CC - 04-12-83APPROV ED- • CITY OF ROSEMEAD P,y MINUTES OF THE REGULAR MEETING OF THE ROSEMEAD CITY COUNCIL APRIL 12, 1983 AT 8:00 P.M. The Regular Meeting of the Rosemead City Council was called to order by Mayor Tury at 8:00 p. m., in the Council Chambers of City Hall, 8838 E. Valley Boulevard, Rosemead, California. The Pledge to the Flag was led by Councilman Cichy. The Invocation was delivered by Rev. Jim Kehrli. ROLL CALL OF OFFICERS: Present: Councilmembers Cichy, Cleveland, Imperial, Taylor and Mayor Tury Absent: None APPROVAL OF MINUTES: MARCH 22, 1983 - REGULAR MEETING MOTION BY COUNCILMAN IMPERIAL, SECONDED BY COUNCILMAN CLEVELAND that the Minutes of the March 22, 1983 Meeting be approved.. Vote resulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. PRESENTATIONS Mayor Tury presented Malcolm Boykin with a Resolution con- gratulating him for winning the title of State High School Wrestling Champion and for bringing honor to Rosemead High School and to the City of Rosemead. Mayor Tury presented the Rosemead High School Songleaders with a Resolution of Commendation for winning first place in the competition held at the California State University at Hay- ward on March 12th. Mayor Tury introduced Dr. Terry Irvine, Principal of Rosemead High School. Dr. Terry Irvine stated that these young people who were honored by the Resolutions of Commendation, are not just State Champions but excellent students and good citizens, and he was very proud of each and everyone of them. He also stated that he was very proud of the City of Rosemead, Rosemead High School and the Mayor of Rosemead, who is also a Rosemead High School graduate. Councilman Imperial requested that the Council Meeting be adjourned in honor of Rosemead High School, its fine Principal, and the young people who are here today who are certainly an asset to their peer group. Mayor Tury presented a Resolution honoring and thanking Bob Dickey, Assistant City Manager, for his seven years of service to the City, and congratulated him on his appointment as City Manager to.the City of Walnut. II. PUBLIC HEARING A. CONTINUED PUBLIC HEARING TO CONSIDER CONFIRMATION OF ASSESSMENTS FOR MARSHALL(TEMPLE CITY BLVD. /STRANG) AND BROOKLINE (MARSHALL /LOFTUS) Mayor Tury stated that the Public Hearing was open and in- quired if anyone would care to speak regarding this matter. ing. Tripepi, City Manager, stated that a request had been received from the developer requesting that the Public Hearing be held over to the next Council Meeting of April 26th. CONTINUED PUBLIC HEARING TO CONSIDER INSTALLATION OF FULL STREET IMPROVEMENTS ON BOTH SIDES OF CHARIETTE (MARSHALL /OLNEY) UNDER PROVISIONS OF THE 1911 IMPROVE - MENT ACT. Mayor Tury stated that the Public Hearing was open and in- quired if there was anyone who would care to speak regarding this project. No one came forward and the Mayor closed the Public Hearing. CC -D AWARD OF BID -- HANDYMAN HOME IMPROVEMENT PROGRAM Mayor Tury stated that he had no problem with the low bidder, but he did have a question regarding the residents complaint about the lack of response from the contractor. Tom Hbward, Deputy City Engineer,stated that he believed that Jim Guerra had resolved all the problems in regards to this matter. MOTION BY COUNCILMAN IMPERIAL, SECONDED BY COUNCILMAN CICHY that the contract be awarded to the low bidder, Oakridge, for six residences. CC -H DISPOSAL OF SURPLUS PROPERTY Councilman Taylor stated that he had not seen the surplus property that has been listed, and questioned if the property had depreciated that much. Frank G. Tripepi, City Manager, stated that on many of the items listed that they are inoperable, and will be accepted on an as is basis with a minimum bid on these items. He stated that if the Council would like, the age and purchase date can be pro- vided. Councilman Taylor stated that would be fine. The Mayor declared said motion duly carried and so ordered. CM 4 -12 -83 Page #13 V. MATTERS FOR DISCUSSION & ACTION A. NAUGLES INCIDENT (VERBATIM) Mayor: Mr. Taylor, I'll refer that to you. Taylor: Mr. Mayor, I just wanted some clarification. We have got some pretty good reports on it. I would just like to have the Council refer to the dates of the different reports. They have been amended twice and I just refer that to the Council. As you know, my son was involved in this incident, as far as being. in Naugles Restaurant. I had asked him to ... we have received a story of some of the juveniles that were involved in it, and we have had the sheriff's report, but we haven't received a report from the third parties involved. So I asked him to just, if he would mind letting the Council hear the third side of it. Since there were three parties involved. The Sheriff's response, the other juveniles involved... Steve would you mind telling us what happened there that night. Just..yes, please. Mayor: What's your name Steve, for the record. Steve: My name is Steve Taylor, and I live at 9541 Marshall Street. I haven't read any of the reports or heard what the other boys have said, but that night I had arrived there and I saw some boys drinking in the parking lot and I walked in and some of my friends from my church were there and I started talking with them and they said that those boys out there were hasseling them and I work at that restaurant and I was talking to the manager, and he said that he had.kicked those boys out of the restaurant for drinking, hasseling and food fights. So I was standing there and one of the boys outside came up to me and he...uh..it was close to midnight so I had locked the doors for the manager because we lock the inside doors at midnight. The Manager had asked me to lock the doors so I locked the doors, and one of the boys came over to me and he wanted to come in and I said I am sorry, but the thing is closed. He started accusing me of picking up his beer bottles or something. I said no I didn't. He tried to get into the restaurant and get at me, but I closed the door and I got in. They were outside and they were yelling things to us and giving us the finger and a lot of other things, and we just... none of the other guys were interested and I was just sitting there watching them out of the restaurant and they were just drinking beer and setting the bottles down there and one of the boys, there were three on one side and a driver, one of the boys had a knife in his hand and he had it down next to his side and he was twisting'it in his hand and looking at me and I just sat there and for ten or fifteen minutes I just sat there and smiled at him. They..We had called the Sheriff's on them, and told the Sheriff that they were hasseling them and there was no response. It was ten minutes later and there was another call and the manager said that he had told the sheriff that there was knives involved and somebody could get hurt,. So we went back out there and we were watching them and they decided that they were going to leave. So they decided to start their van and the van did not start. It.died. So they went across the street and got one of their friends from the.Rose Room and charged the battery up and then they left. So... the Sheriff's hadn't come yet, we figured they weren't going to come so we figured we would leave. Since they were gone. So we walked out of the restaurant and went over to the car, and just as my friend and I were going to get into the car, one of the boys jumped over one of the walls. They had hidden behind one of the walls. They started beating up on one of my friends, so I went over and started to help him. Three other boys came from another direction, one with the knife and the other two. So I ran into the restaurant and those three came after me and one of them stayed with my friend, and they went after me and when I came over I got into the.restaurant and for five minutes they kept threatening, telling how they are going to kill me and that I'm dead and everything. The Sheriff still hadn't showed up yet, and at this time, there was an off -duty L.A. P.D. man there and we was helping the manager out with.-.stopping the boys from doing anything. Just about five minutes after that the Sheriff showed up and we told them what had happened. The CM 4 -12 -83 Page #4 Sheriff said o.k. why don't you tell the other sheriff. So I told the other sheriff while this one drove up the street. They were driving around for about five minutes and me and my friend Steve were out in the parking lot watching them, and we saw the van parked up the street, right up Muscatel, about five or six doors down. We got up there and one of the parking lights on the Van were on, so we came back and told the sheriff where they were and the Sheriff went back up there and we followed them back up and the Sheriffs were looking in the van and the boys were around somewhere because the van had the light on. We looked around and the Sheriff told us that we had better go because we were going to get hurt. So I was curious and we wanted to stay. So me and my friend got into the car and went back to Naugles and we went across the street and we watched... and a couple of the Sheriffs were still standing around and one of the Sheriffs came to us and he told us, the same Sheriff that told us the first time, I thought I told you guys to leave, and we said we were sorry and we left. But, my major concern was..me and my friend got away with this luckily because I was able to get back into the restaurant and my friend was able to leave, but the Sheriffs have responded other.times on time, but this time, the Sheriffs did not..I don't want them... the next people, these boys might have trouble with might not be as lucky as we were. Mayor: Steve, do you have to call them very often..out of curiosity is that a problem spot. Do you have problems there very often at Naugles. Steve: Yes, we do. I have called the Sheriff. I have worked there since last June, and we haven't had any problems over the summer. But I have called there quite a few times and we had a robbery there and the Sheriff responded real quick. And a couple of other times the manager said the Sheriff took awhile to get there, but I've never had a problem with the Sheriff not responding in such a long time. And after twenty -five minutes or so when the Sheriff did show up, one Sheriff would have been fine if it were to show up on time, but three or four Sheriffs pull in the driveway within minutes of each other. One Sheriff could have handled it if they would have come in the beginning. They had everything going on there and it was a little late then. The boys were already gone. Mayor: That is unfortunate. We have talked about this whole inci- dent. Steve: I just don't want the next people that these boys bet involved with—they may not be as lucky as us and they may get hurt. Mayor: I can agree with you, there is something wrong with a res- ponse time of twenty -five minutes. Since this incidence has the Sheriff taken the time to cruise that parking lot periodically. Steve: Yes, I have noticed that the Sheriffs have been there a lot more than before the incident. I see them every single night, they are around there a lot. Mayor: We can only apologize to you for the length of time, and talk to the Police commander and I don't'know if you have been shown any of the reports, and like they said they have up -dated them several times. Sounds like it is getting closer to the reality is. Steve: I wanted to know whether the suspects were caught or not, so I went down to the station, but I couldn't get the report. The people that attacked us, they wanted to know their names and I didn't know them. Mayor: Any comments? 0. K. Gary go ahead.. CM 4 -12 -83 Page k5 0 Taylor: S asked Steve to put in the third side of it, and you gentlemen can take what you want out of it, but it pretty well ties into what happened. That there were weapons involved and it was in the tape to the Sheriff. The record is pretty clear. I was shocked at the response time and the mix -up in the calls. You and I were out here last year, Mr. Mayor, and we called the Sheriff, and we waited a half -hour to forty -five minutes, some- thing like that and the poor old fellow just wandered out across the street. Mayor: I think, Frank, to add on to this, we were talking about this, and Frank was in my shop one day and there was some guy either passed out or dead in the curb next to the sidewalk over there. We called the Sheriffs and Frank and I sat there for forty - five minutes and this is the City Manager of a City .calling, and the response time was equally poor. Taylor: Well, Mr. Mayor, there are many good Sheriffs, I don't.... it is just like people you deal with...I have employees maybe 80 to 100 on a job. Some of them are lackadaisical, they don't do their job properly and there are others that are excellent and very conscientious, and that is true with the Sheriff's Department too. There are many good ones. This was an incident, and this was the fifth time for me personally that there has been a poor response and sometimes no response. When a resident calls me on the phone and has complaints and questions what is going on, I have to take it with a grain of salt in one sense because I don't know the validity of it,.but.five out of six times I have personally been involved in ... I have just lost a little bit of faith with... maybe we are not providing the proper coverage and maybe not enough cars, I don't know the answer, but it doesn't explain the response time. We were told in the past,.when complaints would come to us the average is from three to five minutes response. We all wonder how can that be. The Sheriff's department Captain Jim Callas, when he took over last year, I don't criticize him at all, he has a job to do or any of the officers, but I think something needs to be re- viewed a little more accurately. I don't envy his job nor do I condemn him. It is not really his fault, and there are good de- puties, but there is a flaw somewhere. Mayor: I think, possibly, Gary, and maybe we should have done this in the past, why don't we have a meeting with Mr. Callas and the Council here in the Conference Room, a Public Meeting, not a secret meeting, and let us throw these things out. My experience with him, is that he seems to be responsive if he is made aware of a problem. But, I don't know that for a fact, in the past he has been quite responsive. Why don't we do that? Would that be ...would the Council think that would be a good idea? I think instead of all of us ... having problems and talking amongst our- selves, the person to get_ to is Mr. Callas and then we can talk to him as a body, and maybe we are understaffed. Maybe, this is the time to look into alternatives to what we are providing at this particular point and time. Imperial: I would like to say at this time, and I am going to be very blunt and frank, in my association with the City as a Council - person, I have not always been impressed with the service that we got from the Sheriff's department. I was definitely not impressed with the two previous commanders of the Temple City Sheriff.'s De- partment. I am very impressed with Mr. Callas,as far as I am con- cerned he is the best Captain that we have had at the Temple City Sheriff's Station. But like any organization there are problems. At one time, I think we had a good thing going in this City. We had a Sheriff's breakfast where we could get together and we could look these deputies in the eyes and say o. k. what happened, why? Get a response from them. I think it was a good program. I don't know why we don't have them any omre. In my opinion, they were very cost effective because you really resolve a lot of problems and get out some frustrations and get some answers that you pro- bably wouldn't get in a report. I would like to suggest that this meeting that we have with Captain Callas would also include some of his key deputies, either a breakfast or dinner meeting. Let's sit down and break bread with these people and find out what the problem is. I am very concerned with this incident. As much as I think about Captain (continued on next page) CM 4 -12 -83 Page M6 Callas and the way he runs his operation, I am very concerned with this incident, and I think that we as a body ought to sit down and talk to not only him but some of his key people. Thank you. Taylor: Mr. Mayor, I would like, if there is no objection, this item of the meeting verbatim and a copy of it given to Captain Callas, and to put in that file the third party story. Mayor: That's fine.. Taylor: It was incomplete, and Steve hadn't seen the documents or heard the tape or any of it, and I just asked him to come and explain what happened first hand, and you can ask him any questions you want. But I think it is important that it be part of that record because it states that no weapons are involved. They didn't ask the third party involved. That was disturbing to me and also that there was no follow up on that part of it. Mayor: I would like, if it is alright with Steve, to have this made part of the record. Taylor: He's a minor. I am his guardian. Mayor: If there are no objections to that, we will have them made part of the record because this has brought a problem to a head that has been festering for quite some time, and we appreciate your forthrightness and your willingness to come forward and talk to us. Thank you very much. Bonnie Culbertson: I am sure you are all aware of the many robberies that our local banks are having. We are in the process, the Chamber is in the process of setting up a meeting with Captain Callas and a gentleman from the FBI to meet with our local bankers and the savings and loan representatives—because the manager of Union Federal Savings Loan was told,last Friday morning when he called the Sheriff from the Chamber Office that the alarm was set off, go ahead and go in and if you have a problem then call me. So we feel that Captain Callas is not aware of what is happening, and we have already made phone calls initiating this meeting. That doesn't mean that you shouldn't have a separate one, but we would be very happy to include the City Council at that time. Mayor: I think that we should keep those two things separate, but we would be glad to show up and get the information. Cichy: We should get a report on the bank situation, and I don't think we should keep it separate and we should know all about it. Imperial: Also, when we set up this breakfast or dinner meeting with the Sheriff's department, if the Council agrees, I would like to know when it is, I would like the-Council to have enough response time to jot down some questions on this incident with young Mr. Taylor so that they have all this information available at the Meeting. Mayor: Well, why don't we try to arrange an evening meeting, Frank. I would like to have everyone there.and with Jim and possibly some of his head people, if there is no objections to that. I think that in cooperation with the Chamber, if you will let us know when the meeting is, if possibly Frank could be there or someone could be there so that we could hear what is going on too. These things surface sometimes and I wasn't aware that there was a rash of bank robberies in town. To be very honest with you. Culbertson: In fact we were informed that Valley Boulevard has the highest rate of bank robberies in the San Gabriel Valley. Mayor: Did anyone on this Council know that? Taylor: No. Imperial: I didn't. CM 4 -12 -83 Page H7 Mayor: It seems to me to be something that we should be made aware of, now doesn't it? Let's find out why we were not made aware of that. Imperial: It sounds like we have a communications problem. Mayor: That's right. I'll set up that meeting and Bonnie if you will advise us when your meeting and we will try to be pre- sent. O. K. Is it O. K., Gary? Taylor: Yes, Mr. Mayor, thank you. B. CONTRACT POLICY FOR CDBG DEFERRED & LOW INTEREST LOANS Frank G. Tripepi, City Manager, stated that a resolution has been prepared outlining the provisions of the policy limiting the amount of the loan to the lowest responsible bidder. The following Resolution was presented for adoption: RESOLUTION NO. 83 -15 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD ESTABLISHING BID REQUIREMENTS FOR LOW- INTEREST & DEFERRED LOAN IMPROVEMENT PROJECTS UNDER THE CITY COMMUNITY BLOCK GRANT PROGRAM MOTION BY COUNCILMAN CLEVELAND, SECONDED BY COUNCILMAN CICHY that Resolution No. 83 -15 be adopted and the reading in full be waived. Vote resulted: AYES: Councilmen Cichy, Cleveland, Imperial, and Mayor Tury NAYES: Councilman Taylor ABSTAIN: .None ABSENT: None Whereupon the Mayor declared said motion duly carried and so ordered. Councilman Imperial requested that the record show that even though he is in favor of the way the program is administrated, he is not in favor of the funding. Councilman Taylor stated that the Resolution 83 -15 clarified an issue, and his "no" vote was not on the Resolution as such, it was his opposition to some of the program. C. TRAFFIC COMMISSION APPOINTMENT Councilman Imperial stated that he,would like to make a motion to reappoint Eldon Beezley to the Traffic Commission, and commented that he had done an excellent job and has certainly been an asset to the Traffic Commission. MOTION BY COUNCILMAN IMPERIAL, SECONDED BY COUNCILMAN CICHY that Eldon Beezley be reappointed to the Traffic Commission for a term of two years. Vote resulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. D. WALNUT GROVE SLOPE BEAUTIFICATION Frank G. Tripepi, City Manager,.stated that there are three alternatives to the second phase of the project which is the beautification and fencing. Councilman Taylor stated that he felt that the cleaning and the beautification was fine, however, his only reservation is the expense and the necessity of putting in a block wall. He felt that visiability eliminates the potential of things happening. Mayor Tury stated that he felt that in order to give privacy to the back yards, the slats and the chain link fence would be an acceptable compromise. CM 4 -12 -83 Page #8 Councilman Imperial stated that the full intent of the Council was that by taking out the bushes it would eliminate the problem and replacing it with groundcover for beautifica- tion. He feels it is going from one extreme to another by talking about a block wall. He felt that it would set up a target for the grafitti experts and would be something for someone to hide behind. He stated that he could support groundcover, but not a fence. Councilman Taylor inquired what does the $17,000 for option III include. Frank G. Tripepi, City Manager, stated that it includes re- placement of chain link fence and installation and resecuring with new posts sunk in concrete and the installation of the slats. MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILMAN CICHY that Option III be accepted and the staff be authorized to develop specifications and seek bids, and with the alternative to either replace or repair the chain link fence. Vote resulted: AYES: Councilmen Cichy, Cleveland, Taylor and Mayor Tury NAYES: Councilman Imperial ABSTAIN: None ABSENT: None Whereupon the Mayor declared said motion duly carried and so ordered. Councilman Imperial requested that the record show that he is in favor of the beautification project, however, he is not in favor of the expense of a fence, 'and he felt that only groundcover was needed. E. SUPPORT OF LEGISLATIVE BILLS, SB 575, SB 888, & AB 678 MOTION BY COUNCILMAN IMPERIAL, SECONDED BY COUNCILMAN' CLEVELAND that the Legislative Advocate support SB 575, SB 888, and AB 678 on behalf of the City of Rosemead. APPROVAL OF REVISED GENERAL PLAN Mayor Tury requested that the revised General Plan be held over to the next meeting on April 26th for some clarification. of the verbiage. He commented that he had made calls to the Deputy Engineer regarding the matter and'was told that it would rain. The street has been paved so that this complaint will not help him, however, it may help,'others. Councilman Taylor stated that daily job reports should be required to be turned into the City Manager. Councilman Imperial requested a memo from the City Manager explaining where the problem is, for instance if Mr. Dickey had made the contact that he was suppose to and it couldn't be done, he wanted to know why. If there was a reason that he could not contact someone in the Contractors Office, he wanted to know why. Councilman Taylor stated that the requirement of daily job reports should be part of the bid package and also the require- ment of an inspectors report each day should be turned into the City Manager. Mayor Tury thanked Juan Nunez for the information and his helpfulness, and apologized for the dust on Del Mar. CM 4 -12 -83 Page #9 Juan Nunez commented on a pole that was in the middle of the sidewalk just south of Garvey on the eastside that was moved and it seems it will be in the middle of the sidewalk. He stated that over on the westside, about the third post from Garvey on the eastside of Del Mar the telephone company moved aPost and it was put it in the center of the sidewalk. Juan Nunez stated that there was an anchor on Garvey on the southside of the street and it about six inches from the sidewalk and has been of months. east of Del Mar is sticking out there a couple Mayor Tury stated that it will be investigated immediately, and requested that daily work sheets be added to the bid packages, and also a week -end number where the contractor can be contacted. Mayor Tury stated considering the enormity of the Del Mar project, a good job has been done. VI. MATTERS FROM OFFICIALS A. Councilman Imperial commented that he was just back from a trip - -to the White House and he brought back a package that everyone can read, and stated that if there are any questions relating to the trip he would be happy to answer them. There being no further business to be handled,the Council Meeting was adjourned to the next regular meeting on April 26, 1983 at 8:00 p. m.
