ORDINANCE NO. 653
AN ORDINANCE OF THE CITY COUNCII.. OF THE
CITY OF ROSEMEAD AMENDING THE BUSINESS
LICENSE REQUIREMENTS TO PROHIBIT SAI.ES OF
MERCHANDISE, OTHER THAN EDIBI..FS, FROM
VEHICLES AND TO PROHIBIT THE SALE, OF
MERCHANDISE AND EDIBLES FROM VACANT LOTS
THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES ORDAIN AS
FOLLOWS:
Section 1. The City Council hereby finds, determines and declares:
A. The City Council, on February 10, 1987, enacted
Ordinance No. 594 to prohibit the use of "pushcarts" for the
vending of merchandise or edibles within the City; and
B. The City's Zoning regulations prohibit the outdoor display
of merchandise for sale; and
C. Itinerant vendors have set up displays on properties which
. have no facilities, parking, etc. to accommodate customers;
and
D. The City Council has received complaints from the
business community about the presence of those vendors who
are often not reporting taxable sales and therefore avoiding
their fair share of tax support for the community.
Section 2. Sections 6209 and 62l0 of the Rosemead Municipal Code, which
established license fees for Itinerant Vendors, are hereby repealed.
Section 3. New Section 6212.5 of the Rosemead Municipal Code is hereby
adopted to read as follows:
• 6212.5 Itinerant Vendors -
A. No person shall display goods, offered for sale, from any
vehicle.
B. No person, other than an appropriately licensed caterer

or ice cream trek operator, shall display or offer for sale or
sell foodstuffs from a motor vehicle or other vehicle, subject
to registration with the Department of Motor Vehicles.
C. No person, except as specifically authorized by Rosemead
Municipal Code Sections 6211 (c) or 9121.25, shall display, or
offer for sale, goods in violation of Rosemead Municipal
Code Sections 9109.5, 91.12.5, 9114.8 or 9111.5, which require
that all display of merchandise, with certain listed exceptions,
for sale be wholly within an enclosed building.
Section 4. Violation of this Ordinance shall be a misdemeanor and shall be
punishable by a fine not to exceed One Thousand Dollars ($1,000.00) and or not to
exceed six (6) months' imprisonment in the Los Angeles County Jail.
Section 5. The City Clerk shall certify to the adoption of this ordinance.
