Rehab Appeals Board - Item 2A - 2533-2535 Falling LeafTO: HONORABLE CHAIRPERSON AND MEMBERS BUILDING REHABILITATION APPEALS BOARD FROM: BILL CROWE, CITY MANAGER DATE: FEBRUARY 18, 2003 RE: 2533 - 2535 FALLING LEAF - HEARING The subject property consists of two single-family dwellings located in the R-2 zone. The front unit is owner-occupied. The rear unit is dilapidated and is being used as a storage building. The case was initiated in May, 2002, and compliance has not been achieved in over eight months. Case chronology is as follows: • May 13, 2002 - "Please" letter mailed to property owner. • June 17, 2002 - Inspection: no progress. • July 8, 2002 - Property declared substandard by Building Official and a Declaration of Substandard Property filed with Los Angeles County Recorder's office. 15-day certified letter mailed and posted. • September 10, 2002 - Inspection: no progress. • October 1, 2002 - Building Official at site. He spoke to property owner, Mr. Kababik, who agreed to obtain a "rehab" permit and show progress within 30 days. • October 7, 2002 - "Bulky item" trash notice mailed to property owner. • October 30, 2002 -Inspection: good progress on cleanup. 30-day extension granted. Mr. Kababik was given a permit application. REIVIAS AGENDA F cB 2 0 2003 ITEM No. 6 November 27, 2002 - Inspection: additional progress with removal of trash and debris. Mr. Kababik informed the inspector that he had not yet obtained a permit because he had not determined what he wanted to do with the rear unit. December 3, 2002 - Building Official at site: significant progress on yard area cleanup. Mr. Kababik had changed his mind about obtaining a permit because he had been advised that doing so would give the City permission to enter his property. (He had previously denied access beyond the driveway gate.) December 12, 2002 - Owner's son-in-law, Mr. Sabino Cici, came to City Hall to discuss list of defects with Building Official. January 9, 2003 - Building Official at site: no contact with owner. January 15, 2003 - Building Official spoke to Mr. Cici by telephone. He informed Mr. Cici that if Mr. Kababik would not allow on-site progress inspections, and obtain the required permit, a hearing would be scheduled before the Building Rehabilitation Appeals Board. To date, no permit has been obtained and no access has been gained onto the property or into the rear structure. A Notice of Hearing was mailed and posted on the property on February 13, 2003. All interested parties have been notified. CITY BUILDING OFFICIAL'S RECOMMENDATION: It is recommended that the Board find the property substandard and order all substandard conditions and building code violations be removed and/or corrected by April 1, 2003. However, if access is allowed, the required permit is obtained, and sufficient progress is achieved by April 1, 2003, the abatement date may be extended to May 1, 2003.
