CALL TO ORDER: The regular meeting of the City of Rosemead Planning Commission was called to
order by Chairman Lopez at 7:00 p.m. in the Council Chambers of the Rosemead City Hall at 8838 East
Valley Boulevard, Rosemead.
Vice - Chairman Kelty led the Pledge of Allegiance.
Commissioner Loi delivered the invocation.

MOTION BY COMMISSIONER BREEN, SECONDED BY VICE - CHAIRMAN KELTY, that the
minutes of the City of Rosemead Regular Planning Commission Meeting of March 5, 2007, be
APPROVED as submitted.

2. EXPLANATION OF HEARING PROCEDURES AND APPEAL RIGHTS
City Attorney Price explained the public hearing process and the right to appeal Planning
Commission decisions to the City Council.
Chairman Lopez asked if anyone would like to speak on any items not on the agenda, to step

3. PUBLIC HEARING
A. CONDITIONAL USE PERMIT 07 -1085 — 3719 N. Delta Avenue. Man Wai Khau has
submitted an application proposing to demolish a portion of an existing single - family
house and construct a two -story addition that will result in approximately 3,244 square feet
of living area, located at 3719 Delta Avenue in the R -1 (Single - Family Residential) Zone.
Presentation: Planning Services Administrator Brad Johnson
Staff Recommendation: APPROVE — subject to the conditions, for one (1) year.
Planning Services Administrator Johnson stated the applicant and representative were
present and asked the Commissioners if they had any questions.
Chairman Lopez called for questions from the Commissioners.

Chairman Lopez opened the public hearing to those IN FAVOR of this application:
Lap Nguyen of 1913 Glen Road, West Covina, CA, the designer for the project stated
the owners accept all the conditions of approval. He then said they have worked really
hard with Planning Staff to incorporate the new design guidelines in their project.
Chairman Lopez said the design is very nice.
Vice - Chairman Kelty agreed.

B. CONDITI ONAL USE PERMIT 07 -1086 — Dorothy Street, between Delta and Rockhold
Avenue. Omnipoint Communication, Inc. has submitted a Conditional Use Permit
application for the installation of an unmanned wireless facility on an existing Southern
California Edison transmission tower located on the south side of Dorothy Street, between
Delta Avenue and Rockhold Avenue in the R -2 (Light Multi - Family) Zone.
Presentation: Senior Planner George Agaba
Staff Recommendation: APPROVE — subject to the conditions, for six (6) months.
Senior Planner Agaba stated the representative was present and asked the Commissioners if
they had any questions.
Chairman Lopez called for questions from the Commissioners.

Chairman Lopez opened the public hearing to those IN FAVOR of this application:
Monica Moretta of One Venture, Suite 200, Irvine, CA, the representative of the project,
stated that her clients have accepted all the conditions and she is present to answer any
questions.
Vice Chairman Kelty said there are a few antennas on this power line. He then
questioned if it will interfere with other antennas.
Ms. Moretta answered only if another satellite carrier is nearby.

C. TENTATIVE PARCEL MAP 068773 AND CONDITIONAL USE PERMIT 07 -1084 — 9301
Glendon Way. Thomas Trieu and Don Trieu have submitted Tentative Parcel Map
068773 and Conditional Use Permit 07 -1084 applications prosing to subdivide one (1)
existing parcel totaling approximately 20,800 square feet into three (3) parcels in order to
develop the property with three new two -story, single - family detached homes. Lot one (1)
is designed with a new single - family residence of 2,658 square feet of living area. All
parcels are located on Glendon Way in the R -1; Single - Family Residential Zone.
Presentation: Senior Planner George Agaba
Staff Recommendation: APPROVE — subject to the conditions, for two (2) years.
Senior Planner Agaba stated the applicant and representatives were present and asked the
Commissioners if they had any questions.
Chairman Lopez called for questions from the Commissioners.
Vice - Chairman Kelty referred to Ms. Debbie Hostetter's letter and questioned if the
applicants have a right to destroy her brick wall.
City Attorney Price stated no.
Vice - Chairman Kelty questioned condition #11 of the City Engineer's Conditions of
Approval. He said he doesn't know what the Planning Commission proposes to do with
this application.
City Attorney Price recommended the Planning Commission to adjourn this case until
two more weeks due to Ms. Hostetter's specific grading questions that probably no one
is prepared to answer. He said the letter is too generalized to meet specific issues
being raised. He also said he doesn't think this issue can be resolved in this meeting.
He added that the City Engineer should be sent to the site for further review.
Senior Planner Agaba stated the final map will require the applicant to do a preliminary
title report, which will identify the existing easements on site right now. He also stated
that if the easement is not addressed, it will not be recorded. He said the adjacent
neighbor is talking about the easement affecting her property. Senior Planner Agaba
also said condition #9 of the City Engineer's Conditions of Approval states the City
Engineer will review drainage plans prior to final approval. He said the final map will
address other issues and he believes the conditions explain that.
Vice - Chairman Kelty looked at the tentative parcel map and stated Ms. Hostetter's
property is one foot lower than their proposed elevation. He said he would like to
amend that condition. Then he asked Ms. Hostetter if her neighbor to the north is
having the same problem.
Ms. Hostetter answered yes.
Vice - Chairman Kelty said he would like to see something stronger than condition #9,
which states: "Prior to the recordation of the final parcel map, grading and drainage
plans must be approved to provide for contributory drainage from adjoining properties as
approved by the City Engineer, including dedication of the necessary easements." He
also said he wants to make sure the problem gets solved before the final plan check or
it'll be too late.
Commissioner Herrera questioned the square footage on lot three and if the first floor
has to be 10% less than the second floor.
Planning Services Administrator Johnson said today's code doesn't specify the
difference; however, item D of the agenda will address that issue.
Chairman Lopez opened the public hearing to those IN FAVOR of this application:
Lap Nguyen of 1913 Glen Road, West Covina, CA, the designer for the project spoke
about the drainage issue. He said he met with Ms. Hostetter last week and inspected
the situation. He said the existing wall is in good condition and they will stucco and keep
it. He also said he has visited the site and the drainage from the rear to the front of the
property is good. He said Ms. Hostetter is concerned about her living room; however, he
doesn't think her drainage problems are from this property. He also said he and the civil
engineer have discussed about a low point in the center of the driveway, so it can drain
out to the curb. As for the existing easement, he said they will work with the City
Engineer to make it work out and be better.
Chairman Lopez asked Mr. Nguyen if he's saying that it's due to the fact that her addition
is lower, so it's just soaking up the rain.
Mr. Nguyen stated yes. He said outside, her dirt is higher, so that's causing a problem
for her when it rains.
Chairman Lopez asked Mr. Nguyen if they are reconstructing the drainage to make sure
there are no drainage problems. He said staff noticed that it drains out to Glendon Way.
He also said staff has said it's not a City responsibility. He said the owner of the
property should take responsibility of keeping it clean.
Mr. Nguyen said they need to study and work with the City Engineer to take care of that
easement.
Chairman Lopez asked the City Attorney Price if that response answers his question.
City Attorney Price said yes, but they must prevent it from going to adjourning properties.
Mr. Nguyen said based on his experience, sometimes, for drainage, they want to build a
block wall with an open surf, but on his side, they will have water flow down the driveway
to the streets.
Chairman Lopez asked staff if it's easy to work on. He also asked staff if this item needs
to be amended for a few more weeks.
Planning Services Administrator Johnson said he would like to hear the rest of the
testimony first.
Chairman Lopez agreed.
Vice - Chairman Kelty questioned if the water from Claudia Circle flows underground.
Planning Services Administrator Johnson stated it is above ground and collects at a
point and then goes into a subterranean storm drain system.
Vice - Chairman Kelty said it looks like there is a four foot difference between the north
property line and Glendon Way. He said during heavy storms, water may collect.
Planning Services Administrator Johnson said it's impossible to say. He also said it's
clear, but plugged with mud and weeds that has been growing there and hasn't been
cleaned at the curb face.
Vice - Chairman Kelty questioned if that can be a condition.
Planning Services Administrator Johnson said we can add a condition to inspect the
underground tubes and verify it doesn't have any damages.
Chairman Lopez asked if there is anyone else in the audience who wished to speak in favor
of this application.
John Wong of 135 N. San Gabriel, San Gabriel, CA, the civil engineer of the project from
Tritech Associates, Inc., stated, the drainage easement is taking a route from Claudia
Circle. He said after the subdivision, the driveway will be lower than the existing
driveway. He also said there will be a slope to generate the water. He stated that he
would need to get all the maps to study the general easements. He said he doesn't
know how drainage systems will affect the west side. He also said Linda Lee Avenue is
a cut de sac, which means the back yard of this property will be higher than the
properties on Linda Lee Avenue.
Chairman Lopez opened the public hearing to those who wished to OPPOSE this application:
Debbie Hostetter of 3608 N. Linda Lee Avenue, Rosemead, CA, a neighboring resident,
stated her drainage concerns. She said she disapproves the project until her drainage
problems are taken care of. She also said she didn't have a problem until the guy at the
end of the cut de sac built his project. She stated she doesn't understand any of this.
Vice - Chairman Kelty asked Ms. Hostetter if the problem is from the water that is coming
from Claudia Circle. He said the subject property is coming from her fence.
Ms. Hostetter said she has no idea where it's coming from and she doesn't know what is
going on.
Vice - Chairman Kelty asked Ms. Hostetter if her neighbor knows where the water is
coming from.
From the audience, Mr. Jack Saengohark answered Claudia Circle. He also said it goes
underneath his block wall.
Ms. Hostetter said moss is growing along his wall. She also said the water put a hole in
her fence and they never asked for permission.
Senior Planner Agaba asked the Planning Commission to view the pictures that he
attached to the staff report. He said picture #1 illustrates the planter is two (2) feet tall
and five (5) feet wide. He also said the proposed project will delete the planter.
Ms. Hostetter said she is upset that they are saying that it is her problem.
Vice - Chairman Kelty said it looks like a streambed. He also said he can easily see the
water go into her property.
Ms. Hostetter thanked Vice - Chairman Kelty for his response. She said she doesn't
know what is going on. She also said she is upset.
Chairman Lopez asked Ms. Hostetter to step forward, so the Planning Commission can
address their questions to her. He said the planter seems to be causing a problem for
her property. He also said staff needs to investigate these issues.
Ms. Hostetter said she thought she would be able to settle these problems with the
applicant and representatives prior to this Planning Commission meeting.
Chairman Lopez stated no, he doesn't think it could be easily resolved. He said staff
needs to do an inspection to see what is causing the problem. He also said staff needs
to identify if the planter is the issue and correct it.
Ms. Hostetter said she does not object to that. She also apologized for being disruptive.
Chairman Lopez asked if there is anyone else in the audience who wished to oppose this
application.
Mr. Jack Saengohark of 3616 N. Linda Lee Avenue, Rosemead, CA, a neighboring
resident, stated he is the third house to the project. He said his problems aren't as bad
as Ms. Hostetter's. Every time it rains, it goes into his garage. He also said he didn't
have as much problems until Claudia Circle came along. He discussed about Claudia
Circle and how they wanted to buy easement on his property. He stated his concerns
and said he wants his problems to be resolved.
Chairman Lopez asked Mr. Saengohark if his problems occurred after the planter was
installed.
Mr. Saengohark answered yes.
Vice - Chairman questioned if it was after 1988.
Mr. Saengohark answered yes.
Commissioner Breen asked Ms. Hostetter what she meant by saying fireplace on the
last paragraph of page two of her letter.
Ms. Hostetter said those are just little things. She said she doesn't really care about the
fireplace. She said she will be facing three (3) windows on the side of her house and
would like them to put a fascia all around.
Senior Planner Agaba said he wanted to address the visual issues. He referred to sheet
A -3 of the plans and said the east elevation will be facing Ms. Hostetter's property.
Ms. Hostetter said the trim around the house is wood and needs to be kept up.
Chairman Lopez said at this time, it will be taken care of by a planner.
Ms. Hostetter answered okay.
Chairman Lopez asked if anyone else would like to speak in the audience.
Mr. Nguyen stated his clients are new property owners. He said he was asked to visit
Ms. Hostetter's property last Friday and based on his knowledge; the easement is the
owner's responsibility. He said she addressed her drainage problems during his visit.
Chairman Lopez said the planter could be the problem. He asked Mr. Nguyen what his
recommendation is.
Mr. Nguyen said he thinks it's the owner's responsibility, but he wants approval from the
City Engineer.
Chairman Lopez asked Planning Services Administrator Johnson if he has anything else to
add.
Planning Services Administrator Johnson stated the neighbor to the north of Ms.
Hostetter could be affected by Claudia Circle. He said from his observations, it could be
the planter that is causing the problem and it's a question that should be addressed to
the City Engineer. He also said there may be a serious reconstruction of the drainage
and the engineer may easily fix that. He said gravity flow is always the best. He wished
these neighbors came in 15 years ago to resolve these issues. He said it may cost
more for the developers of this project. He also said staff will resolve any problems that
affect the neighboring residents. He then asked the Planning Commission if they want
to appease the project and if the City Attorney feels that it's okay.
City Attorney Price said he is okay with the project, as Ion as there is a say in avoiding

drainage in adjourning properties. He questioned the issue of holes in Ms. Hostetter's
wall.
Planning Services Administrator Johnson said he didn't see holes in the wall during his
visit to the subject site.
City Attorney Price said this needs to be addressed in the conditions.
Planning Services Administrator Johnson said it's up to the Planning Commission to
decide on continuance.
Chairman Lopez questioned if anything needs to be added to condition #9 and #10.
Planning Services Administrator Johnson said he thinks City Attorney Price is more
comfortable with modification to the condition and bringing it back for the resolution.
City Attorney Price said that's fine.
Planning Services Administrator Johnson said the resolution is the final say

Planning Services Administrator Johnson stated the current property owner will clear up
Glendon Way.

D1. MUNICIPAL CODE AMENDMENT 07 -01 — City -wide. Over the last nine (9) months the
Planning Department has been working with a City consultant (Bauer Planning &
Environmental Services BPES) to draft single - family home "design guidelines" and
municipal code text amendments to address issues of residential "mansionization ".
While working on these draft documents, the staff along with BPES, conducted a series
of workshops which included the design community, local developers, homeowners, the
Planning Commission and the City Council. Staff is now holding the required public
hearings before the Planning Commission and City Council to adopt the proposed new
"design guidelines" and municipal code text amendments.

Staff Recommendation: Planning Commission recommends City Council APPROVAL of
Ordinance No. 851, adoption of the "City of Rosemead Single
Family Residential Design Guidelines," and the adoption of
Resolution No. 07 -18.
Planning Services Administrator Johnson discussed the history of mansionization and the
positive and negative aspects of Municipal Code Amendment 07 -01. He said there are a few
major changes of the amendment. The first is the floor area ratio (FAR), dropping from 45%
to 35 %; however, there are incentives for the designers to bring up the FAR from 35% to
40 %. Another change relates to R1 zoning and R1 lots. He said lots that are 12,000+ that
are not subdividing. Second floor reduction is also a major change, where the second floor
can't be larger than 66% of the first floor. After his presentation, he asked the
Commissioners if they had any questions.
Chairman Lopez called for questions from the Commissioners.
Commissioner Herrera questioned the second floor reduction and whether projects today
have to follow those guidelines.
Planning Services Administrator Johnson stated there aren't any guidelines today. He
said the biggest concern of all developers is the adoption of these guidelines and wanting
to submit their project prior to the adoption.
Chairman Lopez said it doesn't matter what they say, a date must be set. He said people
may get mad, but a date has to be set.
Commissioner Loi stated he does not object to R1 and R2 zones, but is curious about
Planned Development zones.
Planning Services Administrator Johnson said if a developer comes in and inquires a bout
a Planned Development zone, staff will follow these guidelines.
Commissioner Loi said if the FAR is lowered to 35 %, it's not necessary to increase
Conditional Use Permit applications to single family homes that are 3,000+ sf.
Planning Services Administrator Johnson said it will lesson the burden on staff. It would
create more time for staff to make sure it meets all requirements than to write staff reports
for houses larger than 2,500 sf.
Commissioner Loi said if you exclude little projects, the Planning Commissioners will be
unaware of those projects.
Planning Services Administrator Johnson said that is why he is turning to the
Commissioners for their opinions.
Vice - Chairman Kelty said he agrees with 3,000 sf.
Chairman Lopez said at 2,500 sf, it allows projects to max to 3,000 sf. He prefers to keep
it at 2,500 sf.
Planning Services Administrator Johnson asked the other Planning Commissioners how
they felt.
Commissioner Herrera said 3,000 sf. is quite large.
Commissioner Breen said he is comfortable at 2,500 sf.
Planning Services Administrator Johnson said he will present to City Council that Planning
Commissioners want to keep it at 2,500 sf.
Chairman Lopez said he is afraid increasing the square footage will lead to larger homes.
Vice - Chairman Kelty questioned chain -link fencing.
Planning Services Administrator Johnson said it will be prohibited. He also said it's a
standard.
Vice Chairman Kelty questioned street side -yard on a corner lot.
Planning Services Administrator Johnson said it's historically covered under general
requirements, but it was deleted. He also said it could certainly be added.
Vice - Chairman Kelty said he likes three (3) feet fencing.

Ms. Nancy Eng of 3126 Jackson Avenue, Rosemead, CA, a realtor and Rosemead
resident stated her reservations on these guidelines. She said changing the FAR from
45% to 35% is significant. She also said it makes more sense to adopt these guidelines
after the general plan update.
Mr. Anthony Cordova of 9023 Guess Street, Rosemead, CA, a resident, stated he is here
on a project for college. He said he wanted more information on Planning
Commissioners.
Chairman Lopez said Planning Commissioners are hired by the City Council to oversee
new projects and homes. He also said Planning Department staff brings all projects to
the Planning Commission and the Commissioner's job is to guide people in the direction
through the criteria set forth.
Commissioner Herrera added the Planning Commissioners are all Rosemead residents.
Mr. Cordova asked the Planning Commissioners if they are just normal people who have
jobs.
Chairman Lopez answered yes.
Planning Services Administrator Johnson gave an example of Commissioner Breen's
departure. He said applications will be available for those who are interested and City
Council will appoint the next Commissioner.
Chairman Lopez said every year, a new Chairman is appointed. He also said in a couple
of months, someone else will take over as Chairman.
Mr. Cordova asked Planning Services Administrator Johnson if he does inspections.
Planning Services Administrator Johnson answered yes.
Senior Planner Agaba suggested Mr. Cordova stop by the Planning Department during
business hours to receive further information.
Mr. Cordova said he has no other questions and thanked the Planning Commissioners.

APPROVING CONDITIONAL USE PERMIT 06 -1077, REQUESTING A NEW TWO -
