The subject property consists of an owner-occupied single family dwelling with unpermitted
additions and a possible garage conversion. The property is located in the R-2 zone. The case was
initiated in April, 2001 and no compliance has been achieved in over six months.
Case chronology as follows:
• April 24, 2001 - 45 day Code Violation Letter mailed to owner.
• April 26, 2001 - Owner's son at City Hall and spoke with both Planning and
Building Department staff. List of defects discussed and record search procedure
explained.
• May 9, 2001 - Building Inspector met with owner at property. Complete interior and
exterior access gained. Code violation case converted to property rehabilitation case.
Revised list of defects compiled and mailed to owner. No permit records found at
County. Owner informed inspector of his intentions to submit plans and attempt to
legalize the unpermitted work.
• June 12, 2001 - Follow-up inspection. No progress.
• June 26, 2001 - Property declared substandard byBuilding Official and a Declaration
of Substandard Property filed with Los Angeles County Recorder's office. 15 day
certified letter mailed and posted.

A Notice of Hearing was mailed and posted on the property on November 7, 2001. All interested
parties have been notified.
CITY BUILDING OFFICIAL'S RECOMMENDATION:
It is recommended that the Board find the property substandard and order all substandard
conditions be removed and/or corrected by January 2, 2002. However, if the required permits are
obtained, and sufficient progress is achieved by January 2, 2002, the abatement date maybe extended
to February 4, 2002.

The City Building Official has determined by inspection that the following property is substandard,
as defined in Section 9905 of the City of Rosemead Building Laws, because of the defects listed on
the attached letter.
THEREFORE, NOTICE IS HEREBY GIVEN that on Tuesdav. November 27. 2001. at 7:00 p.m.,
in the City Hall, 8838 E. Valley Boulevard, Rosemead, California, a HEARING WILL BE

A recent inspection of the property at the above address has found it to be substandard as defined by the City of
Rosemead Building Code, because of the defects enumerated in the attached list.
Section 9908 of the Code declares all such substandard buildings a public nuisance and requires the abatement
thereof by correction, if practical, or demolition of the substandard conditions.
As the owner of record, you are hereby notified to comply with the requirements of the above code, and to correct
or remove the substandard conditions listed. All such work shall be completed within fifteen (15) days after receipt
of this letter. Be advised if you are renting this properr to others the City may file a Notice of Non-Compliance
with the State Franchise Tax Board. Revenue and Taxation Code. Section 17274 states: "No deduction shall be
allowed for interest taxes depreciation or amortization with respect to substandard (rental) housing."
This notice will be posted on the property. If in your opinion, you disagree or cannot comply with the above
findings or order, you may request a public hearing. The request for hearing must be within fifteen (15) days after
posting of this notice on the property, must be in writing, and directed to the City of Rosemead Building Official,
8838 East Valley Boulevard, Rosemead, California 91770.

A recent inspection of the above referenced property, and a complete review of available files, have
revealed improvements constructed without necessary permits and required approvals. The
following items, enumerated on the attached list. have been found to be in violation of Section(s)
103 and 106 of the City of Rosemead Building Code.
If compliance with this notice is not achieved within forty five (45) days, the Building Official
will record with the Los Angeles county Recorder's Office a notice that the property and/or
any building or structure located thereon is in violation of Ordinance 764 and Chapter 15 of
the City of Rosemead Municipal code. This matter may also re referred to the City Attorney's
Office for prosecution.
Compliance'in correcting the violations must include, but is not limited to, obtaining all necessary
approvals and required permits, and complete correction of all violations as required by current code.
Violations shall be corrected to the satisfaction of the Building Official.
This notice will be posted on the property. The forty five (45) day period for achieving compliance
with this Code shall commence from the date the property is posted.
