A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD,
CALIFORNIA, CASTING ITS VOTE(S) FOR COUNCILMEMBER MARGARET
CLARK TO REPRESENT CITIES WITHOUT PRESCRIPTIVE PUMPING
RIGHTS ON THE BOARD OF THE SAN GABRIEL BASIN WATER QUALITY
AUTHORITY
WHEREAS, on September 22, 1992, Senate Bill 1679 was signed into law by Governor
Pete Wilson authorizing the creation of the San Gabriel Basin Water Quality Authority; and
WHEREAS, the Board of the San Gabriel Basin Water Quality Authority is composed of
five members with three appointed members from each of the three municipal water districts, one
elected city council person from cities in the San Gabriel Basin with prescriptive pumping rights,
and one elected city council person from cities in the San Gabriel Basin without prescriptive
pumping rights; and
WHEREAS, the City of Rosemead is one of the cities in the San Gabriel Basin without
prescriptive pumping rights; and
WHEREAS, the City of Rosemead may cast its vote(s) for a representative by resolution
no later than December 15, 1998 at 5:00 p.m.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF ROSEMEAD,
CALIFORNIA DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1. The City Council of the City of Rosemead casts its full vote(s) for
Councilmember Margaret Clark as the representative for cities in the San Gabriel Basin without
prescriptive pumping rights.

WATER PUMPING RIGHTS
Dear City Manager:
The nomination period for the election of the WQA board member representing cities without
water pumping rights was closed on October 17, 1998 at 5:00 p.m. Enclosed is an election ballot,
a sample resolution, a list of nominees, a list of cities without pumping rights and the number of
votes each is entitled. The resolution must be received at the above address by December 15,
1998 at 5:00 p.m. via certified mail or hand delivery only Our office hours are Monday
through Thursday 8:00 a.m. to 12:00 noon and 1:00 p.m. to 5:00 p.m., closed on Fridays. Votes
will be officially counted during the Water Quality Authority's adjourned meeting on December
16, 1998 at 5:00 p.m.
Each city has one vote for each 10,000 residents or majority thereof, as determined by the 1990
U.S. census data. The enclosed ballot indicates the number of votes your city may cast. Please be
aware that a city is not limited to voting for its own city council members and that a city may vote
in an election whether or not it nominated a candidate.

The following candidates have been duly nominated by qualified cities for the office of city
member and alternate of the Board of the San Gabriel Basin Water Quality Authority ( "the
Authority ") from cities without pumping rights.
The election of the city member and alternate will take place at an adjourned meeting of
the Board of the Authority set for December 16, 1998, at 5:00 p.m., at 861 Village Oaks Drive,
Suite 105, Covina, California.
Your city may cast its votes for one candidate by resolution of the city council. The
number of votes to which your city is entitled, based upon population, is set forth above. all your
cities' votes must be cast for only one candidate.
The resolution of the city council casting its votes must be delivered by certified mail or
hand delivered to the Authority at least 24 hours before the meeting of the Board of the Authority
at which the election of the city member and alternate will take place, or the votes will not be
counted.
This Ballot may accompany the resolution of the city council casting its votes for city
member and alternate from cities without pumping rights.

Mr. Wagner responded that negotiations are still on -going with L.A. County for the final
SAFER agreement. However, in the interim, the County has requested that instead of including
the 6% with the law enforcement payment, that a separate payment be made to the liability trust
fund. Mr. Wagner stated that there is a separate line item in the law enforcement budget for this
payment.
Councilman Taylor asked about the $1 million assessment levied against Rosemead due to
the Telamavayo lawsuit which originated in Cerritos.
Mr. Wagner responded that negotiations between L.A- County and the Sheriffs
Department continue in an effort to reduce the liability to the cities. Mr. Wagner continued that
the County has agreed to pay $5 million out of that total settlement; however, it will be taken out
of the funds on deposit from the liability trust fund.
Councilman Taylor asked about the Hershey lawsuit.
Mr. Wagner stated that the Hershey lawsuit is for $3 1/2 million and the Telamavayo suit
is for $25 million.
Councilman Taylor stated that Rosemead is picking up the liabilities for other cities before
we have a Joint Powers agreement.
Mr. Wagner stated that these pre- existing claims have to be settled before an agreement
can be reached.
Councilman Taylor stated that the County is seeking ways to make cities pay and that
cities have no control over those lawsuits. Mr. Taylor continued that the County has their own
liability insurance and the cities have theirs; but, now, the County is assessing other cities because
they don't want to pay the $25 million. Mr. Taylor asked since that incident occurred in another
city, why is Rosemead being assessed $1 million?
Mr. Wagner stated that the old claims need to be cleaned -up and that Contract Cities has
directed a negotiating team to discuss this with David Janssen in an effort to reduce the $25
million.
Councilman Imperial requested information on Check No. 25206 to New Century Ford in
the amount of $2764.55 for vehicle repairs to Units I I and 07.
There being no further comments, the Mayor called for the vote.

Councilman Taylor stated for the record that he voted No against Check No. 25129
