The subject property consists of a tenant-occupied single family dwelling and a shed which had
been converted to a second unit. The property is zoned R-2. The case was initiated in February,
2003, and compliance has not been achieved in over seven months.
Case chronology is as follows:
• February 6, 2003 - "Please" letter mailed to property owner. Los Angeles County
record search information included.
• February 27, 2003 - Property owner, Nancy Barta, telephoned in response to the
"Please" letter. She informed the building inspector that the tenants had apparently
converted the shed into living quarters. She indicated that she planned to visit the
property prior to March 7, 2003.
• March 6, 2003 - Inspection: no progress.
• March 24, 2003 - Inspection: no progress. No indication that property owner had
been to property.
• April 1, 2003 - Property declared substandard by Building Official and a Declaration
of Substandard Property filed with Los Angeles County Recorder's office. 15-day
certified letter mailed and posted on the property.
• April 22, 2003 - Inspection: no progress.

• May 22, 2003 - Inspection: tenants in shed conversion had vacated and shed restored
to original use.
• June 23, 2003 - Inspection: interior access gained to both buildings. A revised list
of defects was compiled and mailed to the property owner.
• July 29, 2003 - Inspection: no progress. A second copy of the revised list of defects
was mailed to the property owner and the lender via certified mail.
• August 28, 2003 - Inspection: no progress. Rear building remained vacant.
To date, no permits have been obtained and all substandard conditions remain.
A Notice of Hearing was mailed and posted on the property on September 10, 2003. All interested
parties have been notified.
CITY BUILDING OFFICIAL'S RECOMMENDATION:
It is recommended that the Board find the property substandard and order all substandard
conditions and building code violations be removed and/or corrected by November 3, 2003.
However, if the required permits are obtained and sufficient progress is achieved by November 3,
X12003, the abatement date may be extended to December 1, 2003.

THEREFORE. NOTICE IS HEREBY GIVEN that on Tuesday, September 23. 2003, at 7:00 p.m.,

5. Shower stall walls are damaged and require repair.

A recent inspection at the subject address found the property to be substandard as defined by Chapter 99 of the City
of Rosemead Building Code, due to the conditions enumerated in the attached list of defects.
Section 9908 of the Rosemead Building Code declares all such substandard buildings a public nuisance and requires
the abatement thereof by repair, rehabilitation, or demolition of the substandard conditions.
As the owner of record, you are hereby ordered to comply with the requirements of said code, by repair,
rehabilitation, or demolition of the substandard conditions listed, within fifteen (15) days after receipt of this notice.
Be advised that if you are renting this property to others the City may file a "Notice of Non-Compliance" with the
State Franchise Tax Board. Section 17274 of the Revenue and Taxation Code states: "No deduction shall be
allowed for interest taxes depreciation or amortization with respect to substandard (rental) housing."
This notice will be posted on the property. If you disagree with the findings, or cannot comply with the order within
the time specified, you may request a public hearing. Such request for hearing must made, in writing, within fifteen
(15) days after posting of this notice on the subject property. The request for hearing shall be directed to the City
of Rosemead Building Official at 8838 East Valley Boulevard, Rosemead, California 91770.
For additional information or assistance, you may contact the inspector whose name and phone number appears on

required permits and inspections.

approvals.
