Public Improvement Reimbursement Agreement between the City and Community Development Commission of the City of Rosemead On Monday, January 10, 2011, Governor Brown issued his 2011-12
budget proposal. The proposal includes the dissolution of redevelopment agencies statewide and the requirement that all future tax increment be used only to satisfy agencies’ existing
obligations. Given the current budget proposal, staff is recommending that the Community Development Commission of the City of Rosemead (CDC) and the City complete a Public Improvement
Reimbursement Agreement (Improvement Agreement). The Improvement Agreement will allow the timely completion of projects and priorities that the City and CDC have previously envisioned
in the City’s Redevelopment Project Areas. Through this agreement, the CDC would agree to fund the improvements with existing increment financing and bond proceeds (less 20% for required
housing set-aside monies) from the redevelopment areas; and the City would agree to implement the public infrastructure Improvements.

Commission and City Council: 1. Adopt Resolution No. 2011-07, making the appropriate findings under Health and Safety Code Section 33445; 2. Approve a Public Improvements Reimbursement
Agreement between the City of Rosemead and the Community Development Commission of the City of Rosemead for the funding of public improvements in the City’s Redevelopment Project Areas,
and authorize the Mayor to execute necessary documents; 3. Authorize the City Manager to establish a separate budget account to hold available funds that will be used to complete public
improvements outlined in the Reimbursement Agreement. 4. COMMISSION CONSENT CALENDAR A. Claims and Demands • Resolution No. 2011 – 05 Recommendation: to approve Resolution No. 2011 –
05, entitled: A RESOLUTION OF THE ROSEMEAD COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF ROSEMEAD ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE SUM OF $871,388.39 DEMAND NO. 10102 THROUGH
10103 AND DEMAND NOS. 11439 THROUGH 11448. 5. FROM EXECUTIVE DIRECTOR & STAFF A. Affordable Housing Reimbursement Agreement between the City of Rosemead and the Community Development
Commission of the City of Rosemead and Adopt Related Resolutions for the Project Areas On Monday, January 10, 2011, Governor Brown issued his 2011-12 budget proposal. The proposal includes

Housing Reimbursement Agreement). These funds will be used to preserve and expand the supply of affordable housing consistent with the goals and objectives of the Project Areas No. 1
and 2 (“Project Areas”), the Five-Year Implementation Plan and other CDC commitments. Pursuant to the attached

housing projects and programs with existing and future Low-and Moderate-Income funds, currently 20% of tax increment funds received from the Project Areas, and the City of Rosemead would
implement the affordable housing projects. Recommendation: That the Community Development Commission and the City Council approve an Affordable Housing Reimbursement Agreement between
the Community Development Commission of the City of Rosemead and the City of Rosemead and adopt related Resolutions No. CDC 2011-06 and 2011-06 for the funding of affordable housing
for Project Areas No. 1 and 2. B. Inventory of Community Development Commission, City Council and Rosemead Housing Development Corporation Agreement and Documents An inventory of all
Redevelopment and Housing related commitments and obligations has been conducted. As a result of this review, it has been determined that three documents, which were approved in public
meetings, were never signed or appropriately executed. These documents are the Angelus Senior Housing Land Lease, Garvey Senior Housing Land Lease and the Garvey Senior Housing Assistance
and Operating Agreement. In order to create a clear record of these obligations, the Housing Development Corporation, Community Development Commission and City Council should take action
to ratify the Agreements and authorize the Chairman and Mayor to finalize these documents by signing the agreements. Recommendation: That the Community Development Commission, the Housing
Development Corporation Board and City Council authorize the Chairman/Mayor to sign the Land Lease and Operating Agreements as originally approved. COMMISSION/CITY COUNCIL WILL RECESS

Public Hearing on the Fiscal Year 2011-12 Annual Action Plan for Federally-Funded Programs The City of Rosemead is a federal entitlement grant recipient of Community Development Block
Grant and HOME Investment Partnership funds from the U.S. Department of Housing and Urban Development (HUD). As part of the process to receive funding, the City must undertake development
of a Consolidated Plan and Annual Action Plan. It is called a Consolidated Plan because it consolidates the application process for HUD’s four (4) entitlement grants into one consolidated
plan and application. The four grants are: Community Development Block Grant (CDBG), HOME Investment Partnership Program (HOME), Housing Opportunities for Persons with AIDS (HOPWA),
and Emergency Shelter Grant (ESG). All four grants are driven by an entitlement formula process set by the federal government. The City is eligible to participate in two (2) of these
programs: CDBG and HOME. As part of the requirements of the federal Consolidated Plan process, the City is required to hold a public hearing regarding the projected use of funds prior
to adoption of its Consolidated Plan and Annual Action Plan. In order to receive the FY 2011-12 allocations, the City must comply with the following requirements of the Consolidated
Plan final rule regarding pre-submission requirements: • Fulfill citizen participation requirements by conducting a public hearing to receive citizen input regarding annual funding needs;
• Publish a draft Plan and Annual Action Plan for a 30-day comment period in order to receive citizen input regarding the final document; and

final Plan and the Annual Action Plan. The Annual Action Plan is a part of the Consolidated Plan, which takes all HUD requirements regarding planning, needs analysis, reporting, budgeting,
citizen participation and certifications and incorporates them into one process. The full Consolidated Plan must be completed once every five (5) years and the Annual Action Plan must
be completed annually. Recommendation: That the City Council conduct a public hearing and take public testimony on the Annual Action Plan covering the period July 1, 2011 – June 30,

No. 2011 – 05 Recommendation: to approve Resolution No. 2011 – 05, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE SUM OF
$1,297,451.96 NUMBERED 101134 THROUGH 101148 AND 72403 THROUGH 72568 INCLUSIVELY C. Release of Certificate of Deposit – Tract Map No. 54385 3047-3061 Ivar Avenue A Faithful Performance
Bond and a Labor and Material Bond were required to guarantee construction of new curb and gutter, sidewalks, one driveway approach, one parkway drain, sewer main, laterals and the installation
of survey monuments for Tract Map No. 54385. In lieu of such surety bonds, the sub-divider submitted a Certificate of Deposit to the City in the amount of $24,000.00. The work has been
completed and the Certificate of Deposit can now be released. Recommendation: That the City Council accept the new curb and gutter, sidewalk, driveway approach, parkway drain, sewer
main, laterals, and survey monuments and release of the Certificate of Deposit in the amount of $24,000.00 to the sub-divider.

Efficiency Conservation Block Grant (EECBG) – Rejection of all Bids As part of the City’s 2010-11 Capital Improvement Program budget, the City Council approved a program titled Citywide
Energy Efficiency Improvements, which consists of several modernization projects of existing infrastructure and systems at City facilities. This project includes the replacement of nearly
40 windows and frame components at City Hall. The City’s allocated an amount of $85,000 that was acquired through the American Recovery and Reinvestment Act of 2009 (ARRA). On January
19, 2011, bids were received and reviewed for the project. Based on the analysis of the bids received, it is recommended that all bids be rejected and the project be re-advertised. Recommendation:
That the City Council reject all bids received for this project and direct staff to readvertise the project for bid. 9. MATTERS FROM MAYOR & CITY COUNCIL A. Assemblymember Mike Eng --Formation
of High-Speed Rail Working Group The City Council will consider the appointment of one of its Members to serve on a local High-Speed Rail Working Group being formed by Assemblymember
Mike Eng. The Working Group will be formed as soon as possible to meet on a quarterly basis. Recommendation: That the City Council select one of its Members to serve on Assemblymember
Mike Eng’s High-Speed Rail Working Group. B. City Council Meeting Minutes At the January 25, 2011, regular City Council meeting, various sets of minutes were discussed for approval.
The September 27, 2005 City Council minutes and the December 5, 2005 minutes were deferred for further review. After the January 25th meeting more research was conducted and it was discovered
that these two sets of minutes were approved by City Council on September 12, 2006 to include Mr. Taylor’s errata minutes; however, both sets were not executed by the Mayor or the City
Clerk. In addition, Mayor Taylor has provided certified copies of the December 13, 2005 minutes and the September 7, 2004 minutes taken by a court reporter hired at that time by the
City. The December 13, 2005 court reporter’s minutes were approved by Council on March 28, 2006 and the September 7, 2004 court reporter’s minutes were approved by Council on January
25, 2005; however, they were not executed by the Mayor or the City Clerk.

1. Approve that the Mayor and the City Clerk signed the September 27, 2005 City Council minutes and the December 5, 2005 City Council and include Mr. Taylor’s errata minutes, as previously
approved; and 2. Approve that the Mayor and the City Clerk signed the September 7, 2004 City Council court reporter’s minutes and December 13, 2005 City Council court reporter’s minutes.
10. ADJOURNMENT The next regular joint Community Development Commission and City Council meeting is scheduled to take place on February 22, 2011 at 6:00 p.m. and 7:00 p.m., respectively.
