suspected to be the problem. There are

al solution. The second possibility would be to put a
trap in the house lateral, and that would intercept the

expensive way.

send another letter to find out what is taking so long.

from the Assessors office, but the Council requested letters

no delay in receiving a letter from Mr. Pope.
CABLE T.V. STUDY SESSION
Mayor Taylor inquired if the Council wanted to set a study
sessionldate and time.

COMMUNICATIONS
A.I Juan Nunez, 2702 Del Mar, inquired what would happen if
there were problems with sewer gas at a later date,and the wet
seal could be broken and the sewer gas could come into the house.
Mayor Taylor stated that anyone's house could have that same
situation today if the seal malfunctioned. If the replacing of
the seal does not solve the problem, then further measures will
be taken. In two weeks another report will be presented to the
Council.
B. CABLE T.V. STUDY SESSION
Councilman Bruesch stated that he would like a date set for
the Cable T.V. Study Session.
Mayor Taylor inquired whether there was enough information
available.
Councilman Tury stated that they had just received a large
package Ion Cable T. V. and he would prefer to set a date for a
study session.
Councilman Bruesch stated thathe would like to have the
public notified of the date.
Mayor Taylor inquired if the 17th of July would be alright.
There being no objection, the Cable Study Session was set for
July 171, 1984 at 8:00 p._m.
C. Hugh Foutz, City Treasurer, announced the Fiesta that
will be held at Rosemead.High School on July 27th at 8:00 p. m.
which will present the "Voices of Chapala" with "Ballet Folklorica".
He invited everyone to attend and felt that it was something that
Rosemead should be proud of, as it will be a great cultural event.
D. Mayor Taylor stated that he had asked the City Manager
to research information regarding who had paid for the hotel accomo-
dationslof the Sister City program. He asked Mr. Foutz if the Sister
City organization was prepared to pay for the hotel accommodations.
Mrl. Foutz stated that they are hoping that the City will pick up
that expense as usual, and it has been budgeted in the past.
Mayyor Taylor stated that he brought this up tonight in order to
give the organization some advance notice, as the City did not pay
for their hotel accommodations the last trip they made to Rosemead.

E.
EXECUTIVE SESSION
City Council recessed to an Executive Session.
City Council reconvened from an Executive Session.
Robert Kress, City Attorney, stated that the Council received
a report from the City Attorney regarding pending eminent domain
litigation by a vote of 3-2 instructed the Attorney to make a
settlement in this matter.
Mayor Taylor requested that the address and the vote be in-
cluded in the minutes.
The City Attorney stated that the property is located at
8689 Garvey and Councilmen Bruesch, Cleveland and Tury voted
Aye and Councilman Imperial and Mayor Taylor voted Naye.
F. Councilman Tury inquired about the cracking concrete
that was poured last year.
Tom Howard, Deputy City Engineer, stated that he has had
the Contractor come back and rework it by sealing the cracks,
and that should solve the problem.

Howard stated that it would be at the Contractor.'s expense.
The City Council Meeting was adjourned to next Tuesday night,
July 171, 1984 at 8:00 p. m. for the Cable T.V. Study Session.
