MINUTES
August 6, 2007
CALL TO ORDER: The regular meeting of the City of Rosemead Planning Commission was called to
order by Chairman Lopez at 7:00 p.m. in the Council Chambers of the Rosemead City Hall at 8838 East
Valley Boulevard, Rosemead.
Chairman Lopez led the Pledge of Allegiance.
Vice - Chairman Kunioka delivered the invocation.

1. EXPLANATION OF HEARING PROCEDURES AND APPEAL RIGHTS:
Attorney Yin explained the public hearing process and the right to appeal Planning
Commission decisions to the City Council.
2. PUBLIC COMMENTS
Chairman Lopez asked if anyone would like to speak on any items not on the agenda, to step
forward.
Mr. Jim Flournoy of 8655 Landis View, a resident, stated he has reviewed the last
three years Planning Commission agendas and looked at all the lot splits and
subdivisions that were approved by the previous Planning Commission. He said he
has almost a full page of addresses, some more critical than others, that no one has
followed up on. He said the City needs to find a way to follow up on these projects.
Chairman Lopez asked Mr. Flournoy if he's sure they weren't checked.
Mr. Flournoy stated if they were checked, the City would've paid to review it.
Chairman Lopez stated it's done prior to final permit approval, so how can the City
give permits without doing this.
Mr. Flournoy stated this is something that has been missing for the longest time.
Commissioner Bevington questioned if Mr. Flournoy wants the Planning Commission
to review this list for Alquist - Priolo Act,

Mr. Flournoy stated Alquist - Priolo and Seismic Hazard Mapping Act need to be done.
He said there is no evidence that the City has been doing it. He also said he hasn't
pulled files from the archives, just the past three years.
3. PUBLIC HEARINGS
A. Conditional Use Permit 06 -1066 — 9117 Garvey Avenue. Paul V. Gerst of Sequoia
Development Services Inc. has submitted a Conditional Use Permit application
requesting approval to install a 53 -foot high self - supporting monopine wireless
telecommunication tower with four (4) attached antenna for wireless communications
purposes. The tower is proposed to be located behind an existing commercial building,
located at 9117 Garvey Avenue in the City of Rosemead, currently zoned M- 1(Light
Manufacturing and Industrial) zone.
Presentation: Senior Planner George Agaba
Staff Recommendation: APPROVE — subject to the conditions, for one (1) year.
Senior Planner Agaba stated the applicant was present and asked the Commissioners if they
had any questions.
Chairman Lopez stated he will open the public hearing to the applicant before the
Commissioners tonight.
Mr. Paul Gerst of One Venture, Suite, 200, Irvine, CA, the applicant, stated he is
representing on behalf of T- Mobile and the property owner. He said they have gone
through a lot of changes. He also said the property owner is working on a lot of code
enforcement issues. He discussed about the signs and how the owner would like to
restore the existing sign and modify the new one. He said the eastern planter is
something they are willing to do, but between the Edison towers and the building, there
is only 18 feet. He then hands the Commissioners a handout on the existing sign and
proposed sign. He said those are the only conditions that he is concerned with.
Chairman Lopez opened the public hearing to the Commissioners.
Commissioner Bevington questioned the height of the monopine.
Senior Planner Agaba stated it is proposed at 53 feet.
Commissioner Bevington questioned if there is a limit.
Senior Planner Agaba stated the limit is 75 feet.
Commissioner Bevington questioned if one year is sufficient. He discussed about a
similar project at his church and said the provision for emergency generator operated for
24 -hours a day for over two weeks and he hopes this project doesn't intend on doing
that. He said emergency should be defined.

Commissioner Vuu questioned why a condition to remove the roof mounted sign is
added, when the owner has no interest in it.
Senior Planner Agaba stated it is staff's recommendation.
Vice- Chairman Kunioka questioned if an actual pine tree will be installed next to the
monopine. He questioned if a condition should be added to keep the pine tree
maintained for some time.
Mr. Gerst stated it's irrigated. He said there will be maintenance for the first few months,
and the tree will grow on its own.
Chairman Lopez questioned the generator requirement. He asked the applicant if it
becomes a nuisance, would they ignore or fix the problem.
Mr. Gerst stated it's a question with Edison. He said there will be an emergency plan set
aside, but he's not sure how they get it.
Chairman Lopez addressed the question to Planning Services Administrator Johnson.
Planning Services Administrator Johnson said if it's in the drawings. He said staff has to
see their plans prior to installation.
Commissioner Vuu questioned if the property owner is okay with combining the two
signs into one.
Mr. Gerst said he thinks the owners would agree. He said the owners want to put signs
on the front and east side of the building.
Commissioner Vuu said they can combine the two signs and make it larger.
Mr. Gerst said they are willing to work with staff.
Vice- Chairman Kunioka questioned what they are envisioning to replace the signs that
will be removed.
Senior Planner Agaba said staff would like them to propose individual channel letters for
each business.
Chairman Lopez opened the public hearing to those IN FAVOR of this application:
Mr. Jim Flournoy questioned why signage is discussed when the application is for a cell
tower pine tree.
Chairman Lopez said it is part of their Conditions of Approval to upgrade the sign.
Senior Planner Agaba stated it's a discretionary project, so staff looks at everything.

Mr. Flournoy said the sign may be historical, so staff should look into it.
Senior Planner Agaba said it's a discretionary project.
There being no one further wishing to address the Commission; Chairman Lopez closed the
public hearing segment for this project.

B. TEN TATIVE PARCEL MAP 067472 & ZONE VARIANCE 05 -337 — 3033 Willard Avenue.
Ann Chen has submitted an application for the subdivision of two (2) parcels totaling
26,312± square feet into four (4) parcels and a Zone Variance application to deviate from
the minimum required lot size of 6,000 square feet for the construction of a four (4) new
single - family residences; located at 3033 Willard Avenue in the R -2 (Light Multiple
Residential) zone.
Presentation: Senior Planner George Agaba
Staff Recommendation: APPROVE — subject to the conditions, for two (2) years.
Senior Planner Agaba stated the applicant and representative were present and asked the
Commissioners if they had any questions.
Chairman Lopez opened the public hearing to the applicant.
Mr. Kamen Lai of 8748 E. Valley Boulevard, Suite K, Rosemead, CA, the designer of the
project, thanked staff. He said different planners have worked on this project during the
past two years. They previously wanted to eliminate the zone variance, but after
discussions with staff, they came to an agreement to design this development with
consistently shaped lots. He said everyone believes this will be suitable for the
neighborhood. He also said this property is in an R -2 zone and 4,500 square feet is
required for each unit. Mr. Lai stated the front lot is now 5,400 square feet. He said
neighboring properties, like 3034 and 3036 Willard Avenue have less than required
square footage. He also said a mixed use project is being proposed just south of this
project site. He stated there are currently 4 units on the site and they will rebuild 4 new
units. No additional units will be added. He said building big homes doesn't entail more
people living inside. He ended by saying that the owners accept all the conditions and
ask for Planning Commission approval.

Chairman Lopez opened the public hearing to the Commissioners
Commissioner Bevington stated he is disturbed by this. He said every lot is less than
20% of the requirement. He also said they are not talking about ownership, but also
about an easement.
Planning Services Administrator Johnson stated the lots and easements are individually
owned.
Commissioner Bevington voiced concerns with the way the common driveway easement
is designed and owned.
Planning Services Administrator Johnson said the City Engineer adds a condition that
says they must record that these are reciprocal ingress and egress easements for each
lot.
Commissioner Bevington said we're pushing the envelope. He said you are supposed to
have 6,000 square feet, but we are allowing 5,000 square feet. He also said he's not
convinced that Rosemead is going in that direction. He said someone needs to make
this as a declaration.
Vice - Chairman Kunioka questioned the mixed use development.
Senior Planner Agaba said the mixed use project is still undergoing the review process
Commissioner Vuu questioned if they are following the old guidelines and how long does
it take for a project to expire.
Senior Planner Agaba stated yes. He said this project was deemed complete prior to the
new design guidelines. There were several issues from the beginning. He said he
believes it was a design issue, since the shape of the lot is irregular.
Planning Services Administrator Johnson said some local government agencies do set
expiration dates, but Rosemead has never done that. He said sometimes, staff doesn't
get responses, so the project sits for months or years. He also said it's up to the City to
set policies. He mentioned that the City has been flexible with our applicants.
Vice - Chairman Kunioka questioned if the lot design layout is the reason why they took
two years.
Planning Services Administrator Johnson answered yes. He said as well as other
aesthetic exterior elevation type of treatments. He also said sometimes, lack of
response keeps a project from being processed.
Vice - Chairman Kunioka questioned if there are a lot of projects left that are
grandfathering in with the old floor area ratio (FAR).

Senior Planner Agaba stated there are a few left.
Commissioner Vuu asked Planning Services Administrator Johnson if an expiration date
should be adopted, so people do not take advantage of this.
Planning Services Administrator Johnson said a study can be done to see how the
process works in other cities. He also said the City has the Subdivision Map Act that has
state laws that govern how fast we process applications. He said setting a policy can
certainly be looked at.
Chairman Lopez questioned what happens when the applicant comes to a point when he
does not meet the requirements.
Planning Services Administrator Johnson stated these applicants aren't vested legally in
their project developments until the Commission or City Council approves the project.
He said the City set July 12, 2007 as the threshold for a complete application date under
the old guidelines.
Chairman Lopez questioned if anything that came in after that date would have to start
with the new guidelines.
Planning Services Administrator Johnson stated yes, unless staff deemed it complete.
He said a few more projects have met the deadline of July 12.
Chairman Lopez opened the public hearing to those IN FAVOR of this application:
Mr. Jim Flournoy stated the drawings look like they incorporated the new design
guidelines. He said they don't look like monster houses. He then questioned planned
development, the driveway, and the fire sprinklers.
Chairman Lopez agreed.
Mr. Flournoy questioned the number of parking spaces.
Chairman Lopez responded that they incorporate two -car garages.
Vice - Chairman Kunioka added the front lot has a three -car garage.
Mr. Flournoy discussed Building Code Section 113.5 and said these projects need to be
investigated.
Chairman Lopez asked Mr. Flournoy if he is in favor of the project.
Mr. Flournoy answered yes.
Planning Services Administrator Johnson stated the LA County Fire Department wanted
a fire turnaround area. LA County Fire Department said that if the last house and garage
has a sprinkler system, a turnaround on -site is not needed.

Chairman Lopez questioned if there is a required length from the street to the rear.
Planning Services Administrator Johnson stated he believes it's150 feet.
Chairman Lopez questioned if they can park in the driveway.
Planning Services Administrator Johnson stated they can't, it will be red - striped and
signed.
Commissioner Vuu asked Attorney Yin about the vehicle access easement.
Attorney Yin stated it will be up to the attorney of the developer. He said it can certainly
be looked at.
Commissioner Vuu said he's afraid it will be a conflict later on when they want to sell the
property.
Planning Services Administrator Johnson referred to condition 13 of the City Engineer's
Conditions of Approval and said the City has done this for many years. He said ever
since the flag lot ordinance has been adopted, he has never seen a problem. He said
the City Engineer has been reviewing these projects. It has to be maintained or the City
will go in and get the work done. He said it's covered with that condition.
Attorney Yin asked Commissioner Vuu if he would like the Attorney's office to work with
the City Engineer.
Commissioner Vuu answered yes. He said he is concerned with vehicle access for lot 2.
Planning Services Administrator Johnson said the City is well covered.
Chairman Lopez opened the public hearing to those who wished to OPPOSE the application:
Mr. Manuel Roybal of 3863 Delta Avenue, a resident, stated when he moved to
Rosemead 35 years ago, it was very nice and quiet. He said now, the City is allowing
subdivisions and lots less than 6,000 square feet, which allows the reduction of more
space.
Mr. Brian Lewin of 9501 Ralph Street, a resident, stated the design of the houses are
very nice. He said he dislikes the footprints. He also said the houses look crammed
together with the lots being 5,000 square feet.
Chairman Lopez asked the Mr. Lai if he would like to address the oppositions.
Mr. Lai said he appreciates the residents concerns. He said the subdivision in the
neighborhood is a continuation of an allowable subdivision and not a new one on the
block. He also said he hopes they are not misunderstood by only having one variance.
He said the three lots in the back meet the minimum requirements. He also said that

once the project is completed, only one unit will be visible. He said he really thinks it's a
great addition to the neighborhood. He added each unit has a two car garage and each
home has four off - street parking spaces.
Chairman Lopez closed the public hearing segment for this project and asked the
Commissioners for a motion.
Commissioner Vuu stated if the Commission keeps granting variances, new projects will
come in requesting variances.
Commissioner Bevington said this project will upgrade the neighborhood. He then
questions how far should the City push our regulations. He said he doesn't think it's an
easy position.
Vice - Chairman Kunioka said he supports this proposal for a couple of reasons. He said
the applicant is replacing six apartments with four homes, so it reduces density. He also
said the adjacent uses are consistent. He added that it's also responsive to the design
standards.
Motion by Vice- Chairman Kunioka.
Commissioner Bevington asked if the Planning Commission and staff are convinced that
a 26 -foot driveway is really necessary or could it be less to allow more landscaping. He
said he doesn't want to see space wasted.
Planning Services Administrator Johnson said it's a great comment. Planners are always
arguing with the fire department, so space is not wasted.
Chairman Lopez asked to withdraw the motion and open up for discussion.
Commissioner Bevington said he will second the motion.
Planning Services Administrator Johnson said the fire department requires certain widths.
He said staff asked the applicants to make these changes. The lots they came up with
met the requirements, but were so oddly shaped, so staff pushed them for this variance.
He said they can come to the Planning Department with all the requirements met, but the
lot shape with confusing legal descriptions would be odd.

C. Tentative Tract Map 062930 and Conditional Use Permits 05 -1041 through 05 -1046 —
3828 -3848 Charlotte Avenue. Long Trinh has submitted a Tentative Tract Map and
associated Conditional Use Permits for a proposed subdivision of two (2) lots, totaling
44,000 square feet of lot area, to be divided into six (6) lots for the construction of six (6)
new single - family residences, each of which is proposed to be greater than 2,500 square
feet, located at 3828 -3848 Charlotte Avenue. The subject properties are located in the
R -1 (Single Family Residential) zone.

Staff Recommendation: APPROVE — subject to the conditions, for two (2) years.
Planning Services Administrator Johnson discussed about the two letters of complaint that
were addressed to the City. He then stated the applicant and representative were present
and asked the Commissioners if they had any questions.
Chairman Lopez opened the public hearing to the applicant.
Mr. Kamen Lai stated the current owner is the third client that has approached him on
these properties. He said the first client had proposed 8 -9 homes and the preliminary
plans were approved by the previous Planning Director; however, the developer
discovered that the water pipe was too small and the fire department would request that
they install a new 8 -inch pipe, which would cost them $70,000, so they withdrew. He said
the current applicant is willing to spend money to install this new pipe for $100,000. He
also said the applicant has his own architectural style and design, but with this project, he
is willing to completely change his style to satisfy staff. He said the back yards of these
properties are in poor shape. He also said the developer hopes the homes will be
occupied by family, which will fulfill their American dream. He said there is no variance
on this property and all zoning codes are met. He then said behind this property, 3861,
3863, and 3865 on Delta Avenue have been subdivided. He said they are exceeding the
lot size. He also said to develop this property; the developer must put in a lot of money to
install the water pipe that will be beneficial to the whole neighborhood. He then
discussed about the construction of the houses and how it will be a great addition to the
neighborhood. Mr. Lai referred to the privacy concerns of the neighbors and said the
owner is willing to work on his windows. He said they will remove the window from the
walk -in closet on lot 4. He also said they will reduce the side windows in the master
bedroom to five feet. He ended by saying that the developer is willing to work on things
to satisfy the neighbor's concerns.
Chairman Lopez opened the public hearing to the Commissioners.
Vice - Chairman Kunioka questioned if there is a balcony facing east.
Mr. Lai stated yes, but they are willing to work with any recommendations. He said it's
facing the rear yard and they don't have a problem with mitigating the situation.

Commissioner Vuu said the developer is spending a lot of money and making
improvements. He said he is dramatically changing his style and working hard with staff.
He also said the developer is trying his best to accommodate the neighbors, by putting
trees and reducing windows.
Chairman Lopez opened the public hearing to those IN FAVOR of this application:
Mr. Long Trinh of 3226 Muscatel Avenue, the developer of this project, stated the
property belongs to his son. He said five of his children pulled together to build these
homes. He also said it will cost them $180,000- 200,000 to install the new water pipe. He
said his children have come together to fund this pipe. He also said they are willing to
work with the neighbors. He ended by saying that his children do not care about how
much they spend on this project because they plan on living there.
Vice - Chairman Kunioka questioned if all six homes will be occupied by the family.
Planning Services Administrator Johnson answered yes.
Mr. Jim Flournoy questioned the adequacy of the water company capacity on Delta
Avenue.
Planning Services Administrator Johnson stated he's not sure of their master capacity
plans.
Mr. Flournoy questioned how much substandard water pressure there is in the City.
Planning Services Administrator Johnson said our current general plan update process
will require all five water companies to provide their master plans and capacity analysis to
the City.
Mr. Flournoy questioned if it's in the seismic hazard mapping act area.
Planning Services Administrator Johnson said it's in a liquefaction zone, which will
require a report prior to permit issuance, during the plan check stage.
Mr. Flournoy said there is only a 90 -day window, so a condition should be added to get
this done.
Chairman Lopez opened the public hearing to those who wished to OPPOSE the application:
Ms. Barbara Walters of 3861 Delta Avenue, a resident, stated she thinks the plans are
beautiful, but does not understand why there are six homes on the lot, cramming them in.
She said she wouldn't have a problem with four on the lot. She discussed about the 5
feet setback and her concerns. She said they utilize their back yards and having the
balcony or house close to her property makes it a bad design. Making it two -story is
horrible. She asked the Commissioners to consider this because she is upset.

Mr. Juan Camarillo of 3857 Delta Avenue, a resident, said building a home 5 feet from
the wall means that you can oversee everything. He questioned privacy. He said he is
building a home that does not infringe on the neighbors privacy. He said that even with
the ideas that they are working on, it will still create noise and privacy issues.
Mr. Manuel Roybal, owner of the subdivision property, stated when they moved in, the
neighborhood was very quiet and single- storied. He said maybe provisions will be made
for rear yards. He said he also owns 3851 Delta Avenue. Mr. Roybal said he is more
used to a tranquil community. He said this project is no different than saying that the
developer is building an apartment complex. He said he hopes the Commission gives
some thoughts to approving this project. He also said they should have more sensitivity
to the neighborhood.
Ms. Ann Marie Camarillo of 3857 Delta Avenue, a resident, stressed her concern. She
said since the developer is so willing to accommodate the neighbors, we should ask them
to make it single- story. She said they eventually plan on building a pool and it will feel
like someone is looking into their yard.
Mr. Gabriel Roybal of 3863 Delta Avenue, stated he grew up in this City and plans on
expanding his family, but privacy is very important to him and he would like to come
home to privacy. He said a single -story home would be adequate. He asked the
Commissioners to take a hard look at this project and put themselves in his position.
Mr. Kamen Lai addressed the neighbor's concerns. He stated the issue is the two -story
homes, but they are following the City codes. He said they are willing to work with the
neighbors, but the approval or denial should be decided by merit of the project itself. He
also said they have been working hard with the City and are trying their best to satisfy
everyone, but all they can do is follow City codes. He said, for example, the neighbors
are planning to build a swimming pool, so if they avoid building a two -story home and 10
years from now, the neighbors decide to not build the swimming pool, what would happen
to the property to the right of this property owner. He also said the lots are almost one
acre and the owners can add multiple homes, but they are only developing six single -
family homes. He said they are willing to modify the details to satisfy the neighbors.
Chairman Lopez stated the designs are promising. He said he's been a resident for 32
years and he is concerned about the neighbors and some changes need to be done. He
said Mr. Lai's designs are great, but the Commissioners need to be considerate.
Vice - Chairman Kunioka said the only contingents are lots 4 and 5.
Mr. Lai said there is a misconception on lot 5. He said the first floor setback is 10 feet
and the second floor is 10 feet, but the deck over the second floor is 14 feet.
Mr. Trinh said they can reduce the second floor deck to 20 feet. He said only the small
room on the second floor has two windows. He also said they are willing to set the
second floor back 20 feet. He said he's also willing to plant trees for privacy. He wants
to make the rear neighbors happy.

Mr. Lai reiterated what Mr. Trinh said. He said only the small room on the second floor
has the two windows. He said they're willing to set the second floor back 20 -feet and
raise the windows five to six feet. He also said the window in the walk -in closet can be
eliminated.
Mr. Trinh said only the garage roof of 3851 Delta Avenue can be seen. He said all the
setbacks are really good. He said five of them are at 35 -feet and the sixth is at 31 -feet.
Mr. Lai pointed out the setbacks.
Commissioner Vuu said the best solution is to request the owner to setback the second
floor of lot 4 an additional 5 -feet to make it 20 -feet.
Mr. Lai said it would only be good for a stairway and hallway.
Mr. Roybal stood up again and said they are boxed in and privacy is an issue.
Mr. Andrew Walters of 3861 Delta Avenue, a resident, stated there are a couple of
issues. He said Mr. Lai brings up Cypress tree solutions to privacy, but will they do the
upkeep on them. He said with Cypress trees planted, he would not get the nice breeze.
When he extended his property, he was told that it must be setback to a certain square
footage. He questioned if they are talking about a variance now, or to code. He then
asked the Commissioners to take what he said into consideration.
Commissioner Bevington made a motion to continue this public hearing and have staff
work with the designer and neighbors to see what makes sense.
Ms. Caroline Kunioka of 8400 Wells Street, the wife of Vice - Chairman Kunioka, stated
they live in a three -story home. She questioned if the house can be partially
subterranean.
Vice - Chairman Kunioka stated he only thinks lot 5 is too close.
Mr. Don Ishii of 3047 Willard Avenue, a resident, questioned if the previous public
hearing can be continued as well.
Planning Services Administrator Johnson answered no; however, they may appeal to the
City Council. He added that there is a fee for that.
MOTION BY COMMISSIONER BEVINGTON, SECONDED BY VICE- CHAIRMAN KUNIOKA,
to CONTINUE TENTATIVE TRACT MAP 062930 AND CONDITIONAL USE PERMITS 05-
1041 THROUGH 05 -1046 FOR ONE MONTH.
Planning Services Administrator Johnson stated this will give the neighbors time to hold a
neighborhood meeting with the developer and designer. He said staff will send notices
two weeks prior to this continued hearing date.

4. CONSENT CALENDAR — These items are considered to be routine actions that may be
considered in one motion by the Planning Commission. Any interested party may request an

6. MATTERS FROM THE PLANNING SERVICES ADMINISTRATOR AND STAFF
Planning Services Administrator Johnson updated the Planning Commission on
Associate Planner Sheri Bermejo's good news regarding the recent birth of her daughter
and that all are healthy and happy.
