PC-03-06-06CITY OF ROSEMEAD PLANNING COMMISSION REGULAR MEETING MINUTES March 6, 2006 CALL TO ORDER: The regular meeting of the City of Rosemead Planning Conunission was called to order by Chairman Loi at 7:00 p.m. in the council chambers of the Rosemead City Hall at 8838 East Valley Boulevard, Rosemead. Conunissioner Herrera led the Pledge of Allegiance. Chairman Kelty delivered the invocation. ROLL CALL: PRESENT: Chairman Loi, Vice - Chairman Lopez and Commissioners Herrera, and Kelty ABSENT: Cornmissioner Breen EX OFFICIO: Bermejo, Johnson, and Price 1. APPROVAL OF MINUTES Minutes of February 6, 2006 MOTION BY COMMISSIONER HERRERA, SECONDED BY COMMISSONER LOPEZ, that the minutes of the City of Rosemead Regular Planning Commission Meeting of February 6, 2006, be APPROVED as submitted. Vote results: YES: LOI, HERRERA, KELTY, AND LOPEZ NO: NONE ABSENT: BREEN ABSTAIN: NONE Chairman Loi declared said motion duly carried and so ordered. 2. EXPLANATION OF HEARING PROCEDURES AND APPEAL RIGHTS Deputy City Attorney Price explained the public hearing process and the right to appeal Planning Commission decisions to the City Council. 3. PUBLIC HEARING A. CONDITIONAL USE PERMIT 06 -1052 — 9368 Valley Boulevard, Suite 102 Hong Ling Du has submitted an application for the establishment of a dance studio, Du's Art Company, located in the C -31); Medium Cormnercial with a Design Overlay zone. Presentation: Assistant Planner Bennejo presented staff report. Staff Recommendation: APPROVE — subject to the conditions, for six (6) months. Chairman Loi called for questions from the Commissioners. None. Applicant(s): In the audience Chairman Loi opened the public hearing to those IN FAVOR of this application. Ted Liu, representing the applicant, offered to answer questions regarding the project. Public hearing was opened to those who wished to OPPOSE the application: None There being no one further wishing to address the Commission; Chairman Loi closed the public hearing segment for this project. MOTION BY COMMISSIONER LOPEZ, SECONDED BY COMMISSIONER HERRERA, to APPROVE Conditional Use Permit 06 -1052, subject to conditions. TENTATIVE TRACT MAP 053715 — 8646 Grand Avenue Huong Duong has submitted an application for a Tentative Tract Map to subdivide one (1) parcel into five (5) residential lots for the development of five (5) new single- family residences in the R -1; Single - Family Residential zone. Staff Recommendation: APPROVE- subject to the conditions, for two (2) years. Presentation: Plaiming Director Johnson presented the staff report. CONDITIONAL USE PERMIT 05 -1033 — 8232 Garvey Avenue Tony Hua and My Thi Pham of My Dung Restaurant have submitted an application for a Conditional Use Permit for the transfer of an On -Sale Beer & Wine (Type 41) ABC license in conjunction with a bona fide public eating place, in the C3 -D; Medium Commercial with a Design Overlay and P; Automobile Parking zones. Presentation: Assistant Planner Bermejo presented the staff report. Staff Recommendation: APPROVE- subject to the conditions, for six (6) months. TENTATIVE PARCEL MAP 053650 AND CONDITIONAL USE PERMIT 03 -914 (A, B, C, D) (EXTENSION) — 4619 Muscatel Avenue. Project architect Lap Nguyen has proposed a project that consists of the subdivision of one parcel into eight lots for the development of eight new single - family residences. Four of the proposed residences will have over 2,500 square feet of living area. Staff Recommendation: APPROVE — subject to conditions, for one (1) year. Presentation: Planning Director Johnson presented a letter from the applicant requesting an extension. MOTION BY COMMISSIONER KELTY, SECONDED BY COMMISSIONER LOPEZ, to APPROVE Tentative Parcel Map 053650 and Conditional Use Permit 03 -914 (A, B, C, D) (Extension), subject to all conditions. RESOLUTION 06 -04 — A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA APPROVING CONDITIONAL USE PERMIT 05 -1027, REQUESTING THE DEVELOPMENT OF ONE (1) NEW SINGLE - FAMILY RESIDENCE; HAVING MORE THAN 2,500 SQUARE FEET OF LIVING AREA, TO BE LOCATED AT 3737 TEMPLE CITY BOULEVARD IN THE R -1; SINGLE - FAMILY RESIDENTIAL ZONE. (APN: 8993- 021 -002). B. RESOLUTION 06 -05 — A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA APPROVING CONDITIONAL USE PERMIT 05 -1029, FOR A NEW ON -SALE BEER AND WINE (TYPE 41) ABC LICENSE IN CONJUNCTION WITH A BONA FIDE EATING ESTABLISHMENT, LOCATED AT 8752 VALLEY BOULEVARD, IN THE C- 3D (MEDIUM COMMERCIAL WITH A DE4SIGN OVERLAY) ZONE. (APN: 5390 -010- 081). C. RESOLUTION 06 -06 — A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, APPROVING DESIGN REVIEW 04 -119 (MODIFICATION), FOR THE REPLACEMENT OF THE EXISTING PYLON SIGN FACE AND CABINET LOCATED AT 8960 VALLEY BOULEVARD. (APN: 5390- 012 -063). D. RESOLUTION 06 -07 — A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, APPROVING CONDITIONAL USE PERMIT 06 -1047, FOR THE TRANSFER OF AN ON -SALE GENERAL (TYPE 47) ABC LICENSE FOR A BONA FIDE PUBLIC EATING ESTABLISHMENT, LOCATED AT 8800 GARVEY AVENUE IN THE M -1 (LIGHT MANUFACTURING AND INDUSTRIAL) ZONE. (APN: 5282- 025 -003). Chairman Loi presented the resolutions by title only. MOTION BY COMMISSIONER LOPEZ, SECONDED BY COMMISSIONER HERRERA, to waive further reading and adopt said resolution. MATTERS FROM CITY OFFICIALS AND STAFF Commissioner Kelty noted that there is an abandoned car at the comer of Earle and Mission and Planning Director Johnson agreed to follow up on the situation.
