The subject property consists of a single family dwelling with extensive unpenmitted construction
and conversions. There appear to be five dwelling units. At the initiation of the case, all units were
tenant-occupied. The property is zoned R-1. A "Please Letter" and "bulky item" trash notice were
mailed to the property owner on April 12, 2000. On May 3, 2000, Mrs. Martinez, the property
owner, submitted a plan to Planning Department attempting to legalize the rear building which
contains two of the unpermitted units. There is also an unpenmitted addition to the garage which
is being used for living purposes. In addition, the main house has been divided into two separate
units. Planning Department staff denied the plan submitted by Mrs. Martinez. The building lacks
the required rear setback, in addition to being too close to the main dwelling. On May 15, 2000,
the building inspector spoke with the property owner. Mrs. Martinez indicated that she would
obtain a permit and commence demolition of the unpermitted construction.
The Building Official declared the property substandard and filed a Declaration of Substandard
Property with the Los Angeles County Recorder's office. A "Thirty Day" certified letter was
mailed and posted on the property on May 24, 2000, requesting abatement of the substandard
conditions. Inspection on June 12, 2000 revealed no progress. Follow-up inspection on June 26,
2000 showed no change at the property. Subsequent inspections in July, August, and September
revealed no change at the property other than the fact that the rear building appeared to have been
vacated. All trash, junk and debris remained scattered throughout the property, and no removal of
the unpermitted work had occurred. Inspection on October 9, 2000 indicated minor yard area
cleanup and the removal of an unpermitted shed: No other progress was evident and, to date, no
permits have been obtained.
A Notice of Hearing was mailed and posted on the property on November 7, 2000. All interested
parties have been notified.

Dear Mr. and Mrs. Martinez:
A recent inspection of the property at the above address has found it to be substandard as defined by the City of
Rosemead Building Code, because of the defects enumerated in the attached list.
Section 9908 of the Code declares all such substandard buildings a public nuisance and requires the abatement
thereof by correction, if practical, or demolition of the substandard conditions.
As the owner of record, you are hereby notified to comply with the requirements of the above code, and to correct
or remove the substandard conditions listed. All such work shall be completed within thirty (30) days after receipt
of this letter. Be advised if you are renting this property to others the City may file a Notice of Non-Compliance
with the State Franchise Tax-Board:--Revenue and-Taxation Code:-Section 17274 states: "No deduction shall be
allowed for interest taxes depreciation or amortization with respect to substandard (rental) housing."
This notice will be posted on the property. If in your opinion, you disagree or cannot comply with the above
findings or order, you may request a public hearing. The request for hearing must be within thirty (30) days after
posting of this notice on the property, must be in writing, and directed to the City of Rosemead Building Official,
8838 East Valley Boulevard, Rosemead, California 91770.
