ORDINANCE NO. 540
AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF ROSEMEAD ADOPTING
BY REFERENCE, PURSUANT TO GOVERNMENT
CODE SECTION 50022.2, LOS ANGELES
COUNTY ORDINANCE NO. 2269, ENTITLED
"PLUMBING CODE", LOS ANGELES COUNTY
ORDINANCE NO. 2225, ENTITLED "BUILDING
CODE" AND LOS ANGELES COUNTY ORDINANCE
NO. 9544, ENTITLED "MECHINACAL CODE"
1981 EDITIONS, AND AMENDING THE ROSEMEAD
MUNICIPAL CODE IN ACCORDANCE THEREWITH
THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES ORDAIN
AS FOLLOWS:
Section 1. The provisions set forth hereinafter
are to be enacted by reference pursuant to Government Code
§50022.2 and this ordinance shall be duly introduced on
November 10,1981; notice of a public hearing shall be duly
made pursuant to Government Code §6066 and a public hearing
shall be conducted on November 24, 1981, in the City Council
Chambers of the Rosemead City Hall at 8838 East Valley
Boulevard in Rosemead, California at the hour of 8:00 P.M.
Section 2. Section 8100 of the Rosemead
Municipal Code is amended to read as follows:
"8100. Adoption of Building Code. There is
adopted by reference, except as provided in this
chapter, that certain building code known and designated
as the Los Angeles County Building Code, as contained in
the 1981 Edition of the Los Angeles County Building
Laws, published by Building News, Inc., being Ordinance
No. 2225 as amended through Ordinance No. 12340. Such
• code shall be the building code of the city, regulating
the erection, construction, enlargement, alteration,
repair, moving, removal, demolition, conversion,
occupancy, use, height, area, maintenance of all
structures and certain equipment therein specifically
regulated, and grading within the city, and providing
for the issuance of permits and the collection of fees
therefor, providing penalties for violation of the code,
and declaring and establishing fire zones."
Section 3. Section 8101 of the Rosemead Municipal
Code is amended to read as follows:

"8101. Amendment to Building Code (Definitions).
Notwithstanding the provisions o Section 1 0, the
Building Code is amended by amending Section 207 thereof
to read:
Sec. 207. Definitions. Whenever any of the names
or terms defined in this Section are used in this Code,
each such name or term shall be deemed and construed to
have the meaning ascribed to it in this Section.
"Board of Appeals" shall mean the Board of Appeals
established by Section 206 hereof.
"Building Department" shall mean the City of
Rosemead Building Department.
"City" shall mean the City of Rosemead except in
Section 103 of said Building Code.
"County", "County of Los Angeles", or "Unincorpo-
rated Territory of the County of Los Angeles" shall mean
the City of Rosemead.
"County Engineer" shall mean City Engineer of the
City of Rosemead.
"Electrical Code" shall mean the Electrical Code
as adopted by Section 8200 of the Rosemead Municipal
Code as amended.
"Fire Code" shall mean the Fire Code as adopted by
Section 3100 of the Rosemead Municipal Code as amended.
"Fire Zone" shall mean the fire zone adopted by an
ordinance creating and establishing fire zones or where
no such fire zones have been adopted by the City shall
be considered to be in Fire Zone No. 3.
"General Fund" shall mean the City Treasury of the
City of Rosemead.
"Health Code" or "Los Angeles County Health Code"
shall mean the Health Code as adopted by Section 5100 of
the Rosemead Municipal Code as amended.
"Health Officer" shall mean the Health Officer of
the City of Rosemead.
"Mechanical Code" shall mean the Mechanical Code a
adopted by Section 8400 of the Rosemead Municipal Code
as amended.
"Plumbing Code" shall mean the Plumbing Code as
adopted by Section 8300 of the Rosemead Municipal Code
as amended.

"Special Inspector" shall mean a person holding a
valid Certificate of Registration issued by the County
of Los Angeles as set forth in Section 305 (b) of this
Code."
Section 4. Section 8105 of the Rosemead Municipal
Code is hereby repealed.
Section 5. Chapter 3 of Article VIII of the
Rosemead Municipal Code is amended to read:
"CHAPTER 3 - PLUMBING CODE

"8300. Adoption of Plumbing Code. There is
adopted by reference, except as provided in this chap-
ter, that certain plumbing code known and designated as
the Los Angeles County Plumbing Code, as contained in
the 1981 Edition of the Los Angeles County Building Laws
published by Building News, Inc., including Appendices
A, B, C, G and I of said Los Angeles County Plumbing
Code, being Ordinance No. 2269 as amended through Ordi-
nance No. 11576. Such code shall be the plumbing code
of the city, regulating plumbing and drainage systems,
house sewers, and private sewage disposal systems, and
prescribing conditions under which such work may be
carried on within the city, and providing for the is-
suance of permits and the collection of fees therefor."
Section 6. Section 8301 of the Rosemead Municipal
Code is amended to read as follows:
"8301. Definitions. Whenever any of the following
names or terms are used in said Los Angeles County
Plumbing Code, each such name or term shall be deemed
and construed to have the meaning ascribed to it in this
section as follows:
"Administrative Authority", "Chief Plumbing
Inspector", or "Plumbing Inspector" shall mean the
Building Official of the City of Rosemead.
"Board of Examiners of Plumbers", "Gas Fitters and
Sewerage Contractors", or "Board of Examiners" shall
mean the Board of Examiners of Plumbers, Gas Fitters and
Sewerage Contractors, of the County of Los Angeles
established by Section 73 of the said Los Angeles County
Plumbing Code.
"City" shall mean the City of Rosemead except in
Section 3 of said Los Angeles County Plumbing Code.
"County", "County of Los Angeles" or "unincorpo-
rated territory of the County of Los Angeles" shall mean
the City of Rosemead.

"Gas Fitting Contractor", "Journeyman Gas Fitter",
"Journeyman Plumber" or "Plumbing Contractor" shall mean
a person holding a valid Certificate of Registration
issued by the County of Los Angeles as set forth in
Section 72 of said Los Angeles County Plumbing Code."
Section 7. Chapter 4 of Article VIII of the
Rosemead Municipal Code is amended to read:
"8400. Adoption of Mechanical Code. The Los
Angeles County Mechanical Code, being Ordinance No. 9544
of the County of Los Angeles as amended to and in effect
on November 1, 1977, as contained in the 1981 edition of
the Los Angeles County Building Laws published by the
Building News, Inc., and including the appendix to said
Los Angeles County Mechanical Code, except as herein
provided, is hereby adopted by reference as the
Mechanical Code of the City of Rosemead, as amended by
Sections 8401, et seq., of this Chapter. Said Code may
be referred to as the 'Mechanical Code'."
Section 8. Section 8401 of the Rosemead Municipal
Code is amended to read as follows:
"8401. Definitions. Whenever any of the following
names or terms are used in said Los Angeles Mechanical
• Code, each such name or term shall be deemed and
construed to have the meaning ascribed to it in this
section as follows:
"Board of Appeals", or "Board of Examiners of
Plumbers" shall mean the Board of Examiners of Plumbers,
Gas Fitters and Sewerage Contractors of the County of
Los Angeles established by Section 73 of the Los Angeles
County Plumbing Code as published in said Los Angeles
County Building Laws.
"Building Department" shall mean the Rosemead
Building Department.
"Building Code", "Uniform Building Code", or "Los
Angeles County Building Code" shall mean the Building
• Code of the City of Rosemead as amended.
"Building Official" shall mean Building Official
of the City of Rosemead.
"City" shall mean the City of Rosemead.
"Electrical Code" shall mean the Electrical Code
as adopted by Section 8200 of the Rosemead Municipal
Code as amended.

"Fire Code" or "Los Angeles County Fire Code"
shall mean the Fire Code as adopted by Section 3100 of
the Rosemead Municipal Code as amended.
"General Fund" shall mean the City Treasury of the
City of Rosemead.
"Health Code" or "Los Angeles County Health Code"
shall mean the Health Code as adopted by Section 5100 of
the Rosemead Municipal Code as amended.
"Mechanical Code" shall mean the Mechanical Code
of the City of Rosemead.
"Plumbing Code" shall mean the Plumbing Code as
adopted by Section 8300 of the Rosemead Municipal Code
as amended."
Section 9. Violations and Penalty. No person
shall violate any of the provisions, or fail to comply with
any of the requirements, of Article VIII of the Rosemead
Municipal Code. Any person violating any of the
provisions or failing to comply with any of the requirements
of said Article, shall be guilty of a misdemeanor. Any
person convicted of a misdemeanor under the provisions of
said Article VIII, shall be punishable by a fine of not more
than five hundred dollars, or by imprisonment in the city or
county jail for a period not exceeding six months, or by both
such fine and imprisonment. Each such person shall be guilty
of a separate offense for each and every day during any
portion of which any violation of any provisions of these
Chapters is committed, continued, or permitted by such person
and shall be punishable accordingly.
Section 10. Three (3) copies of said Ordinances
2269, 2225 and 9544, of the County of Los Angeles as amended
have been deposited with the City Clerk of the City of
Rosemead, and shall be at all times maintained by said City
Clerk for use and examination by the public.
Section 11. The City Council finds and determines
that the local variances from the State Building Standards
Code and regulations adopted pursuant to Health and Safety
• Code §17922, contained in the City Building and Plumbing
Codes, are reasonably necessary because of local climatic and
geographical considerations. Particularly, Building Code
variances are contained in §3203(b) (prescribing fire
retardency treatment for wood shake and shingle roofing) and
Chapter 67 (prescribing security provisions regarding use of
dead bolts and sliding glass doors).
