ABILITATION APPEALS BOARD FROM: BILL CROW CITY MANAGER DATE: JUNE 17, 2003 RE: 3243 DEL MAR AVENUE - HEARING The subject property consists of an owner-occupied single family dwelling located in the C-3 zone. The case was initiated in July, 2002, and compliance has not been achieved in nearly a year. Case chronology is as follows: • July 17, 2002 - "Please" letter mailed to property owner. • August 5, 2002 - Owner's daughter, Maria Villegas, came to City Hall to discuss list of defects. • August 19, 2002 - 30-day extension granted to allow time for a record search from Los Angeles County. • September 19, 2002 - Inspection: no progress. Maria Villegas telephoned. She indicated that she would return to City Hall the following week to speak to the Building Official. • September 26, 2002 - Ms. Villegas at City Hall to discuss list of defects with Building Official. He advised her to consult with Planning Department regarding the possible legalization of the unpermitted work. • September 30, 2002 - Inspection: no progress. REHAB JUN 2 4 2003 ITEM No. = • A October 14, 2002 - Property declared substandard by Building Official and a Declaration of Substandard Property filed with Los Angeles County Recorder's office. 15-day certified letter mailed and posted. October 30, 2002 -Building Official met with Ms. Villegas. It was determined that the carport, storage room and "guest" room, which were built without approvals and permits, must be demolished. A 30-day extension was granted to allow time to pursue Planning Department approval of a proposed two-car garage and storage room. • November 28, 2002 - Inspection: no progress. • January 6, 2003 - Inspection: no progress and no plans submitted to Planning Department. • January 30, 2003 - Maria Villegas telephoned.to inform staff that she would be in to obtain "Rehab" permit. • February 4, 2003 - Inspection: no progress and no permit obtained. • February 26, 2003 - Inspection: no progress. Inspector noticed that the unpermitted addition at the rear of the property appeared to be being used as a separate unit. A revised list of defects, to include this condition, was compiled and mailed to property owner. Building Official telephoned Ms. Villegas to remind her that the required permit had not been obtained. He agreed to grant a 30-day extension if the permit was obtained by March 6, 2003. • March 27, 2003 - No permit obtained. Building Official phoned Ms. Villegas. She agreed to obtain permit by March 31, 2003. He explained that significant progress in the removal of the substandard, unpermitted structures must be achieved, and that failure to do so would result in the scheduling of a hearing. • March 31, 2003 - "Rehab" permit obtained. 30-day extension granted. • April 29, 2003 - Inspection: no progress. All substandard conditions remain. Inspector left telephone message for Ms. Villegas. • May 29, 2003 - Inspection: no progress. Another message was left for Ms. Villegas. • June 2, 2003 - Building inspector drove by property. The rear unpennitted addition had been painted rather than demolished. Inspector left telephone message for Ms. Villegas. Ms. Villegas did not return the call, nor did she respond to the two previous messages. • June 16, 2003 - Building Official, building inspector and Ms. Villegas met at site. List of defects discussed. A portion of the rear substandard structure adjacent to the north property line had been removed. Owner will attempt to make additional progress by the day of the Hearing. A Notice of Hearing was mailed and posted on the property on June 11, 2003. All interested parties have been notified. CITY BUILDING OFFICIAL'S RECOMMENDATION: It is recommended that the Board find the property substandard and order all substandard conditions and building code violations be removed and/or corrected by August 1, 2003.
