AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ROSEMEAD, CALIFORNIA CHANGING CITY ELECTIONS
FROM APRIL OF EVEN-NUMBERED YEARS TO MARCH OF
ODD-NUMBERED YEARS PURSUANT TO ELECTIONS
CODE SECTION 2601
THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA DOES
HEREBY ORDAIN AS FOLLOWS:
Section 1. The City Council finds, determines and declares as follows:
A. The legislature has changed the date of California's Presidential
primary election from June of even numbered years, divisible by
four, to the fourth Tuesday in March of even numbered years,
divisible by four.
• B. The City of Rosemead's General Municipal Election is
presently set for the second Tuesday in April, 1996, which is just
two weeks after the Presidential Primary.
C. The County Registrar-Recorder's Office has notified the City
that it will be unable to provide the usual level of assistance for
Municipal Elections that occur within such a short period of time
after the Presidential Primary.
D. The City Clerk has advised the Council that the assistance of
the County Registrar-Recorder's Office is essential and the most
cost-efficient method of providing election assistance. If the
County Registrar-Recorder's Office is not available for such duties,
the City would have to contra) t with outside suppliers at an
• additional cost.
E. The City Council finds that having two important, but different
elections, just two weeks apart, would tend to confuse the voters as
to the issues and candidates to be voted upon at each such election.
F. Postponement of the scheduled April, 1996 election to March,
1997 will result in a one-time cost savings to the City of Rosemead
of $ 27,000.00 in the 1995-96 fiscal year.
Section 2. Pursuant to Section 2601 of the California Elections Code and as authorized
thereby, the City general elections shall, commencing on March 4, 1997 and henceforth, be held
on the first Tuesday following the first Monday in March of odd-numbered years.
Section 3. All ordinances inconsistent with the provisions set forth in Section 2 herein
are hereby repealed.
Section 4. The City Clerk shall certify to the adoption of this Ordinance and provide the
Notice required by Section 2601 of the Elections Code.
Section 5. If any section, subsection, subdivision sentence, clause phrase, or portion of
this ordinance, or the application thereof to any person or place, is for any reason held to be
invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision
shall not affect the validity of the remainder of this ordinance. The City Council hereby declares
that it would have adopted this ordinance, and each section, subsection, subdivision, sentence,
clause, phrase, or portion thereof irrespective of the fact that any one or more sections,
subsections, subdivisions, sentences, clauses, phrases or portions thereof be declared invalid or
unconstitutional.
