At that time, the Board ordered that the case be deferred and returned for Rehearing on July 26, 2005. The subject property consists of two legal units. The rear building, 3301, has unpermitted conversions and additions. The property is zoned R -2 with a lot size of 10,576 t square feet. The case was initiated in June 2004, and compliance has not been achieved in over a year. Case chronology is as follows: • June 8, 2004 - "Please" letter and Los Angeles County record search information mailed to property owner. • July 12, 2004 - Inspection: no progress. • July 20, 2004 - Property declared substandard by Building Official and a Declaration of Substandard Property filed with Los Angeles County Recorder's office. 15 -day certified letter mailed to the property owner and posted at the property. Another record search information sheet was included. • July 28, 2004 - Property owner's daughter at Building Department counter. She spoke to the Building Official who explained the list of defects and suggested she make an appointment with the building inspector to meet at the site. • August 10, 2004 - Building inspector met with the property owner and his daughter at the property. The inspector verified that the rear dwelling had been divided into three separate units. 'The owner expressed interest in constructing two additional two -car garages. He indicated he would submit plans to Planning Department. REHAB AGENDA JUL 2 6 2005 ITEM No. • September 7, 2004 - Inspection: no progress. • September 20, 2004 - Owner's daughter at Planning Department counter to inquire about site plan submittal instructions. • October 7, 2004 - Building inspector sent follow -up letter requesting compliance. • October 27, 2004 - Planning Department denied preliminary site plan. Planning Department staff also visited the site and sent letter to applicant addressing the Planning Department's concerns. • November 1, 2004 - Owner picked up plans from Planning Department. • December 9, 2004 - Owner hired building designer to prepare plans. The designer, Mr. Lam, informed the building inspector that he would submit plans within two weeks. • December 28, 2004• - Inspection: no progress. Plans had not been submitted as promised. • March 10, 2005 - Joint inspection with Planning and Building Department. No progress. • March 15, 2005 - Project denied. Planning Department sent a detailed letter of explanation to property owner explaining the violations and items to be corrected. • April 14, 2005 - Inspection: no progress. • May 14, 2005 - Inspection: no progress. • May 18, 2005 - Building inspector sent follow -up letter requesting compliance. • June 28, 2005 - Hearing before Building Rehabilitation Appeals Board. Case re- scheduled for July 26, 2005, in order for staff to arrange for a Cantonese interpreter. • June 30, 2005 - Owner obtained rehabilitation repair permits. • July 13, 2005 - Inspection: significant progress. Revised list of defects mailed to property owner: G A Notice of Hearing was mailed and posted on the property on July 13, 2005. All interested parties have been notified. CITY BUILDING OFFICIAL'S RECOMMENDATION: It is recommended that the Board find the property substandard and order all substandard conditions be removed and/or corrected by September 1, 2005. However, if sufficient progress is achieved by September 1, 2005, the abatement date may be extended to October 3, 2005. Please address the following items: 1. All additions without a permit must provide the minimum front, side, and rear yard setbacks. Planning and Building Department Staff were only able to find a permit for a single 2 -story residential unit at the rear of the property, with a total living area of 1,176 square feet. The permit showed that the structure was 28 feet wide by 21 feet deep. Plans of all proposed additions must be submitted to the Planning Department for review and approval. If the illegal additions do not meet these requirements, they must be removed. a. The rear house addition is built within the required 20 -foot rear yard and 5 -foot side yard setbacks, and must therefore be removed. b. The detached storage area does not have permits. In order to provide storage space, a minimum 2 -car garage must first be provided for each residential unit. If this requirement is not met, then the storage area must be removed. 2. The existing residential units are considered non - conforming because they do not provide the required garage parking spaces. Prior to obtaining approval for a new addition, the applicant must first provide the.required garage for each residential unit on the property. 3. The municipal code requires that a minimum of 50% of the front yard and 50% of the rear yard must be landscaped for each unit. The majority of the space between the two residential units is improved with concrete. Additional landscaping must be provided within this area. 4. Railing must be provided along the elevated walkway of the rear house. Page 1 of 1 5. The wood staircase placed on the northwest side of the property must be removed and replaced with a concrete stairway with hand rails. Property is unsightly due to lack of proper maintenance. 2. Overgrown vegetation throughout property 3. Exterior walls are damaged in several locations and require repair and paint. 4. Trash, junk, discarded furniture and house hold appliances are being stored throughout property. 5. Plumbinghas been installed at building exterior without the required approvals and permits. (Laundry area) 6. underfloor screens are missing/torn in several locations. 7. Roof is deteriorated in several locations and does not provide weather protection. 8. Garage has been converted to a living space without the required approvals and permits. 9. Addition to garage has been constructed without the required approvals and permit. 10. Patio cover at rear has been constructed without the required approvals and permits and is encroaching on required side property line setbacks.' 11. Sink drain piping is open, allowing effluent to discharging onto ground. 3301 (Rear Units) Substandard Conditions Dwelline has been altered and is being used as three separate living units without the required approvals and permits.
