Ordinance No. 715 - 2714 Stingle AvenueORDINANCE NO. 715 • AS FOLLOWS: declares: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD APPROVING A CHANGE OF ZONE FROM R-1 TO M-1 FOR PROPERTY LOCATED AT 2714 STINGLE AVENUE (ZONE CHANGE 92-189) THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES ORDAIN Section 1. The City Council finds, determines and (a) An application for a change of zone from R-1 to M-1 was duly filed by Nola Pearson for property located at 2714 Stingle Avenue and more particularly described on Exhibit "A" attached hereto and incorporated herein by this reference; and (b) A public hearing was duly held before the Planning Commission on November 2, 1992, at which time the Commission recommended approval of said request; and (c) That on December 8, 1992, the City Council conducted a duly noticed hearing on said zone change request. Section 2. The City Council further finds: (a) That the change in zone from R-1 to M-1 is consistent with the goals, objectives and land use designation of the subject area as contained in the City's General Plan; and (b) That a Negative Declaration was prepared in accordance with State law and local regulation. The Negative Declaration was approved by the Planning commission and is hereby affirmed Section 3. The City Council hereby approves Zone Change 92-189 from R-1 to M-1 for property located at 2714 Stingle Avenue and more particularly described in Exhibit "A" attached hereto, pursuant to observance of the conditions of approval as set forth in Exhibit "B", also attached. 0 Section 4. The Zoning Map of the City of Rosemead is hereby amended to reflect the approved change of zone on the effective date of this ordinance. Section 5. The City Clerk shall certify to the adoption of this ordinance and cause the same to be processed according to State law. Page 2 EXHIBIT "A" ZONE CHANGE CASE 2714 STNGLE AVENUE NOLA PEARSON LEGAL DESCRIPTION That portion of Lot 5 of Tract No. 830, in the City of Rosemead, County of Los Angeles, State of California, in Map Book 16, Page 117 in the office of the Recorder of said County, more particularly described as follows: Beginning at a point 422.5 feet S.0°071E. of the northwesterly corner of said portion of Lot 5, then 5.89°.58'E. a distance of 229 feet, thence S.0°07'E. a distance of 57.5 feet, thence N89°58'E. a distance of 229 feet, thence N.0°07'W. a distance of 57.5 feet to the point of beginning. • 1 -Ord. No. 715 EXHIBIT "B" Page 3 ZONE CHANGE 92-189 2714 STINGLE AVENUE CONDITIONS OF APPROVAL NOVEMBER 2, 1992 1. The following conditions must be complied with to the satisfaction of the Director of Planning, prior to final approval of associated maps, building permits, occupancy permits, or any other appropriate request. 2. The applicant shall sign a notarized affidavit agreeing to these conditions within ten days of approval. 3. The conditions listed on this Exhibit shall be copied directly onto development plans submitted to the Planning and Building Departments for review. 4. The property shall comply with all appropriate Building, Fire, and Health Department regulations. • 5. Adequate lighting shall be provided in the parking area. Motion-activated lights shall be installed where deemed appropriate by the Director of Planning. All exterior lighting shall be directed away from adjacent properties. • 6. the property shall be kept cleared of weeds, debris and abandoned vehicles, and maintained pursuant to the County Fire and Health codes until it is developed. All trash shall be contained in dumpsters and removed on an as-needed basis. No trash shall be visible from outside the dumpster. Surplus construction materials shall be stored so as to be screened from public view when not actually in use. 7. Construction activities shall be limited to take place between the hours of 7:00 a.m. and 8:00 p.m. Monday through Saturday. No construction shall take place on Sundays or on any legal holidays. 8. A 61-high fence, composed of chain link or other approved material, shall totally enclose the perimeter of the property when vacant, under construction, or under demolition, and said fence shall remain until Occupancy is granted. 9. The numbers of the address signs shall be at least 6" tall with a minimum character width of 1/411, contrasting in color and easily visible at driver's level from the street. The location, color and size of such sign shall be subject to the approval of the Planning Director. 10. The existing structures shall be boarded once vacated and demolished within one year if the effective approval date of this zone change. 11. The perimeter property lines of the newly created lots, or where designated by the Director of Planning, shall be fenced with a six-foot (61) high masonry wall, with finished surface on both sides, or wooden fence, supported by steel posts in concrete. 12. All utilities shall be underground including appropriate wiring for cable television. The underground conversion of these utilities shall consider all future connections to the satisfaction of the Director of Planning. 13. A minimum of two trees shall be provided at the site. The size and location of new trees shall be at the discretion of the Planning Department.
