RE: 3102 - 3104 SAN GABRIEL BOULEVARD - HEARING
The subject property consists of a single family dwelling and a store building. The property is
located in the C -3 zone. The residence is tenant - occupied and the store is vacant. This case was
initiated in May, 2001 and no compliance has been achieved in nearly a year.
Case chronology as follows:
• May 21, 2001 - Please letter mailed to property owner.
• June 21, 2001 - Inspection. No progress.
• July 24, 2001 - Inspection attempted. No access gained.
• July 25, 2001 - Property owner left message on building inspector's voice mail
stating that she had an appointment with the City's CDBG representative to apply
for a loan.
• August 8, 2001 - CDBG loan/rebate application considered for commercial portion
only. The property is not eligible due to the fact that a residential use also exists on
the lot.
• September 10, 2001 - Inspection attempted. No access gained. Building inspector
spoke to the tenant on the phone. The tenant claimed that the property owner had
made no attempt to correct the violations.

• October 9, 2001 - Property declared substandard by Building Official and a
Declaration of Substandard Property filed with Los Angeles County Recorder's
office. 30 day certified letter mailed and posted.
• November 6, 2001 - Inspection attempted. No access.
November 26, 2001 - Inspection. No progress.
December 3, 2001 - Inspector spoke to property owner on the phone. Inspector
reminded owner that permits were required for the repairs. List of defects discussed.
• January 10, 2002 - Inspection. No progress. Tenant expressed concerns regarding
garage. Garage access gained for the first time. Inspector noted several additional
defects and a revised list was mailed to the property owner.
• January 31, 2002 - Owner's mother contacted Council Member Imperial. She
claimed that the tenant was conducting a business from the residence and that most
of the defects had been corrected.
• February 11, 2002 - Joint inspection with Planning and Building Departments.
Planning Director, Building Official, building inspector, tenant, and the owner's
mother were present. All agreed that the property was in very poor condition. The
tenant agreed to clean up the rear yard.
• February 14, 2002 - Tenant cited by Code Enforcement twice for operating a
business from a residence.
• March 12, 2002 - Inspection. No progress.
• April 10, 2002 - Building Department staff contacted CDBG representative
regarding status of application. CDBG presently unable to proceed with the
loan/rebate application due to the non - conforming use status of the property. The
property is zoned C -3, however residential use is present.
A Notice of Hearing was mailed and posted on the property on April 11, 2002. All interested parties
have been notified.
CITY BUILDING OFFICIAL'S RECOMMENDATION:
It is recommended that the Board find the property substandard and order all substandard
conditions be removed and/or corrected by June 3, 2002. However, if the required permits are
obtained, and sufficient progress is achieved by June 3, 2002, the abatement date may be extended
to July 1, 2002.

as defined in Section 9905 of the City of Rosemead Building Laws, because of the defects listed on
the attached letter.
THEREFORE, NOTICE IS HEREBY GIVEN that on Tuesday April 23 2002 at 7:00 p.m., in the
CityHall, 8838 E. Valley Boulevard, Rosemead, California, a HEARING WI LL BE CONDUCTED
before the City of Rosemead Rehabilitation Appeals Board on this matter.

Dear Mz. Arguello:
In response to your list of defects to property on 3102 7 3104 San Gabriel Blvd.,
Rosemead. Attached is the list with repairs that were made last month. 1 apologize I must
have misunderstood you. I thought you were going to inspect the house on 3102 San
Gabriel Blvd., on Dec. 27.
It has taken this long to make repairs because we have had a difficult time in finding
the tenant at home. Finally we met and arranged dates she or someone would be
available.
Attached is the list and comments regarding repairs:
*5) Unit lacks working heating unit:
Since the gas had been turned off, it was impossible to inspect the unit. Tenant will call
us to make arrangements to check it when she arranges to have her gas reconnected.
-2) The required garage door is missing:
We purchased the property about 27 years ago, and there has never been a door back
there, it was always simply a two car stall. If indeed it was taken off or converted it was
done by the previous owners.
V) Hazardous electrical wiring:
There is no electrical wiring in that garage -stall area to my knowledge.
�4) Trash, junk and debris is being stored in garage.
Again, I am confused! There is a small room with a locked door which contains a large
wooden table and desk and chairs. By no means is it trash.
-5) Visible insect infection:
On December of 2001, the tenant informed us of roaches/rodents. I immediately called
the city of Rosemead, because there is a storm drain directly in front of our building and
also on the side. We had problems about 5 years previously, the city had the fire
department put some sort of poison in the drain area and our problem was solved. When I
called on Dec. 22, 2001, I was referred to the Vector Dept., in L.A, they in turn directed
me to the Alhambra Health Dept., they referred me to the Pest Control, they referred me
back to the city of Rosemead, they again referred me back to the Vector Dept. So I finally
realized I would not receive any help and on Dec. 27 I arranged for Great Western
Termite Company, in El Monte to rid the place of rodents and any other pests. The tenant
told the exterminator that there was absolutely no problem in the house. So he
concentrated on the shop area only. I also had the palm tree trimmed.
I have been informed that the tenant (who had her business, across the street) that there
are a lot of boxes and party equipment (part of her business equipment) in the yard,
according to her she plans to move them out soon.
*7) Window screen are missing in several locations: '
Again I must admit, I was not aware of the window screen missing. So they must have
been taken off for some reason. I will see that they are replaced.
As far as repairs in the shop, as you know the shop is unoccupied. As you may not
know I have made a application for city loan to make the repairs. As of yet I have heard
nothing.
Contrary to popular believe that if one owns property we can/will and must (according
to city officials) make repairs on a restricted time limit. Believe me, Mz. Arguello, we as
a family have worked two jobs if it were required to pay property taxes (which as
continuously increased) insurance and other emergencies that come along with owning
property, Unfortunately all the blame and responsibility falls on the owner, even when
the tenant is obviously as much to blame. I have evicted the tenant from the shop because
the insurance company threatened to cancel because of the fire hazard because of so
many boxes, etc., I -
Unfortunately if we do not qualify for a city loan for repairs, we will be forced to
consider selling, because meeting the demands by the city of Rosemead have gotten to be
financially impossible for us. We understand that there is a need for improvement, and
we are more than willing if it were financially possible. It is a catch -22 we can't rent the
place unless the repairs are made; and we can't make repairs unless the place is rented.
We are trying to make improvements and will because we understand that it is to our
benefit to do so.
