CITY NOVEMBER 9, 2010 SUBJECT: ELECTION FOR WATER QUALITY BOARD MEMBER AND ALTERNATE MEMBER REPRESENTING CITIES WITHOUT WATER PUMPING RIGHTS — RESOLUTION NO. 2010 -80 SUMMARY On September 14, 2010, the City Council nominated Council Member Margaret Clark as the representative for cities in the San Gabriel Basin without prescriptive water pumping rights. At this time the City Council needs to cast its vote(s) for Council Member Clark to represent cities without prescriptive pumping rights on the Board of the San Gabriel Basin Water Quality Authority by approving Resolution No. 2010 -80. Staff Recommendation That the City Council approve Resolution No. 2010 -80, casting its vote(s) for Council Member Margaret Clark to represent cities without prescriptive pumping rights on the Board of the San Gabriel Basin Water Quality Authority. ANALYSIS Each city may cast their votes for only one of the listed nominees (Attachment A) in the form of a resolution and has one vote for each 10,000 residents or majority thereof, as determined by the 2000 U.S. census data. As indicated on the San Gabriel Basin Water Quality Authority ballot (Attachment B), the City of Rosemead may cast 5 votes. The resolution of the city council casting its votes must be delivered by certified mail, FedEx, UPS with signature required or hand delivered to the Authority at least 24 hours before the meeting of the Board of the Authority at which the election of the city member and alternate will take place, or the votes will not be counted. Council Member Clark has been a Charter Member of the Board since it was established in 1992. Staff Recommendation Staff recommends that the City Council approve Resolution No. 2010 -66, voting Council Member Clark to another four year term on the San Gabriel Basin Water Quality Authority Board. ANALYSIS The Water Quality Authority was established by the State Legislature in 1992 for the purpose of developing, financing and implementing groundwater treatment programs. The seven member board consists of three members representing the overlying municipal water districts, one member representing cities with water pumping rights, one member representing cities without water pumping rights and two member representing water purveyors. Prepared by: '11aia vo ; C, GLORIA MOLLEDA CITY CLERK Attachment A — Resolution No. 2010 -66 Attachment B — Letter from Council Member Margaret Clark ATTACHMENT "D" RESOLUTION NO. 2010-80 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, CASTING ITS VOTE(S) FOR COUNCIL MEMBER MARGARET CLARK TO REPRESENT CITIES WITHOUT PRESCRIPTIVE PUMPING RIGHTS ON THE BOARD OF THE SAN GABRIEL BASIN WATER QUALITY AUTHORITY WHEREAS, on September 22, 1992, Senate Bill 1679 was signed into law by Governor Pete Wilson authorizing the creation of the San Gabriel Basin Water Quality Authority; and WHEREAS, the Board of the San Gabriel Basin Water Quality Authority is composed of seven members with three appointed members from each of the three municipal water districts, one elected city council person from cities in the San Gabriel Basin with prescriptive pumping rights, and one elected city council person from cities in the San Gabriel Basin without prescriptive pumping rights; and two members representing water producers in the San Gabriel Basin;,and WHEREAS, the City of Rosemead is one of the cities in the San Gabriel Basin without prescriptive pumping rights; and WHEREAS, the City of Rosemead may cast its vote(s) for a representative by resolution no later than December 20, 2010 at 5:00 p.m. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Rosemead, California, does hereby find, determine and Resolve as Follows: Section 1. The City Council of the City of Rosemead casts its vote(s) for Council Member Margaret Clark as the representative for cities in the San Gabriel Basin without prescriptive pumping rights.
