AN URGENCY ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF ROSEMEAD ORDERING
WATER CONSERVATION AND EMERGENCY
MANAGEMENT MEASURES
THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES HEREBY ORDAIN AS
FOLLOWS:
Section 1. The City Council of the City of Rosemead finds:
A. That Southern California is a relatively arid region with a
large population; and,
B. That Southern California is experiencing its fifth
consecutive year of below normal rainfall; and,
C. That water shortages'may occur because of below normal
rainfall and inadequate supplies; and,
D. That water shortages may also occur because of a disaster
such as an earthquake; and,
E. That the public depends upon water for its general welfare,
health and safety; and,
• F. That water conservation and emergency management measures
are necessary to protect the welfare of the people of
Rosemead during times of water shortage.
Section 2. The Rosemead Municipal Code is hereby amended by
adding a new Chapter VI to Title 5 - Water Conservation - to read as
follows:
CHAPTER VI - WATER CONSERVATION
5600. Water Conservation. The City Council of the City of
Rosemead hereby finds and declares that a water shortage exists
in Southern California which could have severe consequences
within the City of Rosemead and that the regulations set forth
herein are necessary and proper to protect the water supply for
human consumption, sanitation, and fire protection during the
term of this emergency water shortage.
• 5601. General Provisions.
A. This ordinance shall apply to all water users in the
City of Rosemead including individuals and residential,
commercial, industrial, agricultural, governmental and
other water users
B. No water user shall waste water from any source nor
shall any person sanction such waste.

5602. Phase I Water Shortage (voluntary conservation
A. A Phase I Shortage shall be declared when the City is
advised by the City's water purveyors in writing that a
shortage of up to ten percent (10%) will occur in water
supplies delivered to them.
B. All elements of Phase II shall apply in Phase I on a
voluntary basis only.
5603. Phase II Shortage (mandatory conservation).
A. A Phase II Shortage shall be declared when the City is
advised by the City's water purveyors in writing that a
ten to twenty percent (10%-20%) shortage in water
supplies delivered to them will occur.
B. The following restrictions on the use of water by water
users shall be in effect during a Phase II Shortage:
1. There shall be no hose washing of sidewalks,
walkways, buildings, walls, patios, driveways, parking
areas or other paved surfaces, except to eliminate
conditions dangerous to public health or safety or when
required as surface preparation for the application of
architectural coating or painting;
• 2. Washing of motor vehicles, trailers, boats and other
types of equipment shall be done only with a hand-held
bucket or a hose equipped with a positive shutoff
nozzle for quick rinses, except that washing may be
done with reclaimed wastewater, or by a commercial car
wash using recycled water;
3. No water shall be used to clean, fill or maintain
levels in decorative fountains, ponds, lakes or other
similar aesthetic structures unless such water is part
of a recycling system;
4. No water shall be used to refill a swimming pool,
spa, or hot tub emptied after the commencement of Phase
II;
• 5. All,water users shall repair all leaks from indoor
and outdoor plumbing fixtures within forty-eight (48)
hours of discovery;
6. No restaurant, hotel, cafe, cafeteria or other
public place where food is sold, served or offered for
sale, shall serve drinking water to any customer unless
expressly requested and shall display a notice to that
effect;

7. The owner and manager of every hotel, motel, inn,
guest house, bed and breakfast facility and short term
commercial lodging shall post a notice of water
shortage and any necessary compliance measures;
8. No water users shall cause or allow the water to run
off landscape areas into adjoining streets, sidewalks
or other paved areas due to incorrectly directed or
maintained sprinklers or excessive watering;
9. All lawns, landscape or other turf area shall be
watered not more often than every other day and with
watering only during the hours between 5:00 p.m. and
10:00 a.m., with even numbered addresses watering on
even numbered days of the month and odd numbered
addresses watering on odd numbered days of the month.
This provision shall apply to residential, commercial,
industrial and public agencies but shall not apply to
commercial nurseries, golf courses and other
water-dependent industries.
5604. Phase III Shortage (mandatory conservation).
A. A Phase III shortage shall be declared when the City is
advised by the City's water purveyors in writing that a
shortage of over twenty percent (20%) in water
• delivered to them will occur.
B. All of the restrictions of Phase II shall apply except
that:
1. The restrictions on watering lawns, landscape or
other turf areas shall be modified to prohibit watering
more often than every fourth day in a schedule to be
set by the City Manager, with even numbered addresses
watering on even numbered days and odd numbered
addresses watering on odd numbered days, with watering
only during the hours between 6:00 p.m. and 8:00 a.m.;
2. Commercial nurseries, golf courses and other water
dependent industries shall be prohibited from watering
lawn, landscape and other turf areas more often than
every third day on a schedule to be determined by the
City Manager, and shall water only during the hours
• between 6:00 p.m. and 6:00 a.m.;
3. Water used on a one time basis for purposes such as
construction and dust control, shall be limited to that
quantity identified in a plan submitted by the user
which describes water use requirements. The plan shall
be submitted to the City Planning Department for
approval. Water sources other than potable water shall
be utilized where available;

4. The use of water from fire hydrants shall be limited
to fire fighting and related activities and other uses
of water for municipal purposes shall be limited to
activities necessary to maintain the public health,
safety, and welfare.
5605. Exceptions.
A. The restricted uses of water provided for by this
ordinance are not applicable to that use of water
necessary for public health and safety, for essential
health care services or governmental services such as
police, fire and other similar public emergency
services.
B. The use of reclaimed or recycled water shall be exempt
from this Ordinance.
5606. Penalty for Violation. Any person or water user violating
any of the provisions of this chapter shall be issued a written
warning for the first violation. Upon the second or subsequent
violations, the person or water user shall be guilty of an
infraction for each violation, and, upon conviction thereof,
shall be punished as provided in Penal Code.
5607. Severability. If any section, subsection, clause or phrase
• in this ordinance or the application thereof to any person or
circumstances is for any reason held invalid, the validity of the
remainder of the Ordinance or the application of such provision
to other persons or circumstances shall not be affected thereby.
Section 3. The City Council finds and determines that there is
an urgent necessity to take legislative action through the exercise
of the police powers to protect the public peace, health and safety
of this City. This Urgency Ordinance shall therefore be effective
upon its adoption.
Section 4. The City Clerk shall certify to the adoption of this
ordinance and shall cause a copy hereof to be processed as required
by law.
