CC - 2010-83 - Landscaping Improvements at the I- 10 Freeway Off Ramp Adjacent to San Gabriel Blvd.
RESOLUTION NO. 2010 - _ 4; � A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD REGARDING CONTRACTING FOR LANDSCAPING IMPROVEMENTS AT THE INTERSTATE 10 FREEWAY OFF RAMP AREAS ADJACENT TO SAN GABRIEL BOULEVARD WHEREAS, off ramp areas adjacent to the Interstate 10 Freeway in the City of Rosemead are highly visible areas and serve as important entry points to residents and local commerce, as a result the City Council has stated one of its important goals is the beautification of those areas; and WHEREAS, the State of California, Department of Transportation (Caltrans) has competitively bid consistent with state public contracting law, a contract to authorize roadway, pedestrian accessibility, and some landscape improvements along the Interstate 10 Freeway at off ramp locations in the City of Rosemead; and WHEREAS, the City of Rosemead has worked with Caltrans officials to develop landscaping plans on Interstate 10 Freeway off ramp locations in the City that will greatly improve upon the State's initial plans to only plant groundcover and commonly used landscaping materials at these locations; and WHEREAS, Caltrans has authorized the City's improved landscaping plans in conjunction with ongoing Interstate 10 improvements, contingent on the City's use of the existing landscaping contractor Eco Logic, Inc. under contract with the State; and . WHEREAS, the City of Rosemead will realize significant savings in costs and time associated with using the State's competitively bid contract with Eco Logic, Inc. and if the City does not undertake its improvements now, it is not certain if or when Caltrans will grant the City access to make its desired landscape improvements. NOW THEREFORE BE IT RESOLVED that the City Council of the City of Rosemead hereby declares and finds the following: Section 1. The above recitals are incorporated herein. Section 2. The City of Rosemead hereby authorizes the completion of landscaping improvements along the Interstate 10 Freeway /San Gabriel Boulevard as discussed in the staff report accompanying this Resolution. Section 3. The City Manager is hereby authorized to enter into a contract with Eco Logic, Inc. for the Interstate 10 Freeway /San Gabriel Boulevard Beautification Project using the State of California Department of Transportation Contract No. 07- 166814 without submitting the work to the public bidding process as obtaining competitive proposals would not produce an advantage, and the advertisement for competitive bid would thus be undesirable, impractical or impossible as permitted in Graydon v. Pasadena Redevelopment Agency (1980) 104 Cal.App. 3d 631, 636 -637, 164 Cal.Rptr. 56. Eco Logic, Inc. is the only company which Caltrans will permit the City to perform work on the location at this time. Further, failure to use Eco Logic, Inc. will significantly delay or prevent the City from making its desired landscape upgrades. Failure to use Eco Logic Inc., will not result in costs savings and Caltrans has already complied with the competitive bid process in its selection of Eco Logic, Inc. Section 4. The City Clerk shall certify as to the adoption of this Resolution. This project includes a complete landscape makeover, which includes ground cover, trees, shrubs, and color splashes (roses and perennials) on off ramp slopes and adjacent areas. Staff Recommendation It is recommended that the City Council: 1. Approve the landscape plans and specifications. 2. Adopt Resolution . No. 2010 - 83 ,authorizing the City Manager to enter into a contract with Eco Logic Inc. for the I -10 /San Gabriel Boulevard Beautification Project (using the State of California Department of Transportation Contract No. 07- 166814) in the amount of $63,503.95 and establish an amount of $9,500 (approximately 15 %) to cover the cost of unforeseen construction expenses. DISCUSSION The 1 -10/ San Gabriel Boulevard Beautification Project is located on the freeway off ramp slopes, south of the 1 -10 Freeway just adjacent to San Gabriel Boulevard. There are several maintenance issues along these slope areas including overgrown weeds, trash debris, and graffiti. The City's Public Works Department routinely monitors this stretch of roadway and spends considerable time removing weeds and trash debris. The proposed project includes drought tolerant shrubs, groundcover, trees and color splashes (roses and perennials) along the slope areas adjacent to the freeway. This mix of plant and tree species will provide a continual bloom from spring through fall months ITEM NO. O n l ei___ APPROVED FOR CITY COUNCIL AGENDA: City Council Meeting December 14, 2010. Page 2 of 3 and beautify non - landscaped areas where trash and weeds currently accumulate. Together with the upcoming freeway underpass bridge painting project, this landscaping improvement work will provide a welcome entry into the City of Rosemead. This project is the second location of a multiple phase approach to improve all 1 -10 Freeway off ramp areas in the City, also including Rosemead Boulevard, Walnut Grove Avenue, and Del Mar Avenue. In conjunction with the existing Caltrans 1 -10 Freeway off ramp improvements, the City has been able to work with Caltrans officials to develop landscaping plans and coordinate beautification improvements to immediately follow roadway improvements at these locations. The Council previously approved a contract for improvements along Del Mar Avenue. Clearing and grubbing work has started at the Del Mar location and landscape planting is expected to be finished in December. Once finished with Del Mar, crews will move to San Gabriel Blvd off ramp locations (in early January). The City's landscaping plans are intended to improve upon the State's initial plans to install groundcover and other commonly used landscaping materials at these locations. Caltrans officials have approved the City's proposed landscaping plans and have authorized Caltrans' landscape contractor, Eco Logic Inc., to complete improvements. Eco Logic Inc. competitively bid and was awarded a State landscaping contract to complete work as part of the State's 1 -10 Improvement Project (Attachment 1). By utilizing this previously competitively bid contract, the City will save significant costs associated with contractor mobilization, irrigation materials, rodent control, and permitting (these costs are already included in Ecologic's contract with the State). As a result, the City will only be responsible for the costs associated with installing the City's preferred landscaping materials. The City will also save a substantial amount of time as compared to the normal design review and encroachment permitting process through Caltrans, which can sometimes take 6 -12 months. In accordance with the City's Purchasing Policy, the City Council may use a competitive bid conducted by another public agency to purchase goods and services. The attached resolution has been reviewed by the City Attorney and outlines the findings made to take advantage of the State's existing landscape improvement contract. FINANCIAL REVIEW Funding for this project was approved by the City Council as part of the City's Capital Improvement Program, Budget. There is approximately $500,000 available for beautification improvements at Interstate 10 freeway off ramp locations. ENVIRONMENTAL REVIEW The project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15304 (a) of the CEQA Implementing Guidelines. This exemption covers projects involving minor alterations of land that do not have a significant effect on the environment. City Council Meeting December 14, 2010.
