RE: 3921 IVAR AVENUE - HEARING
The subject property consists of an owner-occupied single family residence, a garage with attached
workshop, and various storage buildings. The property is zoned R-1.
On January 27, 2000, a "Stop Work" notice was issued by the building inspector for construction
in progress without the required approvals and permits. Planning Department denied approval of the
proposed laundry room and patio cover and requested the unpermitted work be demolished,
including the removal of the plumbing and electrical components. Planning Department also
requested that the porch enclosure attached to the rear storage building be removed. Compliance was
not achieved and the case was eventually referred to the Building Department Property Rehabilitation
Section.
Case chronology is as follows:
• October 1, 2002 - "Please" letter mailed to property owner.
• November 4, 2002 - Inspection: no progress.
• November 19, 2002 - Property declared substandard by Building Official and a
Declaration of Substandard Propertyfiled with Los Angeles County Recorder's office.
15-day certified letter mailed and posted. '
• December 1, 2002 - Property owners at City Hall and informed staff that they
intended to construct a second unit at the rear of the property. They claimed that plans
would be submitted within two months.

February 5, 2003 - Inspection: no progress. No plans submitted to Planning
Department.
March 24, 2003 - Inspection: no progress.
March 27, 2003 - Site visit by Building Official. He spoke with property owner and
explained that items on the list of defects needed to be corrected in a timely manner
and could not be delayed until the possible construction of a second unit. He informed
owner that a hearing before the Property Rehabilitation Appeals Board would be
scheduled for April 22, 2003.
To date, no permits have been obtained to make repairs, and no plans have been submitted for a
second unit. All unpermitted work remains.
A Notice of Hearing was mailed and posted on the property on April 7, 2003. All interested parties
have been notified.
CITY BUILDING OFFICIAL'S RECOMMENDATION:
It is recommended that the Board find the property substandard and order all substandard conditions
and building code violations be removed and/or corrected by June 2, 2003. However, if the required
permits are obtained, and sufficient progress is achieved by June 2, 2003, the abatement date maybe
extended to July 1, 2003.

THEREFORE, NOTICE IS HEREBY GIVEN that on Tuesday April 22, 2003. at 7:00 p.m., in the
CiuvHall, 3833 E. Valley Boulevard, Rosemead, California, a HEARING WILL BE CONDUCTED
before the Citv of Rosemead Rehabilitation Appeals Board on this matter.

A recent inspection at the subject address found the property to be substandard as defined by Chapter 99 of the City
of Rosemead Building Code, due to the conditions enumerated in the attached list of defects.
Section 9908 of the Rosemead Building Code declares all such substandard buildings a public nuisance and requires
the abatement thereof by repair, rehabilitation, or demolition of the substandard conditions.
As the owner of record, you are hereby ordered to comply with the requirements of said code; by repair,
rehabilitation, or demolition of the substandard conditions listed, within fifteen (15) days after receipt of this notice.
Be advised that if you are renting this property to others `he City may file a "'Notice of Non-Compliance" with the
State Franchise Tax Board. Section 17274 of the Revenue and Taxation Code states: "No deduction shall be
allowed for interest taxes depreciation or amortization with respect to substandard (rental) housing."
This notice will be posted on the property. If you disagree with the findings, or cannot comply with the order within
the time specified, you.may request a public. hearing. Such request for hearing must made, in writing, within fifteen
(15) days after posting of this notice on the subject property. The request for hearing shall be directed to the City

electrical and plumbing components from the south side of the garage/shop structure as required by
the Planning Department review on September 25, 2000.
2. The eave overhangs on the north side of the garage/shop structure may not extend closer than three
(3) feet to the property line.
