Rehab Appeals Board - Item 2B - 2418 Gladys AveTO: HONORABLE CHAIRMAN AND MEMBERS BUILDING REHABILITATION APPEALS BOARD FROM: BILL CROrE!CITY MANAGER DATE: JUNE 17. 2003 RE: 2418 GLADYS AVENUE - HEARING The subject property consists of a tenant-occupied single family residence with several unpermitted additions and alterations. The property is zoned R1-AP. The case was initiated in July, 2002, and compliance has not been achieved in nearly a year. Case chronology is as follows: • July 23, 2002 - "Please" letter mailed to property owner. • August 19, 2002 - Owner at City Hall. She spoke to Planning Department staff regarding the unpermitted additions. • September 3, 2002 - Staff received letter from George Pacheco, property owner's attorney, requesting a 70-day extension. Building inspector left message for Mr. Pacheco granting the extension. • September 19, 2002 - Inspection: progress had commenced in the removal of one of the unpermitted patios. • October 17, 2002 - Inspection: further progress had been achieved, however no permit had been obtained and no interior access gained. • November 7, 2002 - Building inspector spoke with Mr. Pacheco. She explained that if Mr. Pacheco's client did not submit plans within two weeks the City would file a Declaration of Subtandard against the property. REHAB AGENDA JUN 2.4 2003 ITEM No.7 -d. • January 14, 2003 - Inspection: interior access gained. A revised list of defects was generated and a copy was mailed to the property owner. • January 23, 2003 - No plans submitted. Property declared substandard by Building Official and a Declaration of Substandard Property filed with Los Angeles County Recorder's office. 30-day certified letter mailed to the property owner and posted at the property. • January 29, 2003 - A contractor telephoned requesting a copy of the list of defects. Building inspector faxed list to contractor. • February 24, 2003 - Inspection attempted: no access. Certified letter returned "unclaimed" and was resent via first class mail. • March 24, 2003 - Inspection: no progress. • April 21, 2003 - Property owner at City Hall. She indicated that her intentions were to sell the property to the tenants. She also claimed that it had been the tenants who had performed all of the unpermitted construction without her consent. An "Agreement to Release Declaration of Substandard" was drafted to facilitate in the sale of the property. • April 28, 2003 - Copy of the above document faxed to City Attorney for review and approval. • May 6, 2003 - "Agreement to Release Declaration of Substandard" picked up by real estate agent for signatures and notarization. A $15,000 refundable deposit required prior to the execution of the document. • May 27, 2003 - Inspection attempted: no access due to locked gate. Building inspector left message for real estate agent regarding the agreement which had not been returned to the City. • June 12, 2003 - Plans submitted for two-car garage. Plans approved. • June 16, 2003 - "Rehab" permit obtained. To date, the "Agreement to Release Declaration of Substandard" with the required deposit has not been returned. A Notice of Hearing was mailed and posted on the property on June 11, 2003. All interested parties have been notified. CITY BUILDING OFFICIAL'S RECOMMENDATION: It is recommended that the Board find the property substandard and order all substandard conditions and building code violations be removed and/or corrected by August 1, 2003.
