Rehab Appeals Board - Minutes 02-25-03MINUTES OF THE REGULAR MEETING ROSEMEAD BUILDING REHABILITATION APPEALS BOARD FEBRUARY 25, 2003 The regular meeting of the Rosemead Building Rehabilitation Appeals Board was called to order by Chairman Bruesch at 7:07 p.m. in the Conference Room of City Hall, 8838 E. Valley Boulevard, Rosemead, California. The Pledge to the Flag and Invocation were waived as having been completed during the meeting just adjourned. ROLL CALL OF OFFICERS: Present: Boardmembers Clark, Imperial, Vice-Chairman Vasquez, and Chairman Bruesch Absent: Taylor - excused APPROVAL OF MINUTES: None L ADMINISTRATION OF OATH The Board Secretary administered the oath to-all persons wishing to address the Board. H. HEARINGS A. 3444 LA FAYETTE The subject property consists of a single-family dwelling with unpermitted additions and alterations. There is an unpermitted building at the rear of the lot, also with additions and alterations, which is being used as a second unit. It appears the owner resides in the rear unit, while the front is tenant-occupied. The property is zoned R-2. This case was initiated in March, 2002, and compliance has not been achieved in nearly a year. Kiu Lam, 3444 Lafayette Street, Rosemead, owner of the property was present, and Joe, of 3524 Baldwin Avenue, #F, El Monte, who will translate for Ms. Lam. James Guerra, Building Official, stated that plans had been submitted by the owner's architect in September, 2002. Plans have not been returned after the architect picked up the corrected set. Joe explained that Ms. Lam just lost her job and was not aware that she needed to obtain permits to legalize the unpermitted additions. Chairman Bruesch explained that many of the items on the list are fire and safety hazards. REHABMIN:2.2"3 Page # I Joe explained that Ms. Lam is requesting that the Board grant an extension in order for her find a job. Ms. Lam is no longer working with the architect. Boardmember Clark requested that the Board work with Ms. Lam to begin work on the hazardous conditions first. Mayor Bruesch pointed out the owner can apply for assistance from the City if the property is not used as a rental and is owner-occupied. MOTION BY BOARDMEMBER IMPERIAL, SECOND-BY BOARDMEMBER CLARK that the Board find the property substandard and order all substandard conditions and building code violations be removed and/or corrected by April 1, 2003. However, if an interior inspection and progress in abating hazardous conditions is made by April 1, 2003, the abatement date may be extended to May 1, 2003. If plan check submittal proceeds, an additional extension to June 2, 2003, may be granted to allow time to make any necessary Building Department corrections and to obtain the required permits. Vote resulted: Aye: Vasquez, Clark, Bruesch, Imperial No: None Absent: Taylor Abstain: None The Chairman declared said motion duly carried and so ordered. B. 2533-2535 FALLING LEAF - HEARING James Guerra, Building Official, asked that this item be cancelled as the owner agreed today to allow an interior inspection. The inspection is scheduled for March 12, 2003. Mr. Guerra concluded that if the item is not resolved, it will be brought back for hearing at the March meeting. M. STATUS REPORTS A. SUBSTANDARD BUILDINGS AND PROPERTIES B. BUILDING REHABILITATION APPEALS BOARD C. CITY PROSECUTING'ATTORNEY REFERRAL UPDATE No action was required on the aforementioned items. MATTERS FROM OFFICIALS Boardmember Clark, referring to the Hearing on 3444 Lafayette Street, asked why the letter dated March 27, 2002 went to another person, rather than to Ms. Lam. James Guerra, Building Official, stated that Ms. Lam may have been the property prior to that date; however, the Building Department does not always have current title information when they send their initial letter. The letter is mailed to the assessed owner, and they run the title search at a later date. Boardmember Clark asked that the title date be researched. If the previous owner or realtor was aware of all the violations and sold it that way, isn't that fraudulent? Mr. Guerra stated that when that question arises, he suggests that the owner obtain legal advice. V.
