Rehab Appeals Board - Item 2A - 3921 Ivar Ave
TO: HONORABLE CHAIRMAN AND MEMBERS BUILDING REHABILITATION APPEALS BOARD FROM: BILL CROWE, CII MANAGER DATE: MAY 20, 2003 RE: 3921 IVAR AVENUE - REHEARING The subject property consists of an owner - occupied single family residence, a garage with attached workshop, and various storage buildings. The property is zoned R -1. This property was previously before the Board on April 22, 2003. At that time, the Board ordered the case deferred, and to be returned for Rehearing in May to ensure the property owners fully understood the nature of the issues. In response to the Building Rehabilitation Appeals Board's direction, staff met with the property owners and an interpreter on May 6, 2003. The owners agreed to removed the shed, patio cover, and the unpermitted plumbing and electrical work within 30 days. However, to date, no permits have been obtained to make repairs, and no plans have been submitted for a second unit. All unpermitted work remains. BACKGROUND: In January, 2000, a "Stop Work" notice was issued by the building inspector for construction in progress without the required approvals and permits. Planning Department denied approval of the proposed laundry room because it exceeded the allowable square footage for an accessory building. Staff requested the laundry room, unpermitted patio, and all related plumbing and electrical work be removed. Planning Department also requested that the unpermitted porch enclosure attached to the rear storage building be removed. Compliance was not achieved and the case was eventually referred to the Building Department Property Rehabilitation Section. Case chronology is as follows: October 1, 2002 - "Please" letter mailed to property owner. November 4, 2002 - Inspection: no progress. F REHAB AGENDA MAY 2 7 2003 ITEM No. _ZZ , • November 19, 2002 - Property declared substandard by Building Official and a Declaration of Substandard Property filed with Los Angeles County Recorder's office. 15 -day certified letter mailed and posted. • December 1, 2002 - Property owners at City Hall and informed staff that they intended to construct a second unit at the rear of the property. They claimed that plans would be submitted within two months. • February 5, 2003 - Inspection: no progress. No plans submitted to Planning Department. • March 24, 2003 - Inspection: no progress. • March 27, 2003 - Site visit by Building Official. He spoke with property owner and explained that items on the list of defects needed to be corrected in a timely manner and could not be delayed until the possible construction of a second unit. He informed owner that a hearing before the Property Rehabilitation Appeals Board would be scheduled for April 22, 2003. April 22, 2003 - Building Rehabilitation Appeals Board Hearing. Board ordered that the case be returned for Rehearing on May 27, 2003. May 6, 2003 - Meeting at the site with Building Official, building inspector, property owners, and interpreter. Owners agreed to remove the shed, patio cover, and unpermitted plumbing and electrical work within 30 days. A Notice of Hearing was mailed and posted on the property on May 12, 2003. All interested parties have been notified. CITY BUILDING OFFICIAL'S RECOMMENDATION: It is recommended that the Board find the property substandard and order all substandard conditions and building code violations be removed and/or corrected by July 1, 2003. PERDZITS ARE REQUHLED for repairs and may be obtained at the Building Department from 7:00 A.M. to 11:00 A.M., Monday through Thursday, and from 4:00 P.M. to 6:00 P.M., Thursdays.
