The City Attorney has also been made aware of this issue. He will continue to monitor the decision as it goes through the appeals process. RECOMMENDATION It is recommended the Traffic Commission file this report until further actions are made on the issue. Staff will be in contact with the City Attorney to keep informed on the issue. The federal act was meant to deregulate motor carriers, putting them on an equal footing with air carriers. Preempting local ordinances "would be more likely to further that purpose, since it would decrease the likelihood that motor carriers would be subject to burdensome local regulation," Damrell reasoned. The act exempts state safety regulations from its preemption clause, but "not regulations and laws issued by the local governments," the judge found. Additionally, "It is clear that Congress intended to preempt (even) state law C related to the price, route, or service of any motor carrier of property." The judge noted that while there is a difference of opinion among federal appellate courts on whether the safety exception extends to local ordinances, the split is four that it does not, with the 9th Circuit among the four. Riley, Vice President of City of Angels Medical Center's Ingleside Campus. Dr. Riley indicates the Ingleside Campus has experienced considerable growth resulting in a shortage of on -site parking availability. Dr. Riley is requesting the removal of on- street parking prohibitions on Hellman Avenue and Stevens Avenue to accommodate more street parking adjacent to their facility. CONDITIONS Stevens Avenue is a 32 -foot wide residential roadway with parking allowed on both sides of the street. Parking is prohibited on Mondays between 10 AM and 2 PM for street sweeping. Parking directly in front of the Medical, Center is fully occupied. Hellman Avenue is a 40 -foot wide collector roadway with one lane of traffic in both directions separated by a double yellow centerline. In front of the Medical Center parking is restricted primarily with red and yellow curb. The available parking, including the yellow curb is fully occupied. Exhibit 1 depicts existing conditions on Hellman Avenue and Stevens Avenue DATA The reported accident history on Hellman Avenue, Stevens Avenue and Prospect Avenue in the vicinity of the Medical Center was reviewed for the period from January 1, 1998 through March 31, 2001. Three accidents were reported and summarized on the following page. Hellman Ave. 75 feet west of Improper Turn 5 /27 /99,Thursday & Stevens Ave. 7:09 PM Eastbound vehicle making a U -turn broadsided an eastbound vehicle proceeding straight. * PCF = Primary Collision Factor DISCUSSION Field observation of the parking at the Medical Center identified a high volume of vehicles parking on -site as well as off -site (street parking). It appears the on- street parking is fully occupied throughout the day. However, this on- street parking does not yet encroach into the residential area of Stevens Avenue. There does exist red curb on Stevens Avenue immediately south of Hellman Avenue. This red curb was installed in 1998 in response to resident's concern for vehicles obstructing visibility and maneuverability at the intersection of Hellman Avenue and Stevens Avenue. The staff report and meeting minutes of the Traffic Commission meeting regarding this issue is attached. No change is recommended for this existing red curb. The existing red curb on Hellman Avenue appears to have been installed in association with the white crosswalk that was removed approximately 5 years ago. The red curb was installed to provide additional visibility of the crosswalk and is no longer necessary. However, some red curb should be retained to provide maneuverability for vehicles entering the Medical Center as well as those entering and exiting the gated residential community north of the Medical Center. The existing yellow curb on Hellman Avenue was probably installed at the request of the previous tenant of the Medical Center (Ingleside Hospital). It appears the current facility has a loading area on Prospect Avenue. Removal or Request to Remove On- street Parking Prohibitions on Hellman Avenue and Stevens Avenue — City of Angels Medical Center Page 3 of 3 reduction of the yellow curb needs to be discussed with Dr. Riley. However, due to the holiday schedule, contact with Dr. Riley was not made. Staff will attempt to contact Dr. Riley before the Traffic Commission meeting. RECOMMENDATION Based on the request from the Medical Center and observation of the conditions of the site, it is recommended that 100 feet of red curb be removed to provide more "unrestricted" parking on Hellman Avenue in front of the Medical Center. Additional "unrestricted" parking area may be recommended after discussions with Dr. Riley regarding the yellow curb. Exhibit 1 depicts the location of the recommended removal of red curb. However, such growth has resulted in increased numbers of employees and physicians to handle our patient volume, as well as visitors and vendors, alike. As a result, our already tight parking situation in our on -site lot has become even more taxed, despite the hiring of our own Full -Time parking attendant. With such excess our employees, visitors, etc. are left to search for street parking which is forbidden in some areas due to red -curbs and /or other restrictions (specifically on Hellman Ave and Stevens Street). Please consider my request to review and eliminate_ the street parking restrictions surrounding our facility to help ease the critical parking situation for our facility. Parking is allowed on both sides of Stevens Avenue except during street sweeping periods. There are no traffic stripes painted on the roadway. The prima facie speed limit on Stevens Avenue is 25 mph. Hellman Avenue is a 40 -foot wide east/west roadway with fronting residential properties on both sides of the street. Parking is allowed on both sides of the roadway. A double yellow stripe separates opposing lanes of traffic. The posted speed limit on Hellman Avenue is 30 mph. Figure 1 depicts these conditions. 0 M . The accident involved a westbound vehicle proceeding straight broadsided an eastbound vehicle making a U -turn. The primary collision factor was "unsafe speed ". DEC.26'2001 11:45 #1514 P.003 DISCUSSIOR Field review of the intersection did identify vehicles parked in the vicinity. It appeared that the majority of the vehicles were parked for long periods of time. Parking did occur up to the curb returns of both Hellman Avenue and Stevens Avenue. The density of the parking on Stevens Avenue lessened as you traveled south from Hellman Avenue. The favorable accident history indicates vehicles are accessing /traveling the intersection in a prudent manner. .If there were accidents involving parked vehicles, a correlation between the volume and location of parked vehicles might be made. Currently, Ingleside Hospital is responsible for cleaning the gutters on the east side of Stevens Avenue from Hellman Avenue to their south property line. This was approved at the request of the Hospital by City staff to accommodate the parking needs of the facility. The installation of red curb at the intersection will improve ingress and egress at . Stevens Avenue and Hellman Avenue. However, staff did identify red curb existing on the south side of Hellman Avenue both east and west of Stevens Avenue. No additional red curb, therefore, is recommended on Hellman Avenue. •uu The installation of 50 feet of red curb on the east and west sides of Stevens Avenue at Hellman Avenue is recommended as depicted in Figure 1. Qe To: The Rosemead Traffic Commission CC: Mr. Donald Wagner, Assistant City Manager Re: Parking situation on Stevens Avenue Madam, Gentlemen of the Rosemead Traffic Commission: Problem: We, the residents of North Stevens Avenue, are experiencing great difficulties in making left and right turns onto Hellman Avenue from Stevens Avenue or onto Stevens Avenue going south due to vehicles parked on the very end of the street on Stevens Avenue intersecting Hellman Avenue and Hellman Avenue intersecting Stevens Avenue. Solution: Paint the curbs red on both sides of Stevens Avenue (intersecting Hellman Avenue), to the south for at least fifty feet or more and including Hellman Avenue to the west and east. This will give the residents and others a much safer ingress and egress. If possible, a white line in the center of Stevens from Hellman south to just past the hospital parking lot exit would greatly help to keep moving vehicles on the proper side of the street. The primary collision factor was "unsafe speed ". Field review of the intersection did identify vehicles parked in the vicinity. It appeared that the majority of the vehicles were parked for long periods of time. Parking did occur up to the curb returns of both Hellman Avenue and Stevens Avenue. The density of the parking on Stevens Avenue lessened as you traveled south from Hellman Avenue. The favorable accident history indicates vehicles are accessing/traveling the intersection in a prudent manner. If there were accidents involving parked vehicles, a correlation between the volume and location of parked vehicles might be made. Currently, Ingleside Hospital is responsible for cleaning the gutters on the east side of Stevens Avenue from Hellman Avenue to their south property line. This was approved at the request of the I.lospital by City staff to accommodate the parking needs of the facility. The installation of red curb at the intersection will improve ingress and egress at Stevens Avenue and Hellman Avenue. However, staff did identify red curb existing on the south side of Hellman Avenue both east and west of Stevens Avenue_ No additional red curb, therefore, is recommended on Hellman Avenue. RECOMMENDATION: #1514 P. 012 The installation of 50 feet of red curb on the east and west sides of Stevens Avenue at Hellman Avenue is recommended. Deputy Traffic Engineer Itagaki stated that it starts at 32' feet and widens to 36 feet. Speaking before the Commission was: Warren Jung 3300 North Stevens .Rosemead, California 91770 Mr. Jung stated that the problem usually occurs during the day between 7:00 a.m. - 5:00 p.m. He agrees with the red curb and feels that a time limit would help. Chairman Tirre inquired as to how many homes would be affected by this recommendation. Deputy Traffic Engineer Itagaki stated that only I house would be affected. It was moved by Commissioner Baffo, seconded by Commissioner Ruiz, and carried unanimously to approve the Traffic Engineer's recommendation. At this time, Chairman Tirre introduced Jessica Wilkinson to the Commission and the audience. B. SOUTHBOUND DEL MAR AVENUE CURB LANE AT OARVEY AVENUE Deputy Traffic Engineer Itagaki stated that Vice - Chairperson Knapp requested staff to investigate the possibility of installing a southbound right turn only lane on Del Mar Avenue at Garvey Avenue, Vice - Chairperson Knapp indicated the lane appears wide enough to accommodate this .movement.
