M. 13 IN 1r, 'T~ The Regular Meeting of the Rosemead City Council was called to order by Mayor Cleveland at 8:05 p. m., in the Council Chambers of City Hall, 8838 E. Valley Boulevard, Rosemead, California. The Pledge to the Flag was led by Councilman Cichy. The Invocation was delivered by Reverend John Juedes. ROLL CALL OF OFFICERS: Present: Councilmen Cichy, Imperial, Taylor, Tury and Mayor Cleveland Absent: None APPROVAL OF MINUTES: October 25, 1983 - Regular Meeting MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILMAN TURY that the Minutes of the Council Meeting of October 25, 1983 be approved. RESOLUTION NO. 83-49 - CLAIMS & DEMANDS RESOLUTION NO. 83-49 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD ALLOWING CERTAIN CLAIMS & DEMANDS IN THE SUM OF $174,497.44 NUMBERED 8723-8733 & 7847 THROUGH 7949 INCLUSIVELY MOTION BY COUNCILMAN TURY, SECONDED BY COUNCILMAN IMPERIAL that Resolution No. 83-49 be adopted. COUNTY LIGHTING DISTRICT #1395 RESOLUTION NO. 83-50 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD WITHDRAWING ALL THAT PORTION OF THAT PART OF THE CITY OF ROSEMEAD CONTAINED WITHIN THE BOUNDARIES OF COUNTY LIGHTING MAINTENANCE DISTRICT NO.1395 MOTION BY COUNCILMAN TURY, SECONDED BY COUNCILMAN IMPERIAL that Resolution No. 83-50 be adopted. RESOLUTION NO. 83-51 - CITY OF ROSEMEAD MAKING CERTAIN FINDINGS & DETERMINATIONS WITH RESPECT TO ZAPOPAN COM- MUNITY CENTER RESOLUTION NO. 83-51 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD MAKING CERTAIN FINDINGS & DETERMINATIONS WITH RESPECT TO THE ZAPOPAN COMMUNITY CENTER MOTION BY COUNCILMAN IMPERIAL, SECONDED BY COUNCILMAN CICHY that Resolution No. 83-51 be adopted. RESOLUTION NO. 83-52 - CITY OF ROSEMEAD AUTHORIZING A FUEL EFFICIENT TRAFFIC SIGNAL MANAGEMENT PROGRAM GRANT APPLICATION Tom Howard, Assistant City Engineer, stated that this application is to provide a study for the entire traffic signal system within the City of Rosemead in order to sychronize the timing of all the signals to improve the fuel efficiency of motoring public. Frank G. Tripepi, City Manager, stated that this applica- tion would allow the use of State monies to study to see if it is feasible to tie everything together in a single interconnect. He stated that the cost of the project would be $34,100 with $30,700 being funded by the State and $3,400 by the City. Councilman Cichy inquired if the City would be obligated to act to the demands of the State to set the signals at a certain pattern. CONSENT CALENDAR (CC-A deferred) CC-B ACCEPTANCE OF ROAD DEEDS, PERMIT TO ENTER, RIGHT-OF- WAY AGREEMENT FOR STRATHMORE STREET IMPROVEMENT PROJECT MOTION BY COUNCILMAN TURY, SECONDED BY COUNCILMAN TAYLOR that the foregoing item on the Consent Calendar be approved. Vote resulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. CC-A APPROVAL OF PLANS & SPECIFICATIONS FOR DELTA (MISSION/ WELLS) AND WELLS (DELTA/WALNUT GROVE) DRAINAGE IMPROVE= MENTS AND AUTHORIZATION TO SEEK BIDS Councilman.Taylor requested from staff the cause of this pro- ject and the need for the drain system at the Edison right-of-way. Tom Howard, Assistant City Engineer, that the property to the east of the Edison right-of-way on Rockhold drains into the Edison right of way and then in turn drains to the South onto Wells and from Wells it goes down to the left into the drain at intersection of Delta and Wells. It has been a constant nuisance and there have been complaints from property owners in the area. CM 11-8-83 Page k2 0 • Councilman Taylor inquired what percentage of the problem was caused by the Edison right-of-way and what percentage is caused by the residential sites. Mr. Howard stated that about 90% is caused by the Edison right-of-way and 10% by the other residences. Councilman Taylor stated that he felt that this was a viola- tion of the Municipal Code and it would be a gift of public funds to an individual. He requested that the Municipal Code be brought in and Section #4131 be read. Frank G. Tripepi, City Manager, read Section 4131 which states: Flowing Mud or Water on Highway. It shall be unlawful for any person,.firm or corporation, to deposit, drain, wash, allow, to run or divert into or upon any public road,,highway, street or alley, drainage ditch, storm drain, or flood control channel owned by or controlled by any public agency within the City, any water, mud, sand, oil or petroleum. Councilman Taylor stated that this would not solve the pro- blem, but would just run into the drainage system. This should be checked into and the problem should be resolved at the source. A drain system should not be built for an individuals private use. Councilman Tury stated that he agreed that something should be done to get the water stopped. Councilman Taylor requested that this item be deferred for further information. Councilman Tury requested staff to contact the lessor to. see what could be done about stopping the water. Councilman Taylor stated that the Municipal Code has been violated and the Code Enforcement Officer should check it out. There being no objection,.this item has been deferred to the next Council Agenda for November 22, 1983. VI. MATTERS FROM OFFICIALS A. Councilman Cichy requested a brief report on the status of negotiations with Modern Service. Frank G. Tripepi, City Manager, stated that Modern is close to agreeing to setting up a separate set of books and separate allocations which can be used to determine how much of his ex- penses are derived from the Rosemead franchise. Hopefully, most of this will be resolved and available to consider at the next Council Meeting. B. Councilman Cichy commented on the lawsuit against the County of Los Angeles regarding Ambulance services and costs. He stated that the Cities won against the County at the Appellate Court level, however, the fight may continue since this would cost the County several millions of dollars. C. Councilman Tury restated his request to have the signals at Garvey and Walnut Grove monitored to resolve the left-turn problems at that intersection. D. Councilman Imperial inquired if Muscatel School had gotten a permit for band practice. Frank G. Tripepi, City Manager, stated that Muscatel School had received a permit,and met with the conditions of that permit, which were insurance requirements. Councilman Imperial inquired what the hours of operation were. Mr. Tripepi.stated that the application states the time of the operation. CM 11-8-83 Page #3 Councilman Imperial requested copies of the memorandum and application. Mr. Tripepi stated that he would be happy to provide the Council with a copy of the request and application. E. Councilman Imperial inquired about Bartlett Street south of Mission. Frank G. Tripepi,.City Manager, stated that he would have the report on that private street by the next Council Meeting. F. Councilman Taylor inquired about the report regarding the street improvements on Fern and Walnut Grove. Frank G. Tripepi, City Manager, stated that they.were working on it and would have the information by the next Council-Meeting. G. Frank G. Tripepi; City Manager, stated that a copy of the handout on Long Term Finance for Local Governments had been made available to the Council along with a letter which was written by the Mayor to be sent Senator Marks which states the philosophy of the majority of the Council. If there are no objections to the letter, it can be signed and sent to Senator Marks along with a copy to each member of that committee, our own Senator and Assemblywoman, and also to our Legislative Advocate. H. Mayor Cleveland stated that he had been approached by the Sister City Committee and was asked to attend the Sister City trip to Zapopan on December 1st, and requested Council's authori- zation to attend and authorization to present a gift on behalf of the City of Rosemead, and he also requested authorization for the City Manager to accompany him on this trip. MOTION BY COUNCILMAN TURY, SECONDED BY COUNCILMAN CICHY that the Mayor and the City Manager be authorized to attend the Sister City trip to Zapopan on December 1st, 1983 and authoriza- tion to present a gift on behalf of the City of Rosemead be granted. Vote resulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. VII. ORAL COMMUNICATIONS A. Natu Patel, 8544 Mission Drive, commented on the street light that has been out on the corner of Walnut Grove and Mission Drive for the last two weeks. Councilman Taylor inquired if the street light was still out. Mr. Patel stated that it is still out. Councilman Taylor requested a written memorandum ducumenting the call to the City and investigate what is going on. It appears that response time is very poor and the City is not getting the proper service on their calls. Mr. Patel stated that the street light was out on the corner, of Valley Boulevard and Walnut Grove also. He requested a written answer to the resolution of the problem. Mayor Cleveland stated that the City Manager would notify him with a written response. Councilman Taylor stated that there is a signal out on the north side of the street.on Garvey and Jackson and that it has been out for the last several days, and he requested that it be checked out. Mayor Cleveland requested a report back at the next Council Meeting on these items. CM 11-8-83 Page N4 B. Councilman Taylor stated that a senior citizen had contacted him regarding the dial-a-ride program. This citizen had called to be picked up from a store and it was an unmarked car that drove up to pick her up and she was very reluctant to get into the car. Councilman Taylor requested a report on that car and the dial-a-ride program. C. Councilman Tury stated that he had been requested by senior citizens that some of the staff working at the Community Center should have CPR training. He requested a memorandum regarding this matter.so that he may respond to these citizens. D. Councilman Imperial requested that the Council Meeting be adjourned in memory of the war dead in Lebanon and Grenada. Mayor Cleveland adjourned the Council Meeting in memory of the war dead in Lebanon and Grenada to a study session on Novem- ber 15, 1983 at 7:00 D. m., regarding Cable T. V.
