ORDINANCE NO. 552
AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF ROSEMEAD ADOPTING
BY REFERENCE, PURSUANT TO
GOVERNMENT CODE 450022.29 TITLE
20, UTILITIES, DIVISION 2 OF THE
LOS ANGELES COUNTY CODE, AS AMENDED,
THROUGH ORDINANCE 81-0043 OF
DECEMBER 89 1981 AND AMENDING
THE ROSEMEAD MUNICIPAL CODE IN
ACCORDANCE THEREWITH
THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES ORDAIN AS
FOLLOWS:
Section 1. Section 8500 of the Rosemead Municipal Code
is amender to read as follows:
"Section 8500 Adoption of Los Angeles Countv Code
Title 20, UTILITIES DIVISION 2. There is hereby
adopted as a anitary e~ S wer and Industrial Waste
Ordinance of the City of Rosemead, except as it is
hereinafter amended, Title 20, Utilities, Division 2 of
the County of Los Angeles, as amended, and in full force
and effect on January 7, 1982, entitled "An Ordinance
providing regulations for sanitary sewers, and the
deposit of discharge of sewage and other waste matter in
the incorporated territory of the County of Los
Angeles.
Three copies of said Title 20, Utilities, Division
2, of the County of Los Angeles, as amended, have been
deposited with the City Clerk of the City of Rosemead
and shall be at all times maintained by said City Clerk
for use and examination by the public.'
Section 2. Section 8501 of the Rosemead Municipal Code
is hereby amended to read as follows:
"Section 8501 City to be included in unincorpo-
rated area of count Whenever in the said Title 20,
ti ides, Division 2, reference is made to the unin-
corporated area of the County of Los Angeles, such area
shall be deemed to include in its true geographical
location the area of the City of Rosemead."
Section 3. Section 8502 of the Rosemead Municipal Code
is hereby amended to read as follows:
Section 8502 Definitions. Whenever any of the
following names or terms are used in Title 20,

Utilities, Division 2, each such name or term shall be
deemed and construed to have the meaning ascribed to it
in this Section as follows:
A.
"Board"
means the
City
Council;
B.
"County
engineer"
means
the City engineer;
C. "County health officer" means the City
health officer;
D. "County of Los Angeles" means the City of
Rosemead except in such instances where the County
of Los Angeles is a correct notation due to
circumstances;
E. "County Sewer Maintenance District" shall
mean the County Sewer Maintenance District except
in the instance where the territory concerned
either is not within or has been withdrawn from a
County Sewer Maintenance District. In any such
instance "County Sewer Maintenance District" shall
mean the City of Rosemead;
F. "Ordinance" means an ordinance of the City
of Rosemead except in such instances where the
reference is to a stated ordinance of the County of
• Los Angeles;
G. "Public sewer" means all sanitary sewers
and appurtenances thereto, lying within streets or
easements dedicated to the City, which are under
the sole jurisdiction of the City;
H. "Trunk sewer" means a sewer under the
jurisdiction of a public entity other than the
City of Rosemead."
Section 4. Section 8503 of the.Rosemead Municipal Code
is her-e-Sy to read as follows:
"Section 8503 Amendments to Sanitary and
Industrial Waste Ordinance.
• A. Section 20.28.050 of said Title 20, Utilities,
Division 2 is amended to read as follows:
The City Engineer may recommend that the
Council approve an agreement to reimburse or agree
to reimburse a subdivider, school district, an
improvement district formed under special
assessment procedures, or person for the cost of
constructing sanitary sewers for public use where
such sewers can or will be used by areas outside of
the proposed development; and to establish a

reimbursement district and collection rates as
described in the agreement under the provisions of
this Ordinance.
B. Section 20.32.150 of said Title 20, Utilities,
Division 2, is amended to read as follows:
In the event the City Engineer determines that
the property described in the application for a
permit is included with a sewer reimbursement
district, which has been formed by the Council in
accordance with Section 20.28.050, the charge for
connecting to the public sewer shall be as set
forth in the agreement.
C. Section 20.32.290 of said Title 20, Utilities,
Divisison 2 is hereby repealed.
D. Section 20.32.280 of said Title 20, Utilities,
Division 2 is amended by adding the following paragraph:
All monies collected under this Section for
sewer maintenance are to be submitted directly to
the County Sewer Maintenance District for inclusion
in the Maintenance District's funds.
E. Section 20.32.690 of said Title 20, Utilities,
• Division 2 is amended by adding the following paragraph:
In the event the damaged public sewer is not
in a sewer maintenance district, the violator shall
reimburse the City within thirty (30) days after
the City Engineer shall render an invoice for the
same. The amount when paid shall be deposited in
the City Treasury.
Section 5. Violations and Penalty. No person shall
violate any of the provisions, or ail to comply with any of
the requirements, of Sections 8500 through 8503, of the
Rosemead Municipal Code. Any person violating any of the
provisions or failing to comply with any of the requirement
of said Sections, shall be guilty of a mis,'emeanor under the
provisions of said Sections, shall be punishable by a fine of
not more than five hundred dollars ($500.00), or by imprison-
ment in the city or county jail for a period not exc-:eding
six (6) months, or by both such fine and imprisonment. Each
such person shall be guilty of a separate offense for each
and every day during any portion of which any violation of
any provisions of said Sections are committed, continued, or
permitted by such person and shall be punishable accordingly.
Section 6. The City Clerk shall certify to the
adoptio~ n~Tis Ordinance.
