RE: APPROVAL OF 4TH OF JULY PARADE AGREEMENT BETWEEN THE CITY OF
ROSEMEAD AND PARADE COMMITTEE
Attached for review is an agreement with Rosemead's 4 h of July Parade Committee. The agreement
is the same as the one approved last year by the City Council.
RECOMMENDATION:

Staff recommends that the City Council approve the agreement between the City of Rosemead and
the Rosemead 4th of July Parade Committee.
AGREEMENT
AN AGREEMENT BETWEEN THE CITY OF ROSEMEAD AND THE ROSEMEAD 4TH
OF JULY PARADE COMMITTEE
This Agreement is entered into this 25th day of May, 1999, by and between the City
of Rosemead, a municipal corporation, 8838 East Valley Boulevard, Rosemead, California
91770, hereinafter referred to as "City" and the "Rosemead 4th of July Parade Committee",
whose mailing address is 8367 E. Whitmore, Rosemead, California, 91770, hereinafter referred
to as "Committee".
RECITALS
WHEREAS, the City and the "Committee" have for many years maintained a
relationship whereby the Committee plans and conducts a 4th of July Parade for the benefit of
the citizens of Rosemead under the City's direction and control; and
- - - - WHEREAS, the City and the Committee are desirous of continuing the-existing--
relationship through-a formal contractual agreement; and
WHEREAS, the City of Rosemead is a member of the California Joint Powers
Insurance Authority (CJPIA); and
WHEREAS, the CJPIA General Liability Protection Program provides that any
California corporation or unincorporated association under written contract with the member
City to perform specified functions under the direction and control of the member City is a
"Protected Party";
NOW, THEREFORE, the parties agree as follow:
1. FUNCTIONS. The City authorizes the Committee to plan and conduct the 4th of
July Parade for the residents of Rosemead under the direction and control of the City.
2. FUNDING LEVEL. The City Manager will recommend the City Council allocate $
8,000.00 to the Committee for fiscal year 2000/2001.
3. CITY STAFF REPRESENTATION. City staff may be assigned by the City
Manager as needed to assist in the implementation of the Parade specified in this
agreement.
4. NONPROFIT STATUS. The Committee shall maintain its status as a
unincorporated Association,
5. GENERAL LIABILITY INSURANCE. Due to the Committee's status as a
"Protected Party" under the CJPIA General Liability Protection Program, the
Committee and its officers, agents and volunteers are covered under the terms and
conditions of the CJPIA General Liability Protection program as a "Protected Party"
only for the event authorized by this agreement.
6. COMPLIANCE WITH STATE AND LOCAL REGULATIONS. The Committee
- - - - - - -""shall-operate in accordance with all applicable federal, state and local laws, and in a
reasonable and safe manner.
7. AUDIT OF FINANCIAL RECORDS. The Committee shall make its financial
records accessible to the City for review upon request.
8. NOTICES. All notices shall be served in writing. The notices to the City of
Rosemead shall be mailed to the following address: 8838 East Valley Boulevard, -
Rosemead, 91770. Attention: City Manager. Notices, reports and statements to the
Committee shall be mailed to: 8367 E. Whitmore, Rosemead, California 91770,
Attention: President.
9. TERM. The tern of this Agreement shall be for one (1) fiscal year, July 1, 2000
through June 30, 2001, in full force and effect unless otherwise amended by both
parties.
