A RESOLUTION OF THE CITY OF ROSEMEAD, CALIFORNIA INCREASING
PARKING CITATION FEES BY $3.00, THE AMOUNT TO BE TRANSMITTED TO THE
COURT TRUST FUND AS REQUIRED BY AB 1617
WHEREAS, the Municipal Code of the City of Rosemead provides that certain
filing fees, permit fees, inspection fees, deposits, conditions of service and
parking /vehicle citations may from time to time be established by the City Council, and
WHEREAS, fees and parking citation fees are based on the costs of providing
the services or by statutory requirements, and
WHEREAS, the California State legislature passed AB 1617 requiring cities to
transmit a $3.00 surcharge to the Court Trust Fund for every parking citation for which
bail is collected, and
WHEREAS, the burden of paying the $3.00 surcharge rests with the parking
offender, and
WHEREAS, the Rosemead City Council desires to pass the surcharge obligation
through to the parking offender by increasing parking citation fees $3.00 for each
offense.
NOW, THEREFORE, BE IT RESOLVED by the Rosemead City Council that the
Parking/Vehicle Citation fees be amended as follows:

SUBJECT: INCREASE PARKING CITATION FEES BY $3.00 FOR PARKING
CITATION SURCHARGES IMPLEMENTED BY AB 1617
SUMMARY
On October 9, 2010 the State legislate
with the budget, the legislature apprc
funding shortages. The bill levies a $3
to an existing parking citation surcharge
re approved the fiscal 2010 -11 budget. Along
ved AB 1617 which addresses court system
00 parking citation surcharge and is in addition
of $4.50, also to support court system costs.
Operationally, cities must transmit $7.50 ($4.50 plus $3.00) to the Court Trust Fund for
each parking citation collected. AB 1617 becomes effective 60 days after the Governor
signs the budget and sunsets July 1, 2013.
The States' intended use of the surcharge revenue to pay court system costs makes the
connection between the parking violator and the court system. Therefore, the burden of
the surcharge should be passed on to the parking violator in the form of higher parking
citation fees and not subsidized by the City's taxpayers.
Staff Recommendation
Staff is recommending an increase to all Rosemead parking citation fees of $3.00 per
citation (Attachment A)
FINANCIAL REVIEW
AB 1617 requires cities to transmit $3.00 per parking citation collected. The City
collects approximately 10,000 citations per year; therefore, without increasing the
parking citation fees, AB 1617 would mandate the City to pay an estimated $30,000
from General Fund revenues to the Court Trust Fund each year.
