The subject property consists of two, tenant - occupied, single family dwellings located in the R -2
zone. The rear house has an unpermitted addition.
A "Please Letter" was mailed to the property owner on January 10, 2000, and a "bulky item" trash
notice was sent on January 17, 2000. Inspection on February 16, 2000 revealed no progress. At the
time, a garage conversion was being occupied. The Building Official declared the property
substandard and filed a Declaration of Substandard Property with the Los Angeles County
Recorder's office. A "Fifteen Day" certified letter was mailed and posted on the property on
February 24, 2000, requesting abatement of the substandard conditions.
On March 2, 2000, one of the property owners, Chin Yuen Yee, obtained "Repair per Rehab"
permits for both houses. On April 4, 2000, the building inspector met with Ms. Yee at the property.
At that time, the garage was still occupied. Ms. Yee advised the inspector that she was in the
process of evicting those tenants. She provided documentation to substantiate her claim. On June
5, 2000, Ms. Yee informed staff that the tenants had vacated. She was granted a thirty day extension
to allow her time to submit plans and to make progress. Inspection on July 20, 2000 confirmed that
substantial progress had been achieved. On July 24, 2000, Ms. Yee submitted plans to Planning
Department in an attempt to legalize the unpermitted addition at the rear house. The plans were
denied by Planning Department.
On August 29, 2000, Ms. Yee brought a letter to City Hall requesting to maintain the addition. She
claimed she had purchased the property with the addition, and that the removal of such would create
a financial hardship. She said she purchased the property through a realtor and was unaware of any
unpermitted construction or Code violations. When she submitted her letter, she spoke with staff
from both Building and Planning Departments. She reiterated what she had stated in her letter, and
requested a hearing before the Building Rehabilitation Appeals Board.

Ms. Lee obtained permits, abated the garage conversion and most of the other substandard
conditions. However, the unpermitted addition does not meet Planning Department requirements
and cannot be legalized without major reconstruction and the addition of a two -car garage.
A Notice of Hearing was mailed and posted on the property on September 12, 2000. All interested
parties have been notified.
CITY BUILDING OFFICIAL'S RECOMMENDATION:
It is recommended that the Board find the property substandard and order that the unpermitted
construction be removed by November 1, 2000.

Dear Ms. Arguello,
I am the owner of the referred property. I purchased the property with the alleged the laundry and
storage rooms (total of 185 SF) in 1988 though my real estate agent who went through all indusrial-
standard ways for the transaction of the property. I did not know that the referred rooms had been built
without the city permit unid April, 2000 when 1 was informed by you that the referred rooms (plus another
pre - existing storage room attached to the garrage) had been built without permit. I hired someone to have
the storage room attached to the garage demolished shortly after that. In the meantime. I submitted a plan to
the planning department hoping to conform the alleged rooms to present building code and regulations. The
plan was rejected on 7/2512000 by the planting department because it requires a seperate two -car garage to
have any additions due to the fact that the property is a R -2 lot
By this letter, I'm requesting a variance from your department for me to keep the referred laundry
and storage rooms. I'll be very grateful if you and your department can do so, considering that the previous
demolition already incurred substantial economic loss to me and the further demolition of the referred
rooms will create even more hardship for me. After all, I don't think it is fair to penalize me, an innocent
and ignorant homeowner for the fault of someone else (the previous owner) who has been unfairly enriched
by selling me the property with the trpernutted spaces 12 years ago.

A recent inspection of the property at the above address has found it to be substandard as defined by the City of
Rosemead Building Code, because of the defects enumerated in the attached list.
Section 9908 of the Code declares all such substandard buildings a public nuisance and requires the abatement thereof
by correction, if practical, or demolition of the substandard conditions.
As the owner of record, you are hereby notified to comply with the requirements of the above code, and to correct
or remove the substandard conditions listed. All such work shall be completed within fifteen (15) days after receipt
of this letter. Be advised ifvou are rentine this Property to others the City may file a Notice of Non-Compliance with
the State Franchise Tax Board. Revenue and Taxation Code Section 17274 states "NO deduction shall be allowed
for interest, taxes, depreciation. or amortization—with respect to substandard (rental) housine."
This notice will be posted on the property. if in your opinion, you disagree or cannot comply with the above findings
or order, you may request a public hearing. The request for hearing must be within fifteen (15) days after posting
of this notice on the property, must be in writing, and directed to the City of Rosemead Building Official, 8838 East
Valley Boulevard, Rosemead, California 91770.
