The subject property consists of a vacant single family dwelling with a swimming pool. The
property is zoned R-1. The case was initiated in August, 2002, and compliance has not been achieved
in over eight months.
Case chronology is as follows:
• August 14, 2002 - "Please" letter mailed to property owner.
• August 15, 2002 - "Notice of Intent" to fence and barricade the property (due to
several broken windows and the unsecured pool) mailed to property owner.
• August 16, 2002 - Above notice posted at property.
• August 19, 2002 - Property owner, Annette Gilbert, at Building Department counter.
Building Official granted a 10-day extension to secure the pool and remove the weeds
and overgrown vegetation.
August 26, 2002 - Inspection: pool enclosure partially complete.
September 3, 2002 - Inspection: pool enclosure complete. No other progress.
• November 5, 2002 - Inspection: no progress. Building Official left notice for owner
to contact Building Department by November 14, 2002.

• November 26, 2002 - Property . declared substandard by Building Official and a
Declaration of Substandard Property filed with Los Angeles County Recorder's office.
15-day certified letter mailed and posted.
• December 16, 2002 - Inspection: no progress. Inspector noted stagnant water and
debris accumulating at bottom of pool. Revised list of defects, to include this
condition, compiled and mailed to property owner.
• January 8, 2003 Certified letter returned "unclaimed." Resent via first class mail.
• January 20, 2003 - Inspection: no progress.
• March 24, 2003 - Inspection: no progress.
• April 24, 2003 - Inspection: no progress.
• May 6, 2003 - Site visit by Building Official. Broken windows repaired and
overgrown vegetation removed.
• May 7, 2003 - Revised list of defects compiled to reflect above progress.
To date, no permit has been obtained and no contact has been made with the property owner.
A Notice of Hearing was mailed and posted on the property on May 12, 2003. All interested parties
have been notified.
CITY BUILDING OFFICIAL'S RECOMMENDATION:
It is recommended that the Board find the property substandard and order all substandard conditions
and building code violations be removed and/or corrected by July 1, 2003. However, if sufficient
progress is achieved by July 1, 2003, the abatement date may be extended to August 1, 2003.

A recent inspection at the subject address found the property to be substandard as defined by Chapter 99 of the City
of Rosemead Building Code, due to the conditions enumerated in the attached list of defects.
Section 9908 of the Rosemead Building Code declares all such substandard buildings a public nuisance and requires
the abatement thereof by repair, rehabilitation, or demolition of the substandard conditions.
As the owner of record, you are. hereby ordered to comply with the requirements of said code, by repair,
rehabilitation, or demolition of the substandard conditions listed, within fifteen (15) days after receipt of this notice.
Be advised that if you are renting this properiv to others the City may file a "Notice of Non-Compliance" with the
State Franchise Tax Board.. Section 17274 of the Revenue and Taxation Code states: "No deduction shall be
allowed for interest taxes detireciation or amortization with respect to substandard (rental) housing."
This notice will be posted on the property. If you disagree with the findings, or cannot comply with the order within
the time specified, A,ou may request a public hearing. Such request for hearing must made, in writing, within fifteen

NOTICE OF INTENT TO FENCE & BARRICADE

Dear Property Owners:
An inspection of the above mentioned property on August 14; 2002 found it to be open and
accessible in violation of the City of Rosemead Municipal Code. Section 9905 of the Building
Code declares all such buildings a public nuisance and requires the abatement thereof.
As the owner of record, you are hereby notified to comply with the requirements of the above
code; to securely barricade the building BY 7:00 A.M., AUGUST 20, 2002. Minimum barricade
requirements include 1/2 " plywood installed over all openings to the structure to substantially.
prevent unlawful entry. A six foot high temporary fence surrounding the property shall also be
installed in accordance with the City Municipal Code Section 9121.17(F). (Copy enclosed)
In the event that you fail to comply with the deadline stated above it is the City's intention to enter
on the property and securely barricade the structure(s) to prevent unlawful entry COMMENCING
ON AUGUST 21, 2002, to eliminate the threat to public safety.
The cost of the FHA style barricade performed by City contract includes fees of approximately
$75.00 per security door; and between 535.00 to $50.00 per opening. The property will also be
fenced at the rate of $5.00 per lineal foot, with a pair of gates costing about $98.00. The actual
cost of the work plus processing fees of $521.70, as specified in the Building Code; will be
charged to the owner of the property.
Unpaid costs may become a special assessment against the property, this may require additional
recording and filing fees.
