PC-07-02-07CITY OF ROSEMEAD PLANNING COMMISSION REGULAR MEETING MINUTES July 2, 2007 CALL TO ORDER: The regular meeting of the City of Rosemead Planning Commission was called to order by Chairman Lopez at 7:00 p.m. in the Council Chambers of the Rosemead City Hall at 8838 East Valley Boulevard, Rosemead. Commissioner Kunioka led the Pledge of Allegiance. Vice - Chairman Lopez delivered the invocation. ROLL CALL: PRESENT: Chairman Lopez, Vice - Chairman Kunioka, Commissioners Bevington, Cam, and Vuu ABSENT: None EX OFFICIO: Agaba, Johnson, Trinh, and Yin 1. EXPLANATION OF HEARING PROCEDURES AND APPEAL RIGHTS: Planning Services Administrator Johnson explained the public hearing process and the right to appeal Planning Commission decisions to the City Council. 2. PUBLIC COMMENTS Chairman Lopez asked if anyone would like to speak on any items not on the agenda, to step forward. Mr. Jim Flournoy of 8655 Landis View, a resident, discussed some pending Wal -Mart complaint issues related to dust and the issue of seismic problems in the City. Chairman Lopez asked Planning Services Administrator Johnson a question regarding requirements for fault uses. Planning Services Administrator Johnson answered his question outlining the required seismic requirements and processes the City currently uses. 3. PUBLIC HEARINGS A. Conditional Use Permit 07 -1098 — 9726 E. Valley Boulevard. John Yee, of Lee's Market, has submitted a Conditional Use Permit application for the transfer of ownership of an existing Off -Sale Beer and Wine (Type 20) ABC license in conjunction with a market. Lee's Market is located at 9726 East Valley Boulevard in the C3 -D (Medium Commercial with a Design Overlay) zone. Presentation: Planning Services Administrator Brad Johnson Staff Recommendation: APPROVE — subject to the conditions, for six (6) months. Planning Services Administrator Johnson stated the applicant was present and asked the Commissioners if they had any questions. Chairman Lopez called for questions from the Commissioners. Commissioner Bevington questioned the number of code enforcement staff. Planning Services Administrator Johnson answered his question. Commissioner Bevington stated the importance of enforcement. Planning Services Administrator Johnson agreed. Vice - Chairman Kunioka questioned scientific data behind video surveillance. Planning Services Administrator Johnson answered his question. Vice - Chairman Kunioka questioned condition #25. Planning Services Administrator Johnson answered his question. Chairman Lopez closed the hearing to the Commissioners and opened it to the public. Chairman Lopez opened the public hearing to those IN FAVOR of this application: Mr. Brian Lewin of 9501 Ralph Street, a resident questioned security and lighting. Vice - Chairman Kunioka answered his question. Commissioner Bevington questioned the lighting. Planning Services Administrator Johnson answered his question. Chairman Lopez opened the public hearing to those who wished to OPPOSE the application: None. There being no one further wishing to address the Commission; Chairman Lopez closed the public hearing segment for this project. MOTION BY VICE - CHAIRMAN KUNIOKA, SECONDED BY COMMISSIONER VUU, to APPROVE CONDITIONAL USE PERMIT 07 -1098. Vote results: YES: BEVINGTON, CAM, KUNIOKA, LOPEZ, AND VUU NO: NONE ABSENT: NONE ABSTAIN: NONE Chairman Lopez declared said motion duly carried and so ordered. B. CONDITIONAL USE PERMIT 07 -1099 — 8742 Garvey Avenue. Hoa P. Luu of Banh Xeo Quan Restaurant, has submitted a Conditional Use Permit application requesting approval for a transfer of an On -Sale Beer and Wine (Type 41) ABC license in conjunction with a bona fide public eating establishment located at 8742 Garvey Avenue in the M -1 (Light Manufacturing and Industrial) zone. Presentation: Senior Planner George Agaba Staff Recommendation: APPROVE — subject to the conditions, for six (6) months. Chairman Lopez called for questions from the Commissioners. Vice - Chairman Kunioka questioned the table of uses. Planning Administrative Assistant Lily Trinh answered his question. Commissioner Bevington questioned parking. Vice - Chairman Kunioka stated his concern regarding future vacancies. Planning Services Administrator Johnson answered their question and concern. Vice - Chairman Kunioka agreed. Commissioner Bevington made a statement regarding deadline dates. Attorney Yin addressed his statement. Commissioner Bevington questioned if there is a tracking system. Chairman Lopez questioned if there are guidelines for staff to follow. Planning Services Administrator Johnson answered their questions. Chairman Lopez closed the hearing to the Commissioners and opened it to the public. Chairman Lopez opened the public hearing to those IN FAVOR of this application: None. Chairman Lopez opened the public hearing to those who wished to OPPOSE the application: None. Commissioner Bevington stated applicants should be required to attend the Planning Commission Meeting. He stated his reasoning to why applicants should attend the meeting. Planning Services Administrator Johnson agreed. Attorney Yin agreed. Commissioner Bevington thanked staff. Vice - Chairman Kunioka disagreed and stated they shouldn't be voted against if they aren't present. Commissioner Bevington stated he isn't stating they should be voted against. There being no one further wishing to address the Commission; Chairman Lopez closed the public hearing segment for this project. MOTION BY VICE - CHAIRMAN KUNIOKA SECONDED BY COMMISSIONER VUU, to APPROVE CONDITIONAL USE PERMIT 07 -1099. Commissioner Bevington clarified that this is a new liquor license. Vice - Chairman Kunioka stated it's new because the previous owner let it expire. Vote results: YES: BEVINGTON, CAM, KUNIOKA, LOPEZ, AND VUU NO: NONE ABSENT: NONE ABSTAIN: NONE Chairman Lopez declared said motion duly carried and so ordered. C. CONDITIONAL USE PERMIT 07 -1100 — 9334 De Adalena Street. Thanh Phan submitted a Conditional Use Permit application, requesting approval to construct a new single - family residence on an existing 7,700± square foot parcel currently occupied by a 1,542± square foot single family residence. The applicant is proposing to demolish the existing dwelling unit and replace it with a 3,124± square foot house and attached, three -car garage. The subject site is located at 9334 De Adalena Street in the R -1 (Single - Family Residential) zone. Presentation: Senior Planner George Agaba Staff Recommendation: APPROVE — subject to the conditions, for six (6) months. During the presentation, Senior Planner Agaba distributed revised plans to the Planning Commissioners. Senior Planner Agaba stated the representative was present and asked the Commissioners if they had any questions. Chairman Lopez called for questions from the Commissioners. Commissioner Bevington asked a question regarding conditional use permits and single family residential design guidelines. Planning Services Administrator Johnson answered his question related to the new ordinance and guidelines. Commissioner Bevington stated it's a great neighborhood. Planning Services Administrator Johnson agreed. Vice - Chairman Kunioka made a statement regarding the size. Planning Services Administrator Johnson addressed his statement. Vice - Chairman Kunioka questioned if there are photos of neighboring houses. The applicant's designer distributed three (3) examples of two -story homes on this block to the west. Chairman Lopez opened the public hearing to those IN FAVOR of this application: Mr. Lap Nguyen of 1913 Glen Road, West Covina, CA, the designer for the project stated the owners accept all the conditions of approval. He then said they have worked really hard with Planning Staff to incorporate the new design guidelines in their project. Vice - Chairman Kunioka stated it's a good idea. Mr. Flournoy of 8655 Landis View, a resident, questioned if there is adequate parking. Vice - Chairman Kunioka answered his question. Mr. Flournoy stated he doesn't think that is enough. Chairman Lopez questioned if Mr. Flournoy is in favor of the project. Mr. Flournoy answered yes and questioned second story setbacks. Vice - Chairman Kunioka answered his question. Mr. Flournoy questioned the sheer path seismic engineering and structural loads on the house. Chairman Lopez stated staff will ensure designers are following City requirements. Chairman Lopez opened the public hearing to those who wished to OPPOSE this application: None. MOTION BY COMMISSIONER VUU, SECONDED BY COMMISSIONER BEVINGTON, to APPROVE CONDITIONAL USE PERMIT 07 -1100. Vote results: YES: BEVINGTON, CAM, KUNIOKA, LOPEZ, AND VUU NO: NONE ABSENT: NONE ABSTAIN: NONE Commissioner Bevington questioned the approval for six (6) months. Planning Services Administrator Johnson responded on the reasoning for the six (6) months. Chairman Lopez declared said motion duly carried and so ordered. 4. CONSENT CALENDAR — These items are considered to be routine actions that may be considered in one motion by the Planning Commission. Any interested party may request an item from the consent calendar to be discussed separately. A. Approval o f Minutes — June 18, 2007. Vice - Chairman Kunioka questioned Mr. Lewin's statement regarding the City website downloads. Mr. Lewin answered. Chairman Lopez asked the members of the Commission if there is any reason why Consent Calendar should not be accepted. 10 MOM MOTION BY VICE - CHAIRMAN KUNIOKA, SECONDED BY COMMISSIONER CAM, TO WAIVE FURTHER READING AND ADOPT CONSENT CALENDAR. Vote results: YES: BEVINGTON, CAM, KUNIOKA, AND VUU NO: NONE ABSENT: NONE ABSTAIN: LOPEZ Chairman Lopez declared said motion duly carried and so ordered. 5. MATTERS FROM THE CHAIRMAN & COMMISSIONERS Vice - Chairman Kunioka questioned code enforcement related issues. Planning Services Administrator Johnson answered his questions. Vice - Chairman Kunioka had additional code enforcement questions. Attorney Yin answered his questions. Chairman Lopez asked a question regarding when code enforcement issues can be brought to the courts. Attorney Yin answered his question. 6. MATTERS FROM THE PLANNING SERVICES ADMINISTRATOR AND STAFF Planning Services Administrator Johnson stated Associate Planner Sheri Bermejo is out on maternity leave. He also informed the Planning Commissioners the draft Mixed Use Design Guidelines are available on the website. He said he hopes the guidelines will go to Planning Commission in 4 -5 weeks. Vice - Chairman Kunioka conversed about the 4 of July Parade. Planning Services Administrator Johnson stated the parade will take place on July 4th. He said check -in for Commissioners is at 9:15- 9:30am. Vice - Chairman Kunioka said the starting point is Valley Boulevard and Walnut Grove Avenue. 7.
