Ordinance No. 736 - 2417-2455 Angelus AvenueORDINANCE NO. 736 FOLLOWS: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD APPROVING A DEVELOPMENT AGREEMENT FOR PROPERTY LOCATED AT 2417-2455 ANGELUS AVENUE, ROSEMEAD (DEVELOPMENT AGREEMENT 93-1) THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES ORDAIN AS Section 1. The City Council finds, determines and declares: (a) An application for a development agreement and general plan amendment was duly filed by the Rosemead Housing Development Corporation (RHDC) regarding the property, and more particularly described on Exhibit "A" attached hereto and incorporated herein by this reference; and (b) A public hearing was duly held before the Planning Commission on May 17, 1993, at which time the commission recommended approval of said request; and (c) That on August 24, 1993, the City Council conducted a duly noticed public hearing on said request. Section 2. The City Council further finds: (a) A municipal election was held pursuant to Article XXXIV of the California State Constitution on November 5, 1991, in which Rosemead citizens voted, in part, to authorize construction of 50 units of senior citizen housing for qualified low-income residents upon the site, located at 2417-2455 Angelus Avenue; and (b) That Development Agreement 93-1, pursuant to Sections 65864-65869.5 et. seq. of the Government Code hereby supersedes the development standards as contained within the Rosemead Zoning ordinance, yet is consistent with the land use of the subject area as contained in the City's general plan and is also consistent with the specific approval action referred to in Section la above; and (c) That a Negative Declaration was prepared in accordance with State law. and local regulation. The Negative Declaration was approved by the Planning Commission. • Section 3. The City Council hereby approves Development Agreement 93-1, attached as Exhibit "B", for the property heretofore described, and the provisions of said Development Agreement shall prevail over any conflicting provisions of the Zoning Code. Ord. 7 3 6 page 2 Section 4. The City Clerk shall certify to the adoption of this ordinance and cause the same to be processed according to State law. Ord. 7 3 6 Page 3 EXHIBIT "A" LEGAL DESCRIPTION DEVELOPMENT AGREEMENT 93-1 The easterly 140 feet of the southerly 50 feet of that portion of Lot 5 of Richard Garvey's Addition No. 2 to the Garvey Ranch Tract in the City of Rosemead, County of Los Angeles, State of California as recorded in Book 70 of Maps, Pages 69-71 inclusive, and that portion of Lot 11 in Tract 4610, in the City of Rosemead, County of Los Angeles, State of California, as recorded in Book 93 of Maps, Pages 12 and 13, located easterly of the Los Angeles County Flood Control District easement known as the Alhambra Wash, F.M. 18499-6, E. 17-187, O.R. 16487-11.
